REGULAR COUNCIL MEETING
MARCH 5, 2002
The Schertz City Council convened in Regular Session on Tuesday, March 5, 2002 at
7:00 p.m. in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Schertz,
Texas. Those present were Mayor Hal Baldwin, presiding; Councilmembers Norma
Head, Reginna Agee, Tony Wilenchik and Ken C''''';'u,;ald. Absent: Councilmember
Billy Pitts. Staff present were City Manager Dewey P. Cashwell, Jr. and City Secretary
Norma Althouse.
Mayor Baldwin introduced former Councilmember, Don Seeba, and Wyatt Agee, student
representative for the Transportation Safety Advisory Committee. He also welcomed
students from Joyce Briscoe's government class. He then asked everyone to rise and join
him in the Pledge of Allegiance to the Flag. Following the Pledge, Bea Sykes, candidate
for Guadalupe County Clerk, made a brief presentation.
#1- Comments by Kim Park.
Kim Park thanked the City and Council for their amazing and unbelievable support
following a tragic on-the-job accident in which she lost a leg. She commented that all the
support she received taught her spiritual growth. She will be going to Houston in April to
get a new prosthesis.
Mr. Cashwell presented Ms. Park with a large picture for her office which contained the
caption "I will try again tomorrow." She was surprised and very grateful.
#2 - HEARING OF RESIDENTS
Robert Brockmasn of 4505 Grand Forest made the following comments:
(a) Last night at the Schertz Parkway Zone meeting they mentioned traffic control signs
on Woodland Oaks Drive. He would like to suggest a traffic control sign at Wiederstein
Road and Schertz Parkway
(b) Once again stressed he is against trees in the roadway.
(c) Noted TSAC is having trouble getting their agendas to the City in a timely manner
for posting.
(d) Referred to Item #7 on the agenda and asked if they are talking about cobblestone
sidewalks. John Bierschwale, Public Works Director, explained it is a Y, inch imprint
into the cement, which gives the impression of cobblestone. It is ADA approved.
Mark Roberts of 4300 Spanish Oak referred to the Sign Ordinance regarding electronic
signs. He felt electronic signs should be allowed, especially when they' are not on a major
thoroughfare.

Mayor Baldwin stated electronic signs are more of a traffic distraction than they are ugly
David Richmond, Planning and Zoning Chairman, pointed out that safety is the big issue.
Mayor Baldwin then went on to say the City has granted variances in the past and
probably will in the future, but the Sign Ordinance gives them a handle on the situation.
He advised Mr. Roberts he was not dead in the water - he should bring his case before
Planning and Zoning. The City needs a law in place for those that pose a danger. Mr.
Cashwell pointed out that all electronic signs are not scrolling signs.
#3 - ORDINANCE: Consider and take action regarding final reading of revised Sign
Ordinance.
Mayor Baldwin introduced an Ordinance and read the caption as follows:
ORDINANCE NO. 02-S-2
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, PROVIDING
THAT THE UDC, CITY OF SCHERTZ, TEXAS BE AMENDED BY DELETING
ARTICLE IX, SIGN STANDARDS, AND REPLACING SAME WITH A
REVISED ARTICLE IX, SIGN STANDARDS; PROVIDING AN EFFECTIVE
DATE; AND REPEALING ALL ORDINANCES IN CONFLICT.
Mayor Baldwin inquired ifthere were any further changes to the revised Sign Ordinance.
He was told there were not.
Mr Greenwald moved to approve the final reading of the revised Sign Ordinance. Mrs.
Head seconded the motion, which carried with the following votes:
AYES' Councilmembers Head, Agee, Wilenchik and Greenwald.
NAYS. None.
#4 - BID WARD: Consider and take action awarding bid for rescue-pumper #217.
Mr Cashwell expressed the hope that the long saga of rescue-pumper #217 is about to
come to an end. They received one bid from the Garden Dale Volunteer Fire Department
in the amount of $3850 00. They had determined when they decided to put the item up
for bid again that they wouldn't take less than what it cost to run the ad. The cost was
$179.00 Approval of the bid is recommended. It satisfies the desire of the "Helping Our
Own" organization.
Mr Greenwald moved to award the bid for rescue-pumper #217 to the Garden Dale
Volunteer Department in the amount of $385000. Mrs. Agee seconded the motion, which carried with the following votes:

AYES: Councilmembers Head, Agee, Wilenchik and Greenwald.
NAYS: None.
Following the vote, Mr. Greenwald commented the law needs to be changed which
prevents an entity from donating equipment to another entity unless they are in another
country.
#5 - CONTRACT: Consider and take action regarding GVEC Interlocal Contract for
pole co-location.
Mr. Cashwell advised Council the document before them this evening is complete. On
page 5 of the contract is paragraph 7, which covers indemnification. On page 7,
paragraph 13 covers the terms of the agreement. GVEC has been very cooperative.
Connie Lock is here this evening to answer any questions.
Mrs. Agee moved to approve the Interlocal Agreement between GVEC and the City of
Schertz for pole co-location. Mr. Wilenchik seconded the motion, which carried with the
following votes:
AYES: Council members Head, Agee, Wilenchik and Greenwald.
NAYS. None.
#6 - ORDINA~CE: Consider and take action on first reading of Ordinance repealing
Ordinance 96-M-13, Ordinance 96-M-15, Ordinance 96-M-21 and Ordinance 96-M-22.
Mayor Baldwin introduced an Ordinance and read the caption as follows:
AN ORDINANCE
REPEALING ORDINANCE NO. 96-M-13, ORDINANCE NO. 96-M-15,
ORDINANCE NO. 96-M-21 AND ORDINANCE NO. 96-M-22 AND OTHER
MATTERS IN CONNECTION THEREWITH.
Mr. Cashwell explained that Live Oak Hills was platted in the 1960's. An earlier
development plan had assessment fees, but the developer didn't follow through. Now a
new developer is interested in the property. The reason for the ordinance is so that the
earlier proposal for development doesn't reflect on the current developer.
Mr. Greenwald moved to approve the first reading of an ordinance repealing Ordinance
No. 96-M-13, Ordinance No. 96-M-15, Ordinance NO.96-M-21 and Ordinance No.
96-M-22. Mrs. Head seconded the motion, which carried with the following votes:

#7 - CHANGE ORDER: Consider and take action approving change order #1, Schertz
Parkway Construction Project.
Mr. Cashwell informed Council that Ford Engineering has obtained a cost from Austin
Bridge and Road to construct a colored pattern design sidewalk. The cost is $62, 985.00.
The Parkway Board was unanimous on the sidewalk and approval is recommended. The
quote given by Austin Bridge and Road is within the budget.
John Bierschwale, Public Works Director, had colors, style selections and choice of two
brick imprint designs for Council to consider. Mayor Baldwin asked how deep the
imprint would be and Mr. Bierschwale answered y, inch and the width is 14 inch. The
Mayor then observed it might be hard to clean. Mr Wilenchik thought it might give
better drainage off the sidewalk. Mr. Bierschwale agreed that it should.
Council liked the reddish color and the cobblestone and Mrs. Agee noted there are more
upsides than downsides. The color is good, there would be no puddling and it
discourages skateboarding. Mrs. Head observed that all the rock walls along Schertz
Parkway are white and the sidewalk would be red.
Mr. Wilenchik commented his concern is harmony throughout the City. There are
normal sidewalks, there's the new sidewalk on FM 78, and if they go with this, Schertz
Parkway would stand out. Mr. Greenwald noted it makes the Schertz Parkway sidewalk
unique. It is a primary entrance to the City.
Mr. BierschwaIe suggested they do a test pattern of about 400 to 500 feet and if they
don't like it, they can stop. Mrs. Agee mentioned that color blends in with the mulch.
Mrs. Head pointed out that mulch fades from sunlight, but it will be an exciting idea to
look at after it gets started. Perhaps they could incorporate it into the marketing of
entryways into the City.
Mrs. Agee remarked they could still do cobblestone even if they don't like the color. Mr
Bierschwale said he would ask the contractor to do a small portion so they can see what it
looks like. Mayor Baldwin added he thinks it will look good.
Mr Greenwald moved to approve change order #1 for the Schertz Parkway Construction
Project to Austin Bridge and Road in the amount of $62,985.00 with the provision the
contractor do a small portion first as a sample. Mr Wilenchik seconded the motion,
which carried with the following votes:
AYES Council members Head, Agee, Wilenchik and G, "".. ..a1d.
NAYS None.

Mrs. Head reminded Council of the golf tournament on Friday. The Playscape begins
Monday and money continues to come in.
Mr. Greenwald s~ated the City needs to look at Emergency Management rules - he
understands there have been some changes in the law.
Mr. Cashwell reminded everyone of the Doggie Dash on March 30th to benefit the
Schertz Humane Society. He also told Council they have a narrative in their packets
from the Department of Health and a copy of the agenda for the Schertz/Cibolo joint
Council meeting on March 7th.
Mayor Baldwin mentioned the Spring Clean Up from March 9th through March 24th
from 8:00 a.m. to 6:00 p.m. daily.
#8 - ADJOURNMENT
There being no further business to discuss, Mayor Baldwin adjourned the meeting at
7:56 p.m.
