ccreg 02-05-02 REGULAR SESSION FEBRUARY 5, 2002 The Schertz City Council convened in Regular Session on Tuesday, February 5, 2002 at 7:00 p.m. in the Municipal Complex Council Chambers, 1400 Schertz Parkway,Schertz, Texas. Those present were Mayor Hal Baldwin, presiding; Councilmembers Norma Head; Billy Pitts; Tony Wilenchik and Ken Greenwald. Absent; Councilmember Reginna Agee. Staff present were City Manager Dewey P. Cashwell, Jr. and City Secretary Norma Althouse. Mayor Baldwin asked everyone to rise and join him in the Pledge of Allegiance to the Flag. He then welcomed students from Samuel Clemens High School to the meeting. #1 HEARING OF RESIDENTS Shirley Hester, Robin Dwyer and Kim Stange, all candidates in the upcoming County election, had signed up to speak. Each candidate made a brief presentation and thanked Council for their time. After the presentations, Mrs. Head introduced her grandson Dylan Head. Gilbert Hernandez of 18975 Old Wiederstein Road stated he had been a property owner in the City of Schertz since 1974. He owns several lots in Scenic Hills. He recently received a letter from a Real Estate Attorney offering to purchase his lots for $2000 each. Otherwise, he would be assessed the cost for development of the lots. This attorney claims he has the backing of the City. Mr. Hernandez says he feels intimidated and wants to know where City Council stands on this issue and what his rights are. The same thing occurred several years back and then the developer went bankrupt. Mr. Hernandez wants to sell the lots at his price and not the developer's price. Mr. Cashwell told Mr. Hernandez the staff had met with the developer, Mr. Eugenio, and felt he has a good plan for development of the area. He would provide water, sewer and streets and assess a fair share to property owners who did not wish to sell. Assit. City Manager, Steve Simonson, related this is a dormant area and today was the first meeting the City had with the developer (so much for City backing). Council has to make the final decision before this development could take place. He advised Mr. Hernandez he does not have to sell. Mr. Cashwell pointed out it is a long way until culmination of this project. Mr. Hernandez asked to be apprised of the status and possibly participate in the process. He provided a copy ofthe letter from Mr. Eugenio to Council. Robert Brockman of 4505 Grand Forest inquired how many lots are off Wiederstein Road and Mark Marquez, Management Services, replied there are 188 lots on the west side of Schertz Parkway. 84 Mr. Brockman then asked how the official newspaper for the City is chosen. Mayor Baldwin answered the official newspaper, by law, has to have a second class mailing permit and the Herald Newspaper doesn't have one, but the Seguin Gazette-Enterprise does. Mr. Brockman then expressed concern about places where the trees are not trimmed and worries that the paint on the new fire truck will get scratched. He would like for the newspaper to write an article addressing this problem. Mr. Brockman inquired what exactly is a Certified city. City Attorney, Michael Spain, was going to check on that and hasn't done so yet. Lastly, Mr. Brockman commented that he liked the new name plaques for Council. #2 Presentation of check for Playscape by Carolyn Keas, Vice-President of Member Services, Randolph Region, Randolph Brooks Federal Credit Union. Carolyn Keas and Josh Moran of Randolph Brooks Federal Credit Union presented a check for $10,000 in support of the Playscape. Mrs. Head graciously thanked them for the generous donation. #3 Presenttion offranchise fee check by Marcus Pridgeon, General Manager GVEC. Marcus Pridgeon introduced some people with him - Lou Borgfeld, President of the Board of Directors, Bobby Christmas, Operations Division Manager and Sean Alvarez, Area Manager. Mr. Pridgeon remarked it's always a pleasure to serve Schertz. He presented a quarterly check to the City in the amount of $44,291.33. Mr. Cashwell told Mr. Pridgeon he was ever so grateful that GVEC had stepped forward to help with the Playscape. He knows also they have a pending agreement to co-locate some fiber optics. He appreciates the use of their meeting facilities and knows they are active in the Schertz Business Association. Mr. Pridgeon commented what's good for Schertz is good for GVEC. At this itme, Council took a short recess. #4 ORDINANCE: Consider and take action on final reading of Ordinance calling for a City election on May 4, 2002. Mayor Baldwin introduced an Ordinance and read the caption as follows: ORDINANCE NO. 02-E-l BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, CALLING AN ELECTION TO BE HELD ON MAY 4, 2002 FOR THE PURPOSE OF ELECTING A MAYOR AND TWO COUNCILMEMBERS FOR SAID CITY. 85 Mr. Greenwald moved to approve the final reading of an Ordinance calling for a City election on May 4, 2002. Mrs. Head seconded the motion, which carried with the following votes: AYES: Councilmembers Head, Pitts, Wilenchik and Greenwald. NAYS: None. #5 APPOINTMENTS: Consider and take action regarding appointments to Library Board. Mrs. Head moved to appoint the following members to the Library Board: Barbara Ricks, Chairperson, Pia Jarman, Vice-Chairperson, Mary McAllister, Secretary, Julie Parr, Treasurer, and Margaret Riley, Ruth Tienor, Simone Bailey and Jennifer Wallace as Board Members. Mr. Greenwald seconded the motion, which carried with the following votes: A YES: Councilmembers Head, Pitts, Wilenchik and Greenwald. NAYS: None. #6 EASEMENT: Consider and take action approving request for GVEC Right-of- Way Easement for Good Shepherd Catholic Church. Mr. Pitts verified this was initiated by GVEC and not the City, so there is no cost. Mr. Pitts moved to approve the request for a GVEC Right-of-Way Easement for Good Shepherd Catholic Church. Mr. Wilenchik seconded the motion, which carried with the following votes. A YES: Councilmembers Head, Pitts, Wilenchik and Greenwald. NAYS: None. #7 Discuss and then take action appointing a Councilmember to the 4-Board. Mr. Wilenchik was asked ifhe would serve on the 4-B Board and he accepted Mr. Greenwald moved to appoint Tony Wilenchik as a member of the 4-B Board. Mrs. Head seconded the motion, which carried with the following votes: AYES: Councilmembers Head, Pitts, Wilenchik and Greenwald. NAYS: None. 86 #8 AUDIT: Consider and take action authorizing audit for MUD #1. Mr. Cashwell related that the audit for MUD #2 had been completed. The audit for MUD #1 was incomplete. It is anticipated it will not exceed $6800. Mr. Greenwald moved to authorize an audit for MUD #1 in an amount not to exceed $6800. Mr. Wilenchik seconded the motion, which carried with the following votes: AYES: Councilmembers Head, Pitts, Wilenchik and Greenwald. NAYS: None. Regarding the Playscape Project, Mrs. Head reported she had spoken with people at Samuel Clemens High School and is going back Friday. She also spoke with HEB this morning. She noted that Mayor Baldwin had volunteered to man the tool trailer. Everyone is jumping in there and she is excited. Mrs. Head reminded everyone of the Walkathon on February 23'd and the Golf Tournament on March 8th. You can sign up either at the Library or at City Hall. Mr. Cashwell mentioned that the installation of pipe that crosses the Guadalupe River in Seguin provides for a walking bridge.
