Schertz City Council-Special Workshop
Wednesday, May 9, 2001
The Schertz City Council convened in Special Workshop Session at 7:00pm on
Wednesday, May 9, 2001 in the Conference Room of the Municipal Complex, 1400
Schertz Parkway, Schertz, Texas. Those present were as follows: Mayor Hal Baldwin;
presiding. Councilmembers Ken Greenwald, Norma Head, Reginna Agee, and Glyn
Williams. Staff members present were: City Manager Dewey Cashwell and City
Secretary Norma Althouse. Councilmembers absent: Joe Potempa.
Mayor Baldwin called the meeting to order at 7:00pm.
#1 Canvassing of Election Returns: Consider and take action regarding canvassing
of election returns for General City Election of May 5, 2001.
The Council reviewed the canvassing results with the winners being Reginna Agee for
Place 3, Timothy G. Swinney for place 4, and Ken Greenwald for place 5.
Mayor Baldwin then introduced an Ordinance and read the caption as follows:
ORDINANCE NO. 0l-E-15
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS CANVASSING
THE RETURNS AND DECLARING THE RESULTS OF THE CITY GENERAL
ELECTION HELD IN SAID CITY ON THE FIFTH DAY OF MAY, 2001, AND
DECLARING AN EMERGENCY.
Without further discussion, Mrs. Head moved to approve the ordinance of above for the
canvassing of elected officials. Mrs. Agee seconded the motion, which carried with the
following votes:
AYES: Councilmembers Head, Agee, Greenwald, and Williams.
NAYS: None
#2 Swearing-In of Elected Officials:
Mayor Baldwin then swore in Reginna Agee, Tim Swinney, and Ken Greenwald.
#3 Hearing of Residents:
Bill Neller mentioned that for several years he had made Christmas ornaments for Main
St. and would be happy to donate more if the City needs them. Mr. Neller also asked the
status of the Schertz Hurnane Society. He does voluntary work for the Universal City
Humane Society and he helps collect cans which they convert to cash for Homes for the
Homeless for food provisions. He wondered about similar programs in Schertz.

He was advised by Mayor Baldwin to contact someone at the Schertz Humane Society.
Caesar Amayo of the tire business at 900 FM 78 said he had spoken with TXDoT
regarding their driveways. Mr. Amayo was referred to Steve Simonson who had the
correct information for him.
#4 Video: Showing of video regarding park project from recycled products.
Mr. Swinney stated that USAA gives about 11 million dollars per year in grant money,
they could be a funding source. Mayor Baldwin stated that there are a lot of good
funding sources for example, GVEC.
Mr. Swinney asked if anyone talked about upkeep or maintenance of the park. Mrs. Head
stated that they inspect the project for five years after it is built. They do not want their
name on something that is not up to par or does not look good.
Mr. Swinney mentioned that during the bond drive a couple of years ago, there was talk
about a gazebo. Why not consider it now? Mrs. Head stated there is a plan already
drawn up that has been looked at and there is also a plan to move some old buildings to
the location.
Mr. Swinney stating that in the video, there was an American flag, thinks it would be a
good idea to provide some heritage.
Mr. Cashwell stated that they can count on the City for resources. The City has a lot of
talented people. They need to discuss it and give the City some ideas.
#5 Setting of Public Hearing Date: Consider and take action setting public hearing
date regarding junked vehicles.
Mr. Cashwell stated there needs to be a change in the way they handle the removal of
vehicles that are considered junked vehicles. Mr. Cashwell then asked Mr. Truitt to
explain this issue further.
Mr. Truitt explained that a public hearing is required before a vehicle can be moved from
the property that it is on even if the owner of the vehicle does not ask for a public
hearing. A letter went out to the owner of the vehicle (according to DMV records), and
he then requested this public hearing. Mr. Truitt also sent a letter to the resident (current
owner of the vehicle) and he is using the vehicle for parts. The gentleman is not happy
with the Ordinance and does not want to comply. Inspections gave him an additional 10
days to comply. Mr. Truitt explained that the person that the DMV found to be the owner
requested a public hearing to state that he is no longer the owner of this vehicle.
Mr. Cashwell stated that once the City has the vehicle it is destroyed, it cannot be sold or
used for parts.

There was brief discussion on the need for a public hearing, and it was decided there
needs to be one. Mayor Baldwin suggested June 5th as the public hearing date.
Without further discussion Mr. Greenwald moved to set a public hearing date for June 5,
2001 regarding a junk vehicle. Mr. Swinney seconded the motion, which carried with the
following votes:
AYES: Councilmembers Greenwald, Head, Agee, and Swinney
NAYS: None
#6 Resolution: Discuss Resolution calling for an initial public hearing on land use
assumption and a subsequent public hearing on the capital improvements plan and impact
fees.
Mr. Cashwell explained there is a need for this public hearing to comply with the State
law. There will also be an increase in impact fees.
Mr. Bierschwale stated that these fees can only be used for capital improvement for
Water and Wastewater. They have to go to specific funds. He then explained some of the
projects that they have done. This also has the mechanism to allow a bond payment as a
secondary reserve ifthe City has a bad water year. Mr. Bierschwale stated there is a bill
in front of the State right now that could reduce these fees by 50%.
Mayor Baldwin inquired about the capital recovery fee totals. Mr. Bierschwale stated
that the sewer fees would go up to $809.34 plus CCMA's add on fee of $985.00 making
it a total of $1,794.34. It was $1,300.00 before. The water was $750.00; which will now
go to $1,255.60. Grand total for both is $3,049.94. Mr. Bierschwale stated this is a great
program for the City of Schertz
Mr. Bierschwale advised that they are going to call a public hearing. The advisory board
will listen to the comments ofthe hearing and then make a formal recommendation to the
City Council requesting that the rate increase occurs.
#7 City Manager's Report:
. Welcomed Mr. Swinney to City Council.
. Advised Mr. Swinney of upcoming Strategic Planning program on May 18th and 19th.
. Received affirmation for position of EMS director from Dudley Wait current resident
of Clearwater Florida. He will be coming sometime during second week of June.
Seems to be a well-rounded and capable individual.
. Employee picnic Saturday, May 12th. Everyone invited.
. May 14th Public Forum at 6:30pm at Knights of Columbus Hall

Section 551.072, Deliberation regarding real property

An Executive Session was held from 8:17pm until 9:00pm.
#9 Action, if any, on above Executive Session: No action taken
#10 Adjournment: with no further business to discuss, Mayor Baldwin adjourned the
meeting at 9:03pm.
