ccreg 10-02-01 Schertz City Council-Regular Session Tuesday, October 2, 2001 The Schertz City Council convened in Regular Session on Tuesday, October 2, 2001 at 7:00pm in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Schertz, Texas. Those present were as follows: Mayor Hal Baldwin, presiding; Councilmembers Reginna Agee, Norma Head, Ken Greenwald, Tim Swinney, and Billy Pitts. Staff present: City Manager Dewey P. Cashwell Jr. and Planning and Zoning Secretary Mary Ybarra. Mayor Baldwin called the meeting to order at 7:00pm and then asked everyone to rise and join him in the Pledge of Allegiance. # I Hearing of Residents: None signed up to speak. #2 Consider and take Action of final reading of Ordinance rezoning approximately41.48 acres out of Guadalupe Connty from R-2 to NS and R-4: Mayor Baldwin introduced an Ordinance and read the caption as follows: ORDINANCE NO. 01-S-21 BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS AMENDING THE UNIFIED DEVELOPMENT CODE (UDC) ORDINANCE NO. 96-S-28 BY REZONING APPROXIMATELY 41.48 ACRES OUT OF GUADALUPE COUNTY AND REFLECTING SUCH CHANGES ON CERTAIN ZONING MAPS IN ACCORDANCE WITH THE SCHERTZ UDC ORDINANCE. Without further discussion, Mr. Greenwald moved to approve the final reading of Ordinance rezoning approximately41.48 acres out of Guadalupe County from R-2 to NS and R-4. Mr. Swinney seconded the motion, which carried with the following votes: AYES: Councilmembers Greenwald, Agee, Pitts, and Swinney NAYS: Councilmember Head #3 Discuss Service Plan on Annexation process for GUADCO MUD 1- Northcliffe and MUD 2-Scenic Hills: f' Mr. Cashwell noted the annexation process is moving forward steadily and reported the following have been done for this annexation: . an updated schedule that includes all activities to this point . Cibolo ETJ maps have been accomplished and ordinances will be provided . there has been a meeting between Schertz and Cibolo to make minor adjustments . City Attorney is taking care of the notices and other details for setting of a public hearing 1 r " . City has obtained the legal descriptions ofthe MUD's . there was a City Council briefing on September 26th . service plan elements have been presented . draft notices of proposed annexation have been sent to the two school districts that require notice . the draft service plans and resolutions for setting the annexation hearings have been placed into City Council packets Mr. Cashwell commented the goal is to achieve the same level of service to MUD I & 2 that is provided to the rest of the City. Mr. Simonson explained the area that is being considered is the entire Northcliffe area, the area that is not currently developed, the Scenic Hills area and all the way over to Covers Cove. He estimated about 2,000 people living in the area with 81'p>v"imately 700-800 homes. Mr. Simonson noted this includes the golf course, water & sewer plant, and future land that has not been developed at this time. Mayor Baldwin stated the purpose of this item tonight is to establish a listing of things that the City of Schertz can provide. This has been achieved by the service plan that has been established. #4 Discuss and set public hearing on Annexation of GUADCO MUD 1- Northcliffe and MUD 2-Scenic Hills: Mr. Cashwell reported the public hearings for MUD I & 2 will be October 16, 2001 and November 6, 2001. He noted MUD I & 2 are exactly the same, which is the reason for having the public hearing the same day for both (if there were any problems with one, then there would be the same problems with the other). Mayor Baldwin introduced a Resolution and read the caption as follows: RESOLUTION NO. 01-R-30 BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS AUTHORIZING THE CALLING OF TWO PUBLIC HEARINGS FOR THE CONTEMPLATED ANNEXATION OF GUADCO MUNICIPAL UTILITY DISTRICT NO.1, WHICH IS GENERALLY KNOWN AS THE NORTH CLIFFE SUBDIVISION AND PART OF THE SCENIC HILLS SUBDIVISION. Without further discussion, Mr. Greenwald moved to approve the public hearings scheduled for October 16th and November 6, 2001 for the Annexation of GUADCO MUD I-Northcliffe and MUD 2-Scenic Hills. Mr. Pitts seconded the motion, which carried with the following votes: AYES: Councilmembers Head, Greenwald, Agee, Pitts, and Swinney 2 NAYS: None Mayor Baldwin introduced a Resolution and read the caption as follows: RESOLUTION NO. 01-R-31 BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS AUTHORIZING THE CALLING OF TWO PUBLIC HEARINGS FOR THE CONTEMPLATED ANNEXATION OF GUADCO MUNICIPAL UTILITY DISTRICT NO.2, WHICH IS GENERALLY KNOWN AS THE NORTHCLIFFE SUBDIVISION AND PART OF THE SCENIC HILLS SUBDIVISION. Mr. Greenwald seconded the motion, which carried with the following votes: AYES: Councilmembers Head, Greenwald, Agee, Pitts, and Swinney NAYS: None Mayor Baldwin introduced the County Commissioner Jim Wolverton and County Treasurer Larry Jones and apologized for not introducing them at the beginning of the meeting. He then introduced Mrs. Briscoe's school class and a Boy Scout who is earning a badge for citizenship. Mrs. Head announced Design Day for the Playscape will be October 23rd. Mr. Cashwell reported bids were received for the Schertz Parkway Project. There were seven bids received and all but one is in excess of the bond amount. Mr. Cashwell noted, after talking with staff, the best approach would be to go back out for bids again in three to four weeks.
