ccreg 11-07-00 REGULAR SESSION OF THE SCHERTZ CITY COUNCIL NOVEMBER 7, 2000 The Schertz City Council convened in Regular Session on Tuesday, November 7, 2000 at 7:00 p.m. in the Council Chambers of the Municipal Complex, 1400 Schertz Parkway, Schertz, Texas. Those present were as follows: Mayor Hal Baldwin, presiding; Councilmembers Norma Head; Joe Potempa; Reginna Agee and Ken Greenwald. Staff present were Interim City Manager Steve Simonson and City Secretary Norma Althouse. Mayor Baldwin welcomed everyone and asked them to rise and join him in the Pledge of Allegiance to the Flag. Following the Pledge, Proclamations were presented to Mr. C.A. Kenney, a citizen, and to Sergeant Michael Harris of the Schertz Police Department to recognize an event that occurred July 7, 2000. Mr. Stanley Lipien, a neighbor of Mr. Kenney, collapsed near his home and Mr. Kenney innnediately called 911 and summoned aid, and then began CPR Sergeant Harris assisted with the CPR until an ambulance arrived. Mr. Lipien was also in attendance and is recuperating nicely. Mayor Baldwin mentioned this event bears recognition and re-establishes our filith in mankind. #1 APPROVAL OF MINUTES: Regular Session Special Workshop Session Regular Session 09-05-00 09-13-00 09-19-00 Mrs. Head stated that on page 6, under the minutes of 9-5-00, first paragraph where it breaks down the votes, Mr. Potempa should be under the AYES and she should be under the NAYS. Mrs. Head then moved to approve the minutes for 9-5-00, as amended, and the minutes for 9-13-00 and 9-19-00, as written. Mr. Greenwald seconded the motion, which carried with the following votes: AYES: Councilmembers Head, Potempa, Agee and Greenwald. NAYS: None. #2 HEARING OF RESIDENTS No one had signed up to speak. #3 GUADALUPE COUNTY HOSPITAL: Consider and take action on request from Guadalupe County Hospital. Mr. Simonson explained they are asking for a $10,000 donation from the City to help their Prescription Assistance Program. The City Attorney is working up an agreement. Mr. Greenwald moved to donate $10,000 to Guadalupe County for their Prescription Assistance Program contingent on an agreement being worked up by the City Attorney. Mr. Potempa seconded the motion, which carried with the following votes: ( 23 AYES: Councilmembers Head, Potempa, Agee and Greenwald. NAYS: None. #4 ORDINANCE: Consider and take action on final reading of Ordinance rezoning 71.08 acres from R-l and R-4 to R-5. (Besch property). Mayor Baldwin introduced an Ordinance and read the caption as follows: ORDINANCE NO. OO-S-32 BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS AMENDING THE UNIFIED DEVELOPMENT CODE (UDC) ORDINANCE NO. 96-S-28 BY REZONING APPROXIMATELY 71.08 ACRES OUT OF GUADALUPE COUNTY AND REFLECTING SUCH CHANGES ON CERTAIN ZONING MAPS IN ACCORDANCE WITH THE SCHERTZ UDC ORDINANCE. Mayor Baldwin mentioned they had already held the public hearing on this and approved the first reading of the ordinance. Mr. Simonson added that the name of the subdivision is going to be Wynn Brook. Mrs. Agee moved to approve the final reading ofan Ordinance rezoning 71.08 acres from R-l and R-4 to R-5. Mr. Greenwald seconded the motion, which carried with the following votes: AYES: Councilmembers Head, Potempa, Agee and Greenwald. NAYS: None. #5 APPOINTMENTS: Consider and take action appointing Commissioners to Housing Authority. Mrs. Agee moved to approve the appointment, by Mayor Baldwin, of Earl Sawyer and Lawrence Dixon as Commissioners to the Housing Authority. Mr. Potempa seconded the motion, which carried with the following votes: AYES: Councilmembers Head, Potempa, Agee and Greenwald. NAYS: None. #6 APPOINTMENTS: Consider and take action regarding appointments to Schertz Economic Development Corporation (4B Board). Mr. Potempa moved to appoint the following to the 4B Board: a. Reginna Agee for a two-year term until September 30, 2002; b. Ken Greenwald for a two-year term until September 30, 2002; and 24 c. Ramon Cook for a two-year term until September 30, 2002. Mr. Greenwald seconded the motion, which carried with the following votes: AYES: Councilmembers Head, PV''''''l'''' Agee and Greenwald. NAYS: None. #7 ORDINANCE: Consider and take action on first reading of Ordinance regarding rewrite of Chapter 5 of the Code of Ordinances (Buildings and Building Regulations). Mayor Baldwin introduced an Ordinance and read the caption as follows: AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES, CITY OF SCHERTZ, TEXAS BE AMENDED BY DELETING CHAPTER 5, BUILDINGS AND BUILDING REGULATIONS, AND REPLACING SAME WITH A REVISED CHAPTER 5, BUILDINGS AND BUILDING REGULATIONS; AND PROVIDING A REPEALING CLAUSE. Mr. Simonson advised the fees are on a separate schedule as requested by Council. Mr. Greenwald moved to approve the first reading of an Ordinance regarding rewrite of Chapter 5 of the Code of Ordinances (Buildings and Building Regulations). Mr. Potempa seconded the motion, which carried with the following votes: AYES: Councilmembers Head, Potempa, Agee and Greenwald. NAYS: None. #8 BID AWARD: Consider and take action awarding bid for fire truck. Steve Simonson stated that Chief Woodward is recommending the bid for the fire truck be awarded to Ferrara in the amount of $225,000. Mr. Potempa moveq to award the bid for a fire truck to Ferrara in the amount of $225,000. Mrs. Agee seconded the motion, which carried with the following votes: AYES: Councilmembers Head, Potempa, Agee and Greenwald. NAYS: None. #9 Consider and take action regarding possible cancellation of November 15, 2000 workshop. 25 Mr. Simonson explained that the annual TML Conference is next week and Council has traditionally cancelled the workshop during that week. Mr. Potempa moved to cancel the workshop normally scheduled for November 15,2000 due to the Annual TML Conference. Mr. Greenwald seconded the motion, which carried with the following votes: AYES: Councilmembers Head, Potempa, Agee and Greenwald. NAYS: None. #10 CITY MANAGER'S REPORT . Mentioned receiving a letter from the Chamber of Commerce and they are holding a mixer on Tuesday, November 14th at the Sports Bar at Retarna Park. Please let him know if you plan to attend. . Reported John Bierschwale has been busy securing acre feet of water. The plans are for 3.991.4 acre feet in 2001 and 3.438.4 acre feet in 2002. . Referred to the landscaping project and said they've had a little rain and will have to reschedule. . Advised the RFP for a Municipal Solid Waste Collection and Disposal provider was sent out. Council has copies in their packets. If there are changes, an addendum can be done. #11 ITEMS BY COUNCIL Mrs. Head: . Stated she met with the Library Board and they are very concerned about the roof on the library. It is still leaking badly. As soon as the City can go out for bids, the Library Board would appreciate it. Mr. Potemna: . Reported he and Mayor Baldwin and his wife, Barbara, attended the ceremony for the Paragon Hometown Hero from Schertz, D.C. Morgan. It was a very nice ceremony. Mayor Baldwin indicated they need to hold as reception similar to the one they had last year for Ruth Tienor. The reception was scheduled for November 21, 2000 at 6:30 p.rn., prior to the Council meeting. 26 Mr. Greenwald: . Mentioned the drainage structure at Schertz Parkway and E. Live Oak Road is full of branches. Also, the ditch behind Clyde Ford Village is not flowing well - there's a build-up ofleaves and trash. . Noted it looks like the contractor has a problem with the FM 78 bridge. #12 ITEMS BY MAYOR . Read a letter from TXDoT about a public meeting scheduled for November 14, 2000 at 7:00 p.rn. at 307 W. Court in Seguin. The meeting concerns 2002 - 2005 projects. Everyone is invited.
