REGULAR SESSION OF THE CITY COUNCIL APRIL 21, 1998 The Schertz City Council convened in Regular Session on Tuesday, April 21, 1998 at 7:00 p.m. in the Council Chambers of the Municipal Complex, 1400 Schertz Parkway, Schertz, Texas. The following members were present: Mayor Pro-Tem Timothy Swinney, presiding; Councilmembers Charles McDonald; Joe Potempa; Norman Agee, Sr. and Ken Greenwald. Absent: Mayor Hal Baldwin. Staff present were City Manager Kerry Sweatt and City Secretary Norma Althouse. Mayor Pro- T em Swinney asked everyone to rise and join him in the Pledge of Allegiance to the Flag. #1 HEARING OF RESIDENTS: Those citizens wishing to speak on agenda items (other than public hearing items) or items not on the agenda, will be heard at this time. . Ted Duigon of 1112 Antler Drive informed Council the pending sale of Ms. Jan Besch Day's property to Oak Trail Investments fell through. There is, however, a contract still pending on 10 acres which is currently zoned R-4. He heard that someone wants to build a nursing home on the property. Mr. McDonald suggested the proposed rezoning of the Besch property be placed on a future agenda. Mr. Sweatt advised it could discussed at the next workshop so action could be taken on May 5th. #2 ORDINANCE: Consider and take action on first reading of Ordinance regarding parking regulations in the 500 block of Main Street. Mr. Sweatt advised this is the first reading of the ordinance as redrafted by the staff at the request of Council. Paragraphs ( c ) and ( d ) have been revised to read as follows: ( c) Parking in a 95-foot portion of the 500 block of Main Street shall be for no longer period of time than fifteen (15) minutes during the hours of 11 :00 a.m. until 2:00 p.m., Monday through Saturday. ( d) The portion of the 500 block of Main Street from the east curb line of Lindbergh Avenue, 95 feet east on Main Street, is hereby designated for limited parking and appropriate signs are authorized for placement, and the City Manager is authorized to begin enforcement action upon final passage and publication of the Ordinance. . -171- e . . Mayor Pro- T em Swinney stressed he still thinks this is a business problem and not a government problem. This ordinance is overkill. Mr. McDonald expressed concern about being deluged with phone calls if someone parks for 20 minutes. If that happens, he suggests the ordinance be repealed. Mr. Agee asked if the two businesses involved could post notices. Mr. Sweatt acknowledged they could be asked to do so. We might ask Nathalie's, but the other businesses probably have a much faster turnover in customers than the restaurant. At this time Mayor Pro- T em Swinney introduced an ordinance and read the caption as follows: AN ORDINANCE . BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS PROVIDING THAT CHAPTER 18 OF THE CODE OF ORDINANCES, CITY OF SCHERTZ, TEXAS BE AMENDED BY REVISING ARTICLE V, STOPPING, STANDING AND PARKING, SECTION 18-90, PARKING FOR CERTAIN PURPOSES PROHIBITED; AND PROVIDING AN EFFECTIVE DATE AND A REPEALING CLAUSE. Mr. Agee moved to approve the first reading of an Ordinance regarding parking regulations in the 500 block of Main Street. Mr. Greenwald seconded the motion, which carried with the following votes: AYES: Councilmembers McDonald, Potempa, Agee and Greenwald. NAYS: None. #3 ORDINANCE: Consider and take action on final reading of Ordinance regarding traffic control measures at the intersection of Ashley Park and Baldwin Park. Mr. Sweatt related the first reading of the Ordinance had been approved by Council and it is recommended the final reading also be approved. Mayor Pro- T em Swinney introduced an ordinance and read the caption as follows: . -172- . . e ORDINANCE NO. 98-D-10 BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS PROVIDING THAT THE CODE OF ORDINANCES BE AMENDED BY REVISING SECTION 18-49, THREE-WAY STOPS; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT. Mr. Greenwald moved to approve the final reading of an Ordinance regarding traffic control measures at the intersection of Ashley Park and Baldwin Park. Mr. Potempa seconded the motion, which carried with the following votes: AYES: Councilmembers McDonald, Potempa, Agee and Greenwald. NAYS: None. #4 ORDINANCE: Consider and take action on first reading of Ordinance authorizing a Tax Abatement and Tax Abatement Agreement for and with Coronado Paint. . Mr. Sweatt informed Council the Economic Development Commission has approved a tax abatement for Coronado Paint in the amount of 37.77% over a five-year period of time. Coronado Paint will be adding 21,000 square feet to their building. Mr. Peterson, representing Coronado Paint, thanked everyone for their consideration. They have been in the City for 12 years and expect completion of the addition to their building by July 1 st. This company in Schertz is part of 6 units which take care of everything west of the Mississippi. Mayor Pro- T em Swinney introduced an ordinance and read the caption as follows: AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS APPROVING A TAX ABATEMENT AND TAX ABATEMENT AGREEMENT FOR AND WITH CORONADO PAINT, A PROPERTY OWNER IN THE CITY OF SCHERTZ. Mayor Pro- T em Swinney mentioned that Coronado Paint has been a great partner with the City in the project for removal of graffiti. Mr. Potempa moved to approve the first reading of an Ordinance authorizing a Tax Abatement and Tax Abatement Agreement for and with Coronado Paint. Mr. McDonald seconded the motion, which carried with the following votes: . -173- . . . AYES: Councilmembers McDonald, Potempa, Agee and Greenwald. NAYS: None. #5 ORDINANCE: Consider and take action on first reading of Ordinance approving a Tax Abatement and Tax Abatement Agreement for and with Alamo Packaging. Mr. Sweatt reported they are relocating from San Antonio and will be erecting a 63,000 square foot building in the Tri-County Business Park. The Economic Development Commission has approved a minimum 82.2% tax abatement over an eight-year period of time for Alamo Packaging. Kevin Bauman, Comptroller, and John Taylor, President, are at the meeting this evening to answer any questions. Mr. Taylor had an artist's rendition of the proposed building and said they are merging their San Antonio and Austin facility here in Schertz. They are excited about coming to Schertz and feel it is a good investment for the community. They looked at other cities and counties, but the tax abatement in Schertz is appealing. . Mayor Pro- T em Swinney noted there was a great article on Alamo Packaging in the San Antonio Business Journal and he complimented Mark Marquez for bringing them to Schertz. Mayor Pro-Tem Swinney then introduced an ordinance and read the caption as follows: AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS APPROVING A TAX ABATEMENT AND TAX ABATEMENT AGREEMENT FOR AND WITH ALAMO PACKAGING, A PROPERTY OWNER IN THE CITY OF SCHERTZ. Mr. Greenwald moved to approve the first reading of an Ordinance authorizing a Tax Abatement and Tax Abatement Agreement for and with Alamo Packaging. Mr. Agee seconded the motion, which carried with the following votes: AYES: Council members McDonald, Potempa, Agee and Greenwald. NAYS: None. #6 APPOINTMENTS: Consider and take action regarding appointment of members to the Economic Development Commission. . Mr. Sweatt advised there is a vacancy on the Economic Development Commission and Arnold Barrett has agreed to serve. He owns Barrett's Air Conditioning. -174- . . . Members of the Economic Development Commission who need to be reappointed and have agreed to serve are Lewis Borgfeld, W.J. Sweatt, Jeff Zunker and Tim Fetter. Mr. Agee moved to appoint new member Arnold Barrett and reappoint members Lewis Borgfeld, W.J. Sweatt, Jeff Zunker and Tim Fetter to the Economic Development Commission. Mr. Greenwald seconded the motion, which carried with the following votes: AYES: Councilmembers McDonald, Potempa, Agee and Greenwald. NAYS: None. #7 CITY MANAGER'S REPORT · Related they are proceeding with discussion of the GVEC franchise agreement and wish to continue, if council wishes, with RMI at a cost of $4500. It is their intention to ask John Moore to continue. The consensus of Council was to proceed. #8 ITEMS BY COUNCIL . Mr. McDonald: . Thanked Garden Ridge Pottery for being a good neighbor. Mr. Potempa: · Complimented the City on a great job Sunday on the dedication of the xeriscape park. He was asked by someone if they could put in a rose garden. Mr. Sweatt said the park is geared toward low water maintenance and native plants, but he will check into it. . Noticed that Taco Cabana was packed, that's why no one is at the meeting tonight. Mr. Greenwald: . Congratulated Mayor Pro- T em Swinney on a job well done at the xeriscape park dedication Sunday and suggested everyone go by and take a look at the park. . Stated he received a letter regarding LCRA condemnation and takings. Mr. Sweatt indicated there needs to be an alternate plan. . -175-
