ccreg 07-17-01 Schertz City Council-Regular Session Tuesday, July 17, 2001 The Schertz City Council convened in Regular Session on Tuesday, July 17, 2001 at 7:00pm in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Schertz, Texas. Those present were as follows: Mayor Pro-Tern Norma Head, presiding; Councilmembers Reginna Agee, Ken Greenwald, and Billy Pitts. Staff members present were: City Manager Dewey Cashwell and City Secretary Norma Althouse. Absent: Mayor Hal Baldwin and Councilmember Tim Swinney. Mayor Pro-Tern Head called the meeting to order at 7:00pm and lead everyone in the Pledge of Allegiance. Mayor Baldwin announced that plans had been made for former Councilmember Joe Potempa to receive a plaque, but he was unable to attend. #1 Hearing of Residents: Charles McDonald (Justice of the Peace) stated that a day doesn't go by when someone doesn't come in and say they can't be serviced because they are not in Precinct #3. Something needs to be done. George Mower echoed Mr. McDonald's sentiments. #2 Resignation: Consider and take action accepting resignation of Billy R. Pitts from Schertz Parkway Zone Board. Mrs. Head thanked Mr. Pitts for all his hard work on the Board. Without further discussion Mr. Greenwald moved to accept the resignation of Billy R. Pitts from the Schertz Parkway Zone Board. Mrs. Agee seconded the motion, which carried with the following votes: AYES: Mayor Pro-Tern Head and Councilmembers Agee and Greenwald ABSTAINED: Councilmember Pitts #3 Resolution: Consideration and approval of a Resolution by the City Council of the City of Schertz, Texas authorizing and approving publication of notice of intention to issue certificates of obligation; complying with the requirements contained in Securities and Exchange Commission Rule 15c2-12; and providing an effective date. 218 Mayor Pro-Tern Head introduced a Resolution and read the caption as follows: RESOLUTION NO. 01-R-25 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS AUTHORIZING AND APPROVING PUBLICATION OF NOTICE OF INTENTION TO ISSUE CERTIFICATES OF OBLIGATION; COMPLYING WITH THE REQUIREMENTS CONTAINED IN SECURITIES AND EXCHANGE COMMISSION RULE 15c2-12; AND PROVIDING AN EFFECTIVE DATE. Without further discussion Mr. Greenwald moved to approve a resolution authorizing and approving publication of notice of intention to issue certificates of obligation; complying with the requirements contained in Securities and Exchange Commission Rule 15c2-12; and providing an effective date. Mr. Pitts seconded the motion, which carried with the following votes: AYES: Mayor Pro-Tern Head and Councilmembers Agee, Greenwald, and Pitts NAYS: None #4 Ordinance: First reading of Ordinance approving Tax and Limited Pledge Revenue Certificates of Obligation, Series 2001. Mayor Pro-Tern Head introduced an Ordinance and read the caption as follows: AN ORDINANCE AN ORDINANCE AUTHORIZING THE ISSUANCE OF "CITY OF SCHERTZ, TEXAS COMBINATION TAX AND LIMITED PLEDGE REVENUE CERTIFICATES OF OBLIGATION, SERIES 2001"; PROVIDING FOR THE PAYMENT OF SAID CERTIFICATES BY THE LEVY OF AN AD VALOREM TAX UPON ALL TAXABLE PROPERTY WITHIN THE CITY AND FURTHER SECURING SAID CERTIFICATES BY A LIEN ON AND PLEDGE OF THE PLEDGED REVENUES OF THE SYSTEM; PROVIDING THE TERMS AND CONDITIONS OF SAID CERTIFICATES AND RESOLVING OTHER MATTERS INCIDENT AND RELATING TO THE ISSUANCE, PAYMENT, SECURITY, SALE, AND DELIVERY OF SAID CERTIFICATES, INCLUDING THE APPROVAL AND DISTRIBUTION OF AN OFFICIAL STATEMENT PERTAINING THERETO; AUTHORIZING THE EXECUTION OF A PAYING AGENT/REGISTRAR AGREEMENT; COMPLYING WITH THE REQUIREMENTS OF THE DEPOSITORY TRUST COMPANY'S LETTER OF REPRESENTATIONS; AND PROVIDING AN EFFECTIVE DATE 219 Without further discussion Mr. Greenwald move<! to approve the first reading of ordinance app'v ling Tax and Limited Pledge Revenue Certificates of Obligation, Series 2001. Ms. Agee seconded the motion. Mr. McLiney distributed a new version oflast week's table and reviewed the I & S. A vote was taken and the motion carried with the following results: AYES: Mayor Pro-Tern Head and Councilmernbers Agee, Greenwald, and Pitts NAYS: None #5 Discussion: with Guadalupe County Registrar, J.R. Perez, and Guadalupe County Commissioner, Jim Wolverton, regarding redistricting Plan; and then action on Resolution regarding Redistricting Plan. Guadalupe County Registrar, J.R. Perez and Guadalupe County Commissioner, Jim Wolverton were present to answer questions by Council on the proposed Redistricting Plan. It was suggested that Northcliffe and Precinct Four be added to the Schertz boundary in an effort to keep two commissioners. Mayor Pro-Tern Head introduced a Resolution and read the caption as follows: RESOLUTION NO. 01-R-24 BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS VEHEMENTLY URGING THE GUADALUPE COUNTY COMMISSIONERS TO ENSURE THAT THE CITY OF SCHERTZ CONTINUES TO HAVE REPRESENTATION BY TWO COMMISSIONERS IN GUADALUPE COUNTY. Without further discussion, Mr. Greenwald moved to approve the Resolution as written above with the addition of recommendation to include Northcliffe and Precinct Four and adjust the Schertz boundary to the City of Schertz and to keep two commissioners. Mrs. Agee seconded the motion, which carried with the following votes: AYES: Mayor Pro-Tern Head and Councilmembers Agee, Greenwald, and Pitts NAYS: None Mayor Pro-Tern Head thanked Mr. Perez for being here and answering questions. Mr. Cashwell apologized to Commissioner Wolverton for perhaps diminishing ajob well done. 220 #6 Appointment: Consider and take action appointing Councilmember to Audit Committee. Without further discussion, Mr. Greenwald moved to recommend Mrs. Agee be appointed to the Audit Committee. Mr. Pitts seconded the motion, which carried with the following votes: AYES: Mayor Pro-Tern Head and Councilmembers Greenwald, and Pitts ABSTENTIONS: Councilmember Agee #7 Resolution: Authorizing certain actions including proceedings in eminent domain in connection with the acquisition of certain waterline and ternporary construction easements in Gonzales and Guadalupe Counties and related matters. Mayor Pro-Tern Head introduced a Resolution and read the caption as follows: RESOLUTION NO. 01-R-26 RESOLUTION AUTHORIZING CERTAIN ACTIONS INCLUDING PROCEEDINGS IN EMINENT DOMAIN IN CONNECTION WITH THE ACQUISITION OF CERTAIN WATERLINE AND TEMPORARY CONSTRUCTION EASEMENTS IN GONZALES AND GUADALUPE COUNTIES AND RELATED MATTERS. Without further discussion, Ms. Agee moved to app.vie the resolution authorizing certain actions including proceedings in eminent domain in connection with the acquisition of certain waterline and temporary construction easements in Gonzales and Guadalupe Counties and related matters. Mr. Pitts seconded the motion, which carried with the following votes: AYES: Mayor Pro-Tern Head and Councilmembers Agee, Greenwald, and Pitts NAYS: None #9 City Manager's Report: . Letter to Mayor Baldwin from Bexar County dispute resolution center . Letter of appreciation from Chamber of Commerce .
