ccreg 12-05-00 REGULAR SESSION OF THE SCHERTZ CITY COUNCIL DECEMBER 5, 2000 Prior to the meeting, at 6:30 p.m., a reception was held for D.C. Morgan. Mr. Morgan was chosen as the Paragon Hometown Hero from Schertz. Many, many of his friends showed up for the reception. Pictures were taken and refreshments and conversation were enjoyed by all. The Schertz City Council convened in Regular Session on Tuesday, December 5, 2000 at 7:00 p.rn. in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Schertz, Texas. Those present were as follows: Mayor Hal Baldwin, presiding; Councilmembers Norma Head; Joe Potempa; Glyn D. Williams and Ken Greenwald. Absent: Councilmember Reginna Agee. Staff present were Interim City Manager Steve Simonson and City Secretary Norma Althouse. Mayor Baldwin welcomed everyone and then asked them to rise and join him in the Pledge of Allegiance to the Flag. #1 APPROVAL OF MINUTES: Special Workshop Session 09-27-00 Regular Session 10-03-00 Mr. Greenwald moved to approve the minutes, as written, for the Special Workshop Session of 9-27-00 and the Regular Session of 10-3-00. Mr. Williams seconded the motion, which carried with the following votes: AYES: Councilmembers Head, Potempa, Williams and Greenwald. NAYS: None. #2 HEARING OF RESIDENTS No one had signed up to speak. #3 BID AWARD: Consider and take action awarding bid for police vehicles. Council had received a memo from Chief Smith in their packets. He called Michigan to check on the good and bad points of purchasing Chevrolets. If they got Chevrolets, they could use their light bars, but would need an adapter. He is still recommending they purchase Fords. Mr. Williams thanked Chief Smith for all the additional research. Mr. Greenwald moved to award the bid for police vehicles to Northside Ford in the amount of $80,594.76. Mr. Potempa seconded the motion, which carried with the following votes: ( 36 AYES: Councilmembers Head, Potempa Williams and Greenwald. NAYS: None. #4 ORDINANCE: Consider and take action on final reading of Ordinance regarding Stop intersections. Mayor Baldwin introduced an Ordinance and read the caption as follows: ORDINANCE 00-D-37 BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES, CITY OF SCHERTZ, TEXAS BE AMENDED BY REVISING CHAr .I!.R 18-32, STOP INTERSECTIONS; AND PROVIDING A REPEALING CLAUSE. Mr. Greenwald moved to approve the final reading of an Ordinance regarding Stop intersections. Mrs. Head seconded the motion, which carried with the following votes: AYES: Councilmembers Head, Potempa, Williams and Greenwald. NAYS: None. #5 ORDINANCE: Consider and take action on emergency reading of Ordinance regarding Franchise for Solid Waste Collection. Mayor Baldwin introduced an Ordinance and read the caption as follows: AN ORDINANCE GRANTING BEXAR WASTE, INC. A FRANCHISE FEE FOR MUNICIPAL SOLID WASTE COLLECTION AND DISPOSAL, A RECYCLING, AND A HOUSEHOLD HAZARDOUS WASTE PROGRAM; IMPOSING PROVISIONS AND CONDITIONS RELATING TO THE EXERCISE OF SAME; AND PROVIDING FOR PENALTIES NOT TO EXCEED $200.00 FOR VIOLATION THEREOF; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT WITH THIS ORDINANCE, AND DECLARING AN EMERGENCY. Steve Simonson advised Council that according to the Charter, this Ordinance could not be passed as an emergency. It could be passed on first reading with the second reading 30 days from now. It would not go into effect until 30 days after the final reading. The City can do a longer Interim Contract if necessary. Mr. Williams inquired what is meant by a performance bond. Mr. Simonson answered if something happened to the franchisee, then there would be enough money to hire 37 someone else to carry on with the job. Mr. Williams then asked why it is so much higher when the normal performance bond is $50,000 to $75,000. Mr. Simonson replied the amount was recommended by the City Attorney. It's up to City Council to make it a smaller amount if they so choose. Mark Marquez of Management Services explained it is based on a three-month operation, looking to protect the City's interest. Mr. Simonson added Bexar Waste can live with it and it was brought to Council the way the City Attorney suggested. Mr. Williams commented he is only trying to say there would be revenue coming in. Mr. Greenwald suggested they go with it the way it is. Mrs. Head verified that everything is in the ordinance they had requested and was assured that is the case. Mr. Greenwald moved to approve the first reading of the Ordinance regarding Franchise for Solid Waste Collection. Mr. Potempa seconded the motion, which carried with the following votes: AYES: Councilmembers Head, Potempa, Williams and Greenwald. NAYS: None. After the vote, Mr. Simonson advised Council they would have the Interim Contract ready for discussion at the December 13th workshop and it could be approved at the December 19th meeting. #6 ORDINANCE: Consider and take action on first reading of Ordinance regarding Emergency Plan. Mayor Baldwin introduced an Ordinance and read the caption as follows: AN ORDINANCE ESTABLISHING A PROGRAM OF COMPREHENSIVE EMERGENCY MANAGEMENT; ACKNOWLEDGING THE OFFICE OF EMERGENCY MANAGEMENT DIRECTOR; AUTHORIZING THE APPOINTl\-.l!.l"l. OF AN EMERGENCY MANAGEMENT COORDINATOR; PROVIDING FOR THE DUTIES AND RESPONSmILITIES OF THOSE POSITIONS; IDENTIFYING AN OPERATIONAL ORGANIZATION; GRANTING NECESSARY POWERS TO COPE WITH ALL PHASES OF EMERGENCY MANAGEMENT WHICH THREATEN LIFE AND PROPERTY IN THE CITY OF SCHERTZ; AND AUTHORIZING COOPERATIVE AND MUTUAL AID AGREEMENTS FOR RELIEF WORK BETWEEN TillS AND OTHER CITIES OR COlJrHuS AND FOR RELATED PURPOSES. Mr. Simonson remarked this Plan has been updated from the original one of 1982. 38 Mr. Williams moved to approve the first reading of an Ordinance regarding an Emergency Plan. Mr. Greenwald seconded the motion, which carried with the following votes: AYES: Councilmembers Head, Potempa, Williams and Greenwald. NAYS: None. #7 CITY MANAGER'S REPORT . Thanked everyone for coming to the Christmas Tree Lighting ceremony. Said they fmally had to ask people to leave the snow area because it was getting late. . Mentioned a new engineering firm has moved into the old GVEC building and the Grand Opening is tomorrow from 3:00 p.m. until 7:00 p.rn. . Announced City Public Service is holding a Suburban Cities meeting on December 20th in San Antonio at the Doubletree Hotel from 8:30 a.m. until 1 :30 p.rn. Please RSVP to him if interested in attending. . Stated members of the Inspection Department were out over the weekend and took down 15 signs. #8 ITEMS BY COUNCIL Mr. Potemoa: 1. Reported his wife is in the hospital as the result of a heart attack. He just left her and thanked Carol Simonson and Barbara Baldwin for their help today. She will be having a scan done later tonight. Asked everyone to keep her in their prayers. Mr. Williams: . Indicated he would be out of town and not able to attend the meeting next week. Mr. Greenwald: . Reminded everyone the Police Department is doing the Blue Santa program again this year. . Referred to an article he had distributed to everyone out of the San Antonio Express News and asked when a city annexes a chunk of the county, who's law prevails. 39 #9 ITEMS BY MAYOR · Expressed appreciation for the Tree Lighting Ceremony and asked that thanks for a great job be passed on to Mike De Leon and his crew.
