REGULAR SESSION OF THE CITY COUNCIL
FEBRUARY 3, 1998
The Schertz City Council convened in Regular Session on Tuesday, February 3,
1998 at 7:00 p.m. in the Council Chambers of the Municipal Complex, 1400
Schertz Parkway, Schertz, Texas. The following members were present: Mayor
Hal Baldwin, presiding; Councilmembers Joe Potempa; Norman Agee, Sr. and
Ken Greenwald. Absent: Councilmembers Charles McDonald and Timothy
Swinney. Staff present were City Manager Kerry Sweatt and City Secretary
Norma Althouse.
Mayor Baldwin asked everyone to rise and join him in the Pledge of Allegiance to
the Flag. He then welcomed students from Joyce Briscoe's government class to
the meeting.
#1 HEARING OF RESIDENTS: Those citizens wishing to speak on agenda
items (other than public hearing items) or items not on the agenda, will be heard
at this time.
No one had signed up to speak.

#2 ORDINANCE: Consider and take action on final reading of an Ordinance
authorizing the levy of a sales tax, creation of the City of Schertz Economic
Development Corporation, and approval of Articles of Incorporation and Bylaws
for the Corporation.
Mayor Baldwin introduced an ordinance and read the caption as follows:
ORDINANCE NO. 98-T-3
AN ORDINANCE AUTHORIZING AND APPROVING THE CREATION OF THE
CITY OF SCHERTZ ECONOMIC DEVELOPMENT CORPORATION TO .ACT
ON BEHALF OF THE CITY OF SCHERTZ, TEXAS; LEVYING AN
ADDITIONAL SALES AND USE TAX AS PROVIDED IN THE DEVELOPMENT
CORPORATION ACT OF 1979, AS AMENDED; AND OTHER MATTERS IN
CONNECTION THEREWITH.
Mr. Sweatt advised this is the second and final reading of the Ordinance. The
members of the Schertz Economic Development Corporation will act on behalf of
the City of Schertz for specific purposes.

Mr. Greenwald moved to approve the final reading of the Ordinance authorizing
the levy of a sales tax, creation of the City of Schertz Economic Development
Corporation. and approval of Articles of Incorporation and Bylaws for the
Corporation. Mr. Agee seconded the motion, which carried with the following
votes:
AYES: Councilmembers Potempa, Agee and Greenwald.
NAYS: None.
#3 ELECTION:
a. Consider and take action on an Ordinance ordering an election for May 2,
1998 and declaring an emergency;
b. Consider and take action authorizing Joint Agreement of General
Elections between the City of Schertz, the SCUC ISD and the City of
Cibolo; and
c. Consider and take action authorizing 1998 General Election Services
Contract with the County Elections Officer, State of Texas, County of
Guadalupe.

Mayor Baldwin introduced an ordinance and read the caption as follows:
ORDINANCE NO. 98-E-4
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS CALLING AN
ELECTION TO BE HELD ON MAY 2, 1998 FOR THE PURPOSE OF
ELECTING A MAYOR AND TWO (2) COUNCILMEMBERS FOR SAID CITY,
AND DECLARING AN EMERGENCY.
Mr. Greenwald moved to approve the Ordinance ordering an election for May 2,
1998 and declaring an emergency. Mr. Potempa seconded the motion, which
carried with the following votes:
AYES: Councilmembers Potempa, Agee and Greenwald.
NAYS: None.

Mr. Sweatt advised that both b. and c. relate to the joint election which they hope
will encourage a higher voter turnout.

Mr. Agee moved to approve authorization of the Joint Agreement of General
Elections between the City of Schertz, the SCUC ISD and the City of Cibolo and
to approve authorization of the 1998 General Election Services Contract with the
County Elections Officer, State of Texas, County of Guadalupe. Mr. Potempa
seconded the motion, which carried with the following votes:
AYES: Councilmembers Potempa, Agee and Greenwald.
NAYS: None.
#4 REAPPOINTMENT: Consider and take action reappointing Library Board
members.
Mr. Greenwald moved to reappoint Julie Parr, Mary McAllister, Margaret Riley
and Ruth Tienor to the Library Board. Mr. Agee seconed the motion, which
carried with the following votes:
AYES: Councilmembers Potempa, Agee and Greenwald.
NAYS: None.

#5 ORDINANCE: Consider and take action on first reading of an Ordinance
changing the hours of school zones.
Mayor Baldwin introduced an ordinance and read the caption as follows:
AN ORDINANCE
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS PROVIDING
THAT CHAPTER 18 OF THE CODE OF ORDINANCES, CITY OF SCHERTZ,
TEXAS BE AMENDED BY REVISING ARTICLE IV, SPEED REGULATIONS,
SECTION 18-75, MAXIMUM LIMITS IN SCHOOL ZONES; AND PROVIDING
AN EFFECTIVE DATE AND A REPEALING CLAUSE.

Mr. Sweatt read the paragraph from the ordinance outlining the changes to the
school zone hours. It goes as follows: "It shall be unlawful for any person to
drive or operate any motor vehicle at a rate of speed in excess of that which is
posted within a school speed zone, the limits of which shall be designated by
school speed limit signs, on any day of any regular or any special or summer
school term. Those designations are between the hours of 7:00 a.m. and 9:00
a.m. and between the hours of 3:00 p.m. and 4:30 p.m. with the exception of an
area of Randolph Blvd. where the afternoon hours are between 2:30 p.m. and
4:30 p.m. It shall also be unlawful for any person to drive or operate any motor
vehicle at a rate of speed in excess of that which is posted during the hours when
the lights are flashing." Mr. Sweatt reported this will involve seven State signs
and 2 sets of flashing signals.
