ccreg 04-02-02 SCHERTZ CITY COUNCIL REGULAR SESSION APRIL 2, 2002 The Schertz City Council convened in Regular Session on Tuesday, April 2, 2002 at 7:00 p.m. in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Schertz, Texas. Those present were s follows: Mayor Hal Baldwin, presiding; Councilmembers Norma Head, Billy Pitts, Reginna Agee, Tony Wilenchik and Ken Greenwald. Staff present were City Manager Dewey P Cashwell, Je. and City Secretary Norma Althouse. Mayor Baldwin welcomed everyone to the meeting and asked them to rise and join him in the Pledge of Allegiance to the Flag. #1- PROCLAMATION A Proclamation was presented to City Inspector, Leonard Truitt, declaring the week of April 7th through April 13th as National Building Safety Week. Mr. Truitt informed everyone the Inspection Department would have an open house on Wednesday, April 10th from 8:00 a.m. until 5:30 p.m. #2 - APJ>ROV AL OF MINUTES' Workshop Session Regular Session Workshop Session Regular Session January 09, 2002 January 15,2002 January 30, 2002 February 05, 2002 Mr. Greenwald moved to approve the minutes, as written for the Workshop Session of January 9, 2002, the Regular Session of January 15, 2002, the Workshop Session of January 30, 2002 and the Regular Session of February 5, 2002. Mrs. Head seconded the motion, which carried with the following votes: AYES: Councilmembers Head, Pitts, Agee, Wilenchik and Greenwald. NAYS' None. #3 - HEARING OF RESIDENTS (a) Ramon Cook of 903 Dimrock stated that several of the many reasons they chose to live in Schertz was because of the excellent reputation of the Fire Department and the EMS Department. Mr. Cook went on to say that on February 21, 2002 his wife collapsed at 5:30 p.m. ofa total system failure. The emergency personnel arrived within minutes of being called, treated his wife with dignity and transported her to the hospital. He thanked particularly Preston Wegert and John Hernandez of EMS and Leon Sposari, Tim Zelenak and Loy Bodony of the Fire Department. Mr. Cook then jokingly informed Council he had been empowered by the Schertz/Seguin Local Government Corporation to let them know there are no free bridges in Schertz. 130 Lastly, Mr Cook wanted to know if the seats in the Chamber were ever going to be improved. (b) Robert Brockman of 4505 Grand Forest commented on the following: Noted the Playscape has temporary restrooms and is in need of a water fountain. Mentioned that the sign out in front of the Police Department says the landscaping is maintained by the Woodland Oaks Garden Club. There are several dead trees out there. Personnel from the Fire Department cut the grass at the public safety buildings and it seems to be in good shape. Commented the Fire Department personnel are parking cars inside the compound. They are defeating the purpose of the compound by parking there. Reported that in the Handy Andy parking lot there is a car parked with an expired license plate and an expired inspection sticker After his comments, Mayor Baldwin presented a photograph to Mr. Brockman that was taken of him working at the Playscape. (c) Johnie McDow of 465 Twinpoint Creek updated Council on BVY A activities. Opening Day is Saturday, April 6th at 10:45 a.m. preceded by a parade at 9:00 a.m. that starts at the First Baptist Church on Aero. They have 42 teams this year They have 9 softball teams with 120 girls. They have a total of 580 children and 470 of them are 10 years old or younger They have the largest softball organization for pony in the City of San Antonio area. They are still working on the restroom facilities with volunteers. He gave Mr Cashwell a list of the tournaments. There are 3 all-star tournarnents in the June/July timeframe. He appreciates the school district allowing them to use their practice fields. They use City buildings for their meetings. Over 500 children play basketball. They expect soccer to be more intense this year. Mr. Greenwald asked that someone check to make sure no one else has rented the pavilion for April 6th. (d) Mark Marquez, Management Services Director, introduced Fred Juarez who is newly appointed to the Parkway Zone Board of Directors. Msyor Baldwin thanked Mr. Jusrez for coming to the meeting. #4 - Consider and take action approving audit for Fiscal Year 2001 (October 2000- September 2001), Nancy Vaughan of Armstrong, Vaughan & Associates was as the meeting. She commented they had reviewed the audit at the workshop last week and the City is in a healthy financial condition. Ms. Vaughan said she would be glad to answer any questions. 131 There were no questions, but Mayor Baldwin related that the Audit Committee was made up of him. Mr. Cashwell, Mr Vijay Jain and Mrs. Reginna Agee. He then thanked Ms. Vaughan for her work on the audit. Mrs. Agee moved to approve the audit for Fiscal Year 2001 (October 2000 - September 2001). Mr. Greenwald seconded the motion, which carried with the following votes: AYES. Councilmembers Head, Pitts, Agee, Wilenchik and Greenwald. NAYS: None. #5 - Consider and take action on Interlocal Agreements with Guadalupe, Comal and Bexar Counties in compliance with HB 1445. Mr. Cashwell explained that in response to HB 1445, Michael Spain, City Attorney, has drafted Interlocal Agreements for Guadalupe, Comal and Bexar Counties for their consideration and approval. HB 1445 gives cities the authority to enforce subdivision regulations in their ETJ's. Mr. Greenwald moved to approve the Interlocal Agreements between the City of Schertz and Guadalupe, Comal and Bexar counties in compliance with HB 1445 Mr. Pitts seconded the motion, which carried with the following votes: AYES: Councilmembers Head, Pitts, Agee, Wilenchik and Greenwald. NAYS: None. #6 - Consider and take action on revised vacation policy. Mr. Cashwell indicated the revisions to the vacation policy mainly have to do with housekeeping items. He is trying to streamline the process by leaving the decisions for each department's employee vacations up to the department heads rather than having to come through him for approval. The needs of the organization come first and he feels this is the best way to handle it. Mr Pitts moved to approve the revised vacation policy, as written. Mr. Wilenchik seconded the motion, which carried with the following votes: AYES: Councilmembers Head, Pitts, Agee, Wilenchik and Greenwald. NAYS: None. 132 #7 - Consider and take action setting a calendar date for trip to the well site. Mr. Cashwell said he would like for Council to consider a Saturday before the hot weather sets in. Mayor Baldwin asked if he would be working in coordination with Seguin and Mr Cashwell replied yes. After a brief discussion about several dates, May 11, 2002 was tentatively set as the date for the trip to the well site. The final setting of the date will depend on Seguin. #8 - RESOLUTION: Consider and take action authorizing a Resolution in support of 20th anniversary of charitable bingo in Texas. Mayor Baldwin introduced a Resolution and read the caption as follows: RESOLUTION No. 02-R-3 BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS MARKING THE 20TH ANNIVERSARY OF THE PASSAGE OF THE LAW THAT AUTHORIZED CHARITABLE BINGO IN TEXAS. Mrs. Head moved to approve the Resolution in support of the 20th anniversary of charitable bingo in Texas. Mr. G........../a1d seconded the motion, which carried with the following votes: AYES Councilmembers Head, Pitts, Agee, Wilenchik and Greenwald. NAYS: None. #9- EXECUTIVE SESSION: Called under Chapter 551 Texas Government Code, Sub-Section 551.072, deliberation regarding real property. An Executive Session was held from 7:40 p.m. until 8'40 p.m. #10 - Action, if any, on above Executive Session. Mr. Pitts moved that the City of Schertz enter into an earnest contract with Paul Silber. Mr. Wilenchik seconded the motion, which carried with the following votes: AYES' Councilmembers Head, Pitts, Agee, Wilenchik and Greenwald. Nays: None. Mayor Baldwin asked if anyone had anything to discuss before the meeting is adjourned.
