REGULAR SESSION OF THE SCHERTZ CITY COUNCIL
FEBRUARY 6, 2001
The Schertz City Council convened in Regular Session on Tuesday, February 6,
2001 at 7:00 p.m. in the Municipal Complex Council Chambers, 1400 Schertz
Parkway, Schertz, Texas. Those present were as follows: Councilmembers Joe
Potempa; Reginna Agee and Ken Greenwald. Absent: Mayor Hal Baldwin;
Council members Norma Head and Glyn D. Williams. Staff present were Interim
City Manager Steve Simonson and City Secretary Norma Althouse.
Due to the number of absences, Mr. Greenwald was recruited by those present
to preside as Mayor Pro-Tem. Mayor Pro-Tem Greenwald then asked everyone
to rise and join him in the Pledge of Allegiance to the Flag. Following the Pledge,
Mayor Pro-Tem Greenwald presented a Proclamation designating the week of
February 11, 2001 as Salute to Hospitalized Veterans Week in the City of
Schertz.

Mr. Potempa indicated he was going to abstain on some of the minutes, so it was
decided to carry them over to a future meeting.
#2 HEARING OF RESIDENTS
George Mower of 501 Brooks Ave. commented he has attended County
Commissioner meetings and School Board meetings and those people live up to
their responsibilities. It would behoove City Council to do the same.
Mr. Mower then remarked on the water bond issue. He mentioned the original
design was for a certain size pipe and a certain number of wells. Why change?
He told Council to think this issue over very carefully.
Mayor Pro-Tem Greenwald explained the plan for the original design is over two
years old. They were going to install 39" pipe, but are now going to install 42"
pipe for the same money.
Scott Surian of 2608 Kline Circle stated he is a member of the Woodland Oaks
Homeowners Association and had always abided by their rules until he

purchased a boat. He parked the boat in front of his neighbor's house with no
intention of leaving it there, but in the meantime got a letter from the Police
Department and his neighbor complained. He moved the boat, but now the
neighbor is parking his truck in front of his (Mr. Surian's) house. What can he
do? Mr. Potempa suggested taking his boat and parking it in front of the
neighbor's house. Mr. Simonson took down the address and promised to check
on the appropriate ordinances. Mayor Pro-Tem Greenwald explained the City
does not enforce Homeowners Association covenants, but asked Mr. Surian to
give Mr. Simonson time to investigate the situation.
#3 Presentation by Gordon Dunkley of the Randolph Chamber of Commerce.
Mr. Dunkley announced that the new Community Profiles have been published
and provided copies to the Council and thanked them for their support. He asked
Council to keep him informed about Mayor Baldwin's wife and they would keep
her in their prayers.
Mrs. Agee asked if anything could be done about the FM 3009/IH-35 intersection.
Mr. Dunkley answered they would sit down with the new City Manager and get
his thoughts on the situation. Mr. Simonson advised he had a conversation with
Clay Smith of TXDoT and they are looking at several options. He will try to keep
Council abreast of the progress.
#4 RESOLUTION: Consider and take action approving Resolution regarding
Schertz/Seguin Local Government Corporation bond issue requirements and
Water Rates Plan.
Mayor Pro-Tem Greenwald introduced a Resolution and read the caption as
follows:

BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, T~XAS, SUPPORTING
THE PROJECT AND FINANCING PLANS OF THE SCHERTZ/SEGUIN LOCAL
GOVERNMENT CORPORATION; AND SUPPORTING THE PLAN BY THE
CITY OF SCHERTZ PUBLIC WORKS DIRECTOR FOR WATER RATE
INCREASES.
Mark McLiney, the bonding agent from Southwest Securities, was present. He
noted they are meeting with Standard and Poors tomorrow at 10:00 a.m. The
bonds are scheduled to be sold February 21st and 22nd.
John Bierschwale, Public Works Director, explained the Council had indicated
they wish to go with Option #3 which has an increase of 35.98% the first year.
Also, he has worked up a plan for temporary assistance to needy families when
the water rate increases become effective.

Mr. Greenwald introduced Ramon Cook who serves on the Schertz/Seguin Local
Government Corporation Board. Mr. Cook is a certified Engineer. He has been
working on similar projects since 1965.
Mr. Potempa moved to approve the Resolution regarding the Schertz/Seguin
Local Government Corporation bond issue requirements and Water Rates Plan.
Mrs. Agee seconded the motion, which carried with the following votes:
AYES: Council members Potempa and Agee, and Mayor Pro- Tem Greenwald.
NAYS: None.
#5 PUBLIC HEARING: To receive citizen input on request from Schertz-
Cibolo-Universal City ISD for Specific Use Permit allowing them to build an
elementary school on the southwest corner of Schertz Parkway and Savannah
Drive.
Mayor Pro-Tem Greenwald explained the procedures to be followed for the
public hearing.
Mr. Simonson informed Council the proposed elementary school would be
located on the southwest corner of Schertz Parkway and Savannah Drive. He
went on to say sixty-five (65) letters were sent to property owners within the
required distance. Six (6) were returned in favor and three (3) were returned in
opposition.
David Fluker of the school district was present. Mr. Fluker showed Council the
basic preliminary outlay of the school. He advised it would be a neighborhood
school with a maximum number of 500 students. That would reduce the bussing
of students currently going to Universal City and Cibolo.
Ramon Cook of 513 Dimrock inquired if there would be any kind of stoplight. Mr
Fluker replied probably not. Mr. Cook then inquired about the time frame for
completion of the school and Mr. Fluker answered 2003.
Patti (last name not given) of 217 Samantha Drive asked how close the school
would be to her property. Mr Simonson indicated Sa.,annah Drive has to be
extended to the length of the SCUC ISD property. The lady then wondered how
the City plans to protect the homeowners. Mr. Simonson replied there would be
a certain amount of greenbelt buffer - the same idea as Wilder Intermediate
School. Mr Fluker added that after the Specific Use Permit is approved, then the
planning begins. Mr. Simonson noted that Planning and Zoning is part of the
process. Their meetings are posted publicly and on the web site.
David Smith of 3309 Dusty Crossing commented he has a drainage inlet on his
road and also a big gap under his fence. Is anything going to happen and can

anything be done about it? Mr. Simonson told Mr. Smith they would look at all
that in the engineering process.
Donna Dykes of 3805 Olde Moss stated she thought she was moving into a
retirement community. Now with the proposed building of a new school, she's
wondering about taxes and traffic flow. What are the pros and cons? Mayor Pro-
Tem Greenwald answered the taxes have already gone up to pay for the bonds
for the schools and the school district would have to provide a Traffic Impact
Analysis to the City if this request is approved.
Fred Juarez of 201 Savannah Drive asked if sidewalks are planned. Mr. Fluker
replied sidewalks would be in the site plan.
A lady in the audience (name and address unknown) asked how Council feels
about objections to this Specific Use Permit. Mayor Pro- Tem Greenwald told her
all comments would be considered. The lady went on to say they have already
put their house up for sale and would be moving out of Schertz. Mayor Pro-tem
Greenwald expressed his regret that she feels that way.
Mr. Halliboney of 245 Samantha Drive inquired if all the trees would be
bulldozed. Mr. Fluker replied no. The school district is well aware of the tree
mitigation ordinance. As a matter of fact, it is a monetary incentive to leave as
many trees as possible.
A gentleman (name unknown) from 241 Savannah Drive suggested the City look
at the drainage sloping toward Schertz Parkway.
There being no further questions or comments, the public hearing was closed at
this time.
#6 Consider and take action on above request for a Specific Use Permit.
Mr. Potempa moved to table action, until more Council members are present, on
the request from the SCUC ISD for a Specific Use permit, allowing them to build
an elementary school on the southwest corner of Schertz Parkway and
Savannah Drive. Mrs. Agee seconded the motion, which carried with the
following votes:
AYES: Councilmembers Potempa and Agee, and Mayor Pro- Tem Greenwald.
NAYS: None.
#7 ORDINANCE: Consider and take action on first reading of Ordinance
regarding Stop Intersections and All-Way Stops.

Mayor Pro-Tem Greenwald introduced an Ordinance and read the caption as
follows:
AN ORDINANCE
BY THE CITY COUNCIL OF THE CITY OF SCHERT~, TEXAS, PROVIDING
THAT THE CODE OF ORDINANCES OF THE CITY OF SCHERTZ, TEXAS BE
AMENDED BY REVISING SECTION 18-32, STOP INTERSECTIONS AND
SECTION 18-33, ALL-WAY STOPS; AND PROVIDING A REPEALING
CLAUSE.
Mr. Simonson advised the Stop Intersection would be at FM 1518 and Nell
Deane and the All-Way Stop intersection would be at NeW Deane and Oak Street.
Mrs. Agee moved to approve the first reading of an Ordinance regarding Stop
Intersections and All-Way Stops. Mr Potempa seconded the motion, which
carried with the following votes:
AYES: Councilmembers Potempa and Agee, and Mayor Pro-Tem Greenwald.
NAYS: None.
#8 ORDINANCE: Consider and take action on emergency reading of
Ordinance calling General City Election for May 5, 2001.
Mayor Pro-Tem Greenwald introduced an Ordinance and read the caption as
follows:

BY THE CITY COUNCIL OF THE CITY OF SCHERTZ~.. TEXAS, CALLING AN
ELECTION TO BE HELD ON MAY 5, 2001 FO . THE PURPOSE OF
ELECTING THREE (3) COUNCILMEMBERS FO SAID CITY; AND
DECLARING AN EMERGENCY.
Mayor Pro-Tem Greenwald noted the three Places up f9r election this year are
Places 3, 4 and 5.
Mrs. Agee moved to approve the emergency reading of an Ordinance calling for
a General City Election for May 5, 2001. Mr. Potemp, seconded the motion,
which carried with the following votes:
AYES: Councilmembers Potempa and Agee, and Mayor!Pro-Tem Greenwald.
NAYS: None.

#9 JOINT AGREEMENT: Consider and take action regarding Joint
Agreement for General Elections.
Mayor Pro-Tem Greenwald mentioned the joint elections have been very
successful and the cost has been minimal. J.R. Perez, Guadalupe County
Registrar, oversees the joint elections.
Mrs. Agee moved to approve the Joint Agreement Contract for joint elections
between the City of Schertz, the City of Cibolo, the SCUC ISD and CCMA. Mr.
Potempa seconded the motion, which carried with the following votes:
AYES: Councilmembers Potempa and Agee, and Mayor Pro- Tem Greenwald.
NAYS: None.
#10 Discuss Electric Utility Franchise Fee.
Mr. Potempa moved to table this item until Mr. Williams !is back since it was his
request to have it on the agenda. Mrs. Agee seconded tl1e motion, which carried
with the following votes:
AYES: Councilmembers Potempa and Agee, and Mayor Pro- Tem Greenwald.
NAYS: None.
#11 CITY MANAGER'S REPORT
. Reported he and Mrs. Head attended the TML Legislative Conference
yesterday. There will be a report in the next packet.
. Related Barbara Baldwin is in Intensive Care. Chief Woodward is home. He
has one more chemotherapy session.
. Stated Dewey Cashwell would be on board February 20th.
