ccreg 06-04-02 CITY COUNCIL REGULAR SESSION JUNE 4, 2002 The Schertz City Council convened in Regular Session on Tuesday, June 4, 2002 at 7:00 p.m. in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Schertz, Texas. Those present were Mayor Pro-Tem Billy Pitts, presiding; Councilmembers Norma Head; Reginna Agee; Tony Wilenchik and Ken Greenwald. Absent: Mayor Hal Baldwin. Staff present were City Manager Dewey P Cashwell, Jr. and City Secretary Norma Althouse. Mayor Pro-Tern Billy Pitts presided over the meeting due to the absence of Mayor Hal Baldwin. #1 HEARING OF RESIDENTS Robert Brockman of 4505 Grand Forest had the following comments: . Wondered if the City could get programmable thermostats for the buildings. It bothers him that the air conditioning system runs on weekends. John Bierschwale, Public Works Director, related they are working on plans for a new air conditioning system and it will be programmable. Mr. Brockman then questioned the system in the Community Center and was told it is closed down when the offices are not in use. . Questioned ifthere will be an ordinance any time soon regarding cell phone use in vehicles. Mayor Pro- Tem Pitts explained it would be a hard ordinance to enforce. . Noted there is a caution light at First and Main and he is recommending one where Aero crosses Lindburgh. Mayor Pro-Tem Pitts suggested it be brought to the attention of the TSAC Committee. Mr. Cashwell said he would bring it up at the TSAC meeting this week. #2 PUBLIC HEARING: To receive citizen comments on removal ofajunked vehicle at 3442 Northern Heights. The procedures were explained that would be followed for the public hearing. No citizens were present for comments. Leonard Truitt, City Inspector, explained that two certified letters had been sent to the owner and both were unclaimed. Also, a door hanger went unanswered. On a trip through the neighborhood, it was noticed the door was open, but by the time the employees got to the door it had been closed and the homeowner would not answer. #3 Consider and take actio!! as a result of the public hearing on the junked vehicle at 3442 Northern Heights. 190 Mr Greenwald moved to take action for removing the vehicle from 3442 Northern Heights. Mrs. Agee seconded the motion, which carried with the following votes: AYES. Commissioners Head, Agee, Wilenchik and Greenwald. NAYS. None. #4 ORDINANCE: Consider and take action on final reading of Ordinance rezoning 30.075 acres from Predevelopment (PD) to ApartmentlMulti-Family Residential (R-4). Mayor Pro- Tem Billy Pitts introduced an Ordinance and read the caption as follows: ORDINANCE NO. 02-8-13 BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS AMENDING THE UNIFIED DEVELOPMENT CODE (UDq ORDINANCE NO. 98-S-28 BY REZONING 30.075 ACRES OUT OF GUADALUPE COUNTY AND REFLECTING SUCH CHANGES ON CERTAIN ZONING MAPS IN ACCORDANCE WITH THE SCHERTZ UDC ORDINANCE. Mr. Cashwell reminded Council this Ordinance comes to them through the recommendation of the Planning and Zoning Commission. The property is adjacent to the golf course in Northcliffe. There have been no changes to the Ordinance since the first reading was approved. Mrs. Head inquired if any other property owners responded since the last reading of the ordinance. The City Secretary replied there had been no further responses. Mr. Greenwald moved to approve the final reading of an Ordinance rezoning 30.075 acres from Predevelopment (PO) to ApartmentlMulti-Family Residential (R-4). Mr Wilenchick seconded the motion, which carried with the following votes: AYES: Councilmembers Head, Agee, Wilenchik and Greenwald. NAYS None. #5 ORDINANCE: Consider and take action on final reading of Ordinance revising Code of Ordinances, Section 18-75, MaximumLimits in School Zones and Section 18-76 - Stop Intersections. Mayor Pro-Tern Pitts introduced an Ordinance and read the caption as follows: 191 ORDINANCE NO. 02-D-ll BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS PROVIDING THAT THE CODE OF ORDINANCES OF THE CITY OF SCHERTZ, TEXAS BE AMENDED BY REVISING SECTION 18-75, MAXIMUM LIMITS IN SCHOOL ZONES AND SECTION 18-76, MAXIMUM LIMITS ON SPECIFIC STREETS; AND PROVIDING A REPEALING CLAUSE. Mr. Cashwell advised Council this Ordinance comes to them through a recommendation by TSAC and approval of the appropriate staff. There have been no changes since the first reading of the Ordinance. Mrs. Head moved to approve the final reading of the Ordinance revising the Code of Ordinances, Section 18-75, Maximum Limits in School Zones and Section 18-76, Maximum Limits on Specific Streets. Mr. Greenwald seconded the motion, which carried with the following votes: AYES. Councilmembers Head, Agee, Wilenchik and Greenwald. NAYS: None. #6 ORDINANCE: consider and take action on final reading of Ordinance revising the Code of Ordinances, Section 18-32, Stop Intersections. Mayor Pro-Tern Billy Pitts introduced and Ordinance and read the caption as follows: ORDINANCE NO. 02-D-12 BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS PROVIDING THAT THE CODE OF ORDINANCES OF THE CITY OF SCHERTZ, TEXAS BE AMENDED BY REVISING SECTION 18-32, STOP INTERSECTIONS- DESIGNATED GENERALLY; AND PROVIDING A REPEALING CLAUSE. Mr. Cashwell indicated this Ordinance comes to Council as a result of growth and annexation. There have been no changes since the first reading of the Ordinance. Mr. Greenwald moved to approve the final reading of an Ordinance revising the Code of Ordinances, Section 18-32, Stop Intersections - Oesignated Generally. Mr Wilenchik seconded the motion, which carried with the following votes: AYES: Councilmembers Head, Agee, Wilenchik and Greenwald. NAYS: None. 192 #7 ORDINANCE: Consider and take action on first reading of Ordinance providing for disannexation of. 97 acres of land within the corporate limits of the City of Schertz. Mayor Pro-Tern Billy Pitts introduced and Ordinance and read the caption as follows: AN ORDINANCE PROVIDING FOR THE DISANNEXATION OF .97 ACRES OF LAND \\'unli'O THE CORPORATE LIMITS OF THE CITY OF SCHERTZ, TEXAS AND RELATED MATTERS. Mr. Cashwell explained that in the process of arranging a swap with Universal City, this parcel is part of that arrangement. Mrs. Biegert is in favor of the disannexation. He also noted there had been two spelling corrections to the Ordinance. In Exhibit A, paragraph one, the spelling of the Torribo Herrera Survey has been corrected and in paragraph two, the spelling of the City of Schertz has been corrected. Mr. Greenwald moved to approve the first reading of an Ordinance providing for disannexation of .97 acres ofland within the corporate limits of the City of Schertz Mrs. Agee seconded the motion, which carried with the following votes: AYES: Councilmembers Head, Agee, Wilenchik and Greenwald. NAYS: None. #8 PLA YSCAPE: Oiscuss itemized cost sheet on the Playscape. Mr. Cashwell told Council they have before them an itemized sheet prepared by Vijay Jain, Finance Director, and the budget expenditures stayed pretty tight. So far, they have reached 91% of their goal. Mrs. Head emphasized the important thing is the dollars at the bottom. They have been assured by Time Warner three times they were going to contribute, but still haven't seen any money from them. She asked Mr Cashwell to give them a call. Mrs. Head went on to say they set an ambitious revenue collection and fell short by only $432. #9 Discussion of forms to be used for City Manager's evaluation. Mr. Cashwell noted it is timely to follow through on these matters. He could not find his document crafted from various evaluation forms. He asked Council to bring theirs forward. 193 Mayor Pro-Tern Pitts asked Council for their recollection. Where did they leave off'? What did they decide? Mrs. Agee remembered the calculation of scoring being under discussion. Mayor Pro-Tem Pitts was sure he had the final product on disk and would redistribute it to Council. Mr Greenwald suggested it be on the next workshop agenda. #10 EXECUTIVE SESSION: Called under Chapter 551 Texas Government Code, Sub-Section 551 072 - Oeliberation regarding acquisition of property An Executive Session was held from 7:30 p.m. until 8.15 p.m. #11 Action, if any, on above Executive Sessiou. No action was taken. Before adjournment, Mr. Cashwell announced that Leisure Services Oirector, Jason Hall, would come on board in mid-June. He has been employed in Round Rock where he worked and orchestrated activities at a 55,000 square foot Community facility.
