ccreg 10-16-01 Schertz City Council-Regular Session Tuesday, October 16, 2001 The Schertz City Council convened in Regular Session on Tuesday, October 16, 2001 at 7:00pm in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Schertz, Texas. Those present were as follows: Mayor Hal Baldwin, presiding; Councilmembers Reginna Agee, Norma Head, Ken Greenwald, Tim Swinney, and Billy Pitts. Staff present: City Manager Dewey P. Cashwell Jr. and Planning and Zoning Secretary Mary Ybarra. Mayor Baldwin called the meeting to order at 7:00pm and then asked everyone to rise and join him in the Pledge of Allegiance. #1 Hearing of Residents: Mr. Robert Brockman asked why the Ordinance for the fire truck does not say "fire truck". Mayor Baldwin thanked Mr. Brockman and noted he made a good point, it should say "fire truck". Mr. Cashwell stated the language of the document had to be very specific for the posting ofthe notice. Mr. Spain indicated the City could add an amendment. #2 Public Hearing: To receive citizen comments on proposed annexation of GUADCO No.1 (Northcliffe Subdivision) and GUADCO No.2 (Scenic Hills Subdivision). Mr. Spain announced the public hearing for MUD I was set for 7:00pm and the public hearing for MUD 2 was set for 8:00pm. He suggested Council start with hearing #1, proceed with the rest of the agenda, and then come back to hearing #2. Mr. Cashwell stated MUD I and MUD 2 are identical. The service plans and the schedule of events are provided tonight for anyone who wishes to have one. He reported the annexations are on schedule for completion and would then be effective December 31, 200 I. All requirements have been met and all notifications have been sent. Mayor Baldwin asked if anyone would like to speak st the public hearing for MUD I. No one spoke. There being no further business to discuss, Mayor Baldwin closed the public hearing for MUD I at 7: I Opm. #3 Ordinance: Consider and take action on second and final reading of an ordinance by the City Council for Tax Notes, series 2001. Mayor Baldwin introduced an Ordinance and read the caption as follows: 12 ORDINANCE NO. 01-M-22 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS AUTHORIZING THE ISSUANCE OF "CITY OF SCHERTZ, TEXAS TAX NOTES, SERIES 2001", LEVYING AN ANNUAL AD VALOREM TAX, WITHIN THE LIMITATIONS PRESCRIBED BY LAW, FOR THE PAYMENT OF THE NOTES; PRESCRIBING THE FORM, TERMS, CONDITIONS, AND RESOLVING OTHER MATTERS INCIDENT AND RELATED TO THE ISSUANCE, SALE, AND DELIVERY OF THOSE NOTES; AUTHORIZING THE EXECUTION OF A PAYING AGENT/REGISTRAR AGREEMENT AND A PURCHASE AND INVESTMENT LETTER; COMPLYING WITH THE REQUIREMENTS OF THE DEPOSITORY TRUST COMPANY'S LETTER OF REPRESENTATIONS; AND PROVIDING AN EFFECTIVE DATE Mayor Baldwin stated this is the Ordinance approving the purchase of the fire truck. Without further discussion, Mr. Greenwald moved to approve the final reading of an ordinance by the City Council for Tax Notes, series 2001. Mrs. Agee seconded the motion, which carried with the following votes: AYES: Councilmembers Head, Agee, Greenwald, and Pitts. NAYS: None. #4 Resolution: Consider and take action nominating Sylvia Schlather to the Board of Directors for the Guadalupe County Appraisal District. Mayor Baldwin introduced a Resolution and read the caption as follows: RESOLUTION NO. 01-R-33 BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS NOMINATING A MEMBER TO THE BOARD OF DIRECTORS OF THE GUADALUPE COUNTY APPRAISAL DISTRICT. Without further discussion, Mrs. Agee moved to nominate Sylvia Schlather to the Board of Directors for the Guadalupe County Appraisal District. Mrs. Head seconded the motion, which carried with the following votes: AYES: Councilmembers Head, Agee, Greenwald, and Pitts. NAYS: None. #5 Resolution: Consider and take action to install a traffic signal at FM 3009 at Dietz Road/Live Oak Road. 13 Mayor Baldwin introduced a Resolution and read the caption as follows: RESOLUTION NO. 01-R-32 TO INSTALL TRAFFIC SIGNAL AT FM3009 AT DIETZ ROAD/LIVE OAK ROAD. Mr. Cashwell explained there has been sufficient proof that a traffic light is needed in this location and recommends that City Council approve and adopt the Resolution relating to this issue. Mr. Pitts asked if this type of Resolution has been done before. Mayor Baldwin answered it has been, but its been a long time. Without further discussion, Mr. Greenwald moved to approve the resolution to install a traffic signal at FM 3009 at Dietz Road/Live Oak Road. Mrs. Head seconded the motion, which carried with the following votes: AYES: Councilmembers Head, Agee, Greenwald, and Pitts. NAYS: None. #6 Resolution: Consider and take action on an agreement with the Texas Department of Transportation for construction, maintenance and operation of highway lighting systems within a municipality. Mr. Cashwell reported this has been pending for a long time and there is a need to come forward and start paying the bill. Mayor Baldwin introduced a Resolution and read the caption as follows: RESOLUTION NO. 01-R-34 BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION FOR CONSTRUCTION, MAINTENANCE AND OPERATION OF HIGHWAY LIGHTING SYSTEMS WITHIN A MUNICIPALITY. Without further discussion, Mrs. Head moved to enter into an agreement with the Texas Department of Transportation for construction, maintenance and operation of highway lighting systems within a municipality. Mr. Pitts seconded the motion, which carried with the following votes: AYES: Councilmembers Head, Agee, Greenwald, and Pitts. 14 NAYS: None. #7 Consider and take action on the certified tax roll: Mr. Cashwell briefly reviewed some ofthe numbers on the tax role. Without further discussion, Mr. Greenwald moved to approve the certified tax role. Mrs. Head seconded the motion, which carried with the following votes: AYES: Councilmembers Head, Agee, Greenwald, and Pitts. NAYS: None. #8 Executive Session: Called under Chapter 551 Texas Govemment Code, sub-section 551.074 Personnel Matters: Evaluation of City Manager and compensation thereof. An Executive Session was held from 7:25pm until 8:00pm. Mayor Baldwin opened the public hearing for the annexation of MUD 2 at 8:00pm. Mr. Cashwell reiterated what he said at the first public hearing. Mr. Frank Judson reported he is glad to see this annexation being accomplished. He also noted that during a meeting with GBRA, they asked him to sign a contract for buying a new sewer plant. Mayor Baldwin advised Mr. Judson not to sign any contracts or papers until the City Attorney has a chance to look at them. Mr. Mike Claypool noted any document or contract signed by either district could terminate the annexation. Mayor Baldwin thanked Mr. Judson for bringing that to the attention of the City Council. There being no further business to discuss, Mayor Baldwin closed the public hearing at 8:10pm. At this time, City Council went back into Executive Session from 8:10pm until 9:30pm. #9 Action, if any, on the above Executive Session: No action was taken. Mr. Cashwell announced the joint City Council meeting with Cibolo for tomorrow is cancelled. Upon discussion, it was decided to reschedule for November I, 200 I. 15 Mr. Swinney stated he had attended a Live Oak function where Mrs. Amy Madison represented the City very well. Mr. Cashwell noted the TML conference is November 28_30th and there is a City Council meeting scheduled for November 28th. He asked if Council would like to forego that meeting. The consensus of Council was to forego the meeting of 11/28/01.
