CITY COUNCIL WORKSHOP SESSION
MAY 13,1998
The Schertz City Council convened in Special Workshop Session on
Wednesday, May 13, 1998 at 7:00 p.m. in the Municipal Complex Conference
Room, 1400 Schertz Parkway, Schertz, Texas. The following members were
present: Mayor Hal Baldwin, presiding; Councilmembers Pia Jarman; Norman
Agee, Sr.; Timothy Swinney and Ken Greenwald. Absent: Councilmember Joe
Potempa. Staff present were City Manager Kerry Sweatt and City Secretary
Norma Althouse.
Mayor Baldwin introduced Amy Madison who spoke and showed a video about
Ataxia Telangiectasia (A-T). Mrs. Madison has three children afflicted with the
disease. She informed Council about all the research going on and reminded
them of the fund-raising event scheduled for June 6th at Cypress Bend Park in
New Braunfels. The Council thanked Mrs. Madison for her time.
#1 HEARING OF RESIDENTS: No one had signed up to speak.
#2 Discuss final reading of Ordinance rezoning 65.49 acres of Besch
property from R-5 and OP to R-1.
After hearing from Mr Sweatt that there is nothing new on this item, Council
agreed they were ready for it to be placed on next Tuesday night's agenda.
#3 Discuss final reading of Ordinance authorizing a Tax Abatement and
Tax Abatement Agreement for Genuine Parts.
Ron Bogart of Genuine Parts was at the meeting and gave Council some
background information on the company. Mr. Bogart stated there are three parts
to the company - NAPA, Motion Industries and S.P. Richards. NAPA is the auto
parts distributor and makes up 51 % of the company. Motion Industries
distributes replacement industrial parts and makes up 31 % of the company. S.P.
Richards warehouses office supplies and makes up 18% of the company. S.P.
Richards was established in 1860 and was family-owned until 1975 when it was
sold to Genuine Parts. As well as being in the United States, they also have
international operations. They are pleased to be in Schertz and feel it will meet
their needs for many years to come. Mr. Bogart brought a catalog to show
Council which contains over 20,000 items that they warehouse and stock in their
distribution centers. Mr. Bogart also brought copies of their annual report and
explained they are a very conservative company. They have had 47 years of
consecutive sales increases.

a traffic analysis. If Planning and Zoning turns them down again, the City will
probably end up in court. One of the comments from the residents was that
they want to turn Oak Forest into a gated community. He encourages them to
go ahead and try it because they don't know what they're getting into.
· Distributed a letter signed by Mr. Ron Lewis and noted that regardless of how
much water is in the aquifer, we can only pump 450,000 gallons now and then
in 5 years that amount will be reduced.
. Distributed a water filtration plant plan report submitted by Taylor Mullins.
There was a brief discussion about investing in an engineering study of a
water filtration plant and also about the need to purchase some acre feet of
water from GBRA.
Mrs. Jarman:

· Inquired what happens when the City gives a tax abatement for a certain
number of years and the business leaves before the end of those years. Mr.
Sweatt explained the City has a recapture provision in the agreement and if
that's not available, the building is still there and the facilities are accessible
for investment by another company. Mr. Sweatt said he would be glad to sit
down with Mrs. Jarman and go through the tax abatement formulas with her.
Mayor Baldwin suggested giving her a chart of the tax abatement status of
businesses in the City.
Mr. Aaee:
. Pointed to a brochure and asked if anyone knew what kind of car was
pictured on the front. He's pretty sure it's a 1959 Ford.
Mr. Swinney:
. Asked if everyone had seen the news and the levity they had with the ozone
days.

. Pointed out it is time for the City manager's performance evaluation. In his
opinion, a Councilmember should have to be on Council for 6 months before
they can do an evaluation of the City Manager. He would like to see some
kind of brief policy written for that situation, He had asked the departing
Councilmember to fill out an evaluation form. Suggested everyone turn in
their evaluations to the Mayor by the second workshop in June to allow a
couple of weeks for review. There is no perfect system. They have
discussed ways in the past about how to make this process more meaningful
for the City Manager. His suggestion is to give feedback and specific
examples, but try to avoid using specific incidents as a trend for the whole
year. Mayor Baldwin indicated he would like to give Mr. Sweatt the whole

package this time so he has an understanding of how each individual
Councilmember feels. Mr. Swinney thought offering to speak to the City
Manager on a one-to-one basis may be beneficial. He then asked Mr.
Sweatt if he had anything to add. Mr. Sweatt answered they need to look
across the whole rating period and also be more specific in setting goals and
milestones.
. Reported attending the VFW chili cook-off and noted he doesn't want to see
another pot of chili in his life.
#7 ITEMS BY MAYOR
. Related meeting with the Executive Committee of the Board of Directors of
GVEC today regarding the franchise agreement. Indicated he thought it was a
good meeting, that Schertz came out with what they wanted, and he thinks
they're ready to go. John Moore has done an outstanding job for the City.
Mr. Sweatt mentioned there will be a Resolution on the next agenda for action
to continue the franchise agreement for an additional 60 days while
negotiations are completed. The current franchise agreement expires in 10
days.

. Announced that tomorrow night at 6:00 p.m., the Northeast Partnership is
holding a business appreciation reception at the Live Oak Civic Center and
everyone is invited. Mr. Swinney asked what the dress code is and Mr.
Sweatt replied he thinks it's coat and tie. If it's different, he will give Mr.
Swinney a call.
. Stated that the Miss Schertz Sweetheart judging is this Friday night.
Before going into Executive Session, Mr. Sweatt commented he had forgotten to
mention the going away dinner for former Councilmember Charles McDonald. It
will be held at Nathalie's restaurant on Friday, May 22nd at 6:30 p.m. and
everyone and their spouses are invited. After discovering that Mayor Baldwin
had a conflicting event on his schedule and Mr, Swinney would be on vacation,
Mr. Sweatt was asked to check into the possibility of another night - perhaps
Friday the 29th. He said he would check with Mr. McDonald and let them know.
