WORKSHOP SESSION OF THE SCHERTZ CITY COUNCIL
October 13, 1999
The Schertz City Council convened in Special Workshop Session on
Wednesday, October 13, 1999 at 7:00 p.m. in the Municipal Complex
Conference Room, 1400 Schertz Parkway, Schertz, Texas. The following
members were present: Mayor Hal Baldwin, presiding; Councilmembers Pia
Jarman; Joe Potempa; Reginna Agee; Glyn D. Williams and Ken Greenwald.
Staff present were City Manager Kerry Sweatt and City Secretary Norma
Althouse.
Mayor Baldwin advised that Mr. Potempa has requested a moment of silence for
the three slain law enforcement officers in Atascosa County. Council observed a
moment of silence for that cause.
#1 HEARING OF RESIDENTS
No one had signed up to speak.
#2 Discuss final reading of Ordinance regarding through streets
designated as "stop" intersections.
. Since this Ordinance had already been discussed at a previous workshop, Mayor
Baldwin asked Council if they were ready to have it included on next Tuesday
nights' agenda and they replied they were ready.
#3 Discuss first reading of Ordinance regarding Community Center
Rates.
Mr. Sweatt commented they had previously talked about a proposal for a change
to this ordinance, which had been prepared by Mike Deleon. Under Attachment
3 it covers reservation and lease agreements, rental rates and deposits, picking
up of the key to the Community Center, damages and disorder, inspection by the
City after a function, alcoholic beverages, set up and cleaning time, rental fees,
deposits and security, and the arrangement diagram for setting up a particular
function.
Under Attachment 4 it covers the classifications of convention, social, and local
civic organizations. It also covers rates, contracts and notice of cancellation of a
function.

Mayor Baldwin inquired about rates for the small meeting room and Mr. Sweatt
replied they don't have a history for that room, so it is not included in the
ordinance. Whenever those rates are determined, they can do an amendment to
the ordinance.

Council agreed they were prepared for this ordinance to be included on next
Tuesday night's agenda.
#4 Discuss Ordinance regarding Food Establishment Rules.
Mr. Sweatt reminded Council that copies of the proposed ordinance and of the
section of the Code pertaining to this subject had been included in their packets.
He then stated Gary Davis was present to answer any questions Council may
have.
Mr. Sweatt went on to say two of the main reasons for amending the current
ordinance are (1) to adopt the provisions of the current rule or rules as amended
by the Texas Board of Health found in 25 Texas Administrative Code, Chapter
229, Sections 161 through 171 and 173 through 175 regarding the regulation of
food establishments, and (2) to replace the current practice of issuing a Health
Card with the requirement for completion of a Food Handler Sanitation Training
Course.

Mr. Potempa inquired if this ordinance will give the City more authority and Mr.
Sweatt replied the main thrust of the ordinance is the food handler training. Mr.
Williams asked about the legality of food being served out of the backs of trucks
at construction sites and Mr. Davis answered if no permit has been issued, they
will be cited. Mrs. Jarman verified that the food handler program replaced the
Health Card and was assured that is true. Mr. Williams then asked about
implementation and if the Health Cards will be grandfathered. Mr. Davis
answered they will have to make some kind of arrangement, because it will take
time to get everyone trained.
Mayor Baldwin wondered about the length of the food handler courses and Mr.
Davis indicated they would be 3-4 hours long. Mr. Potempa remarked on places
like McDonalds and their high turnover of employees. Mr. Sweatt noted they
think the food handler courses will help the employer.
Mr. Potempa asked Mr. Davis if he inspects the cafeterias in the schools and Mr.
Davis replied he does. Mr. Williams then asked how the classes will be handled
and Mr. Davis replied he would probably have some at the schools, perhaps
some at City Hall, and probably some evening and Saturday classes. Mr. Sweatt
said they are hoping for cooperation from some of the other cities like Universal
City and Kirby.
Council indicated their readiness for this item to be included on next Tuesday
night's agenda and Mayor Baldwin thanked Mr. Davis for his time and efforts.

. Noted there was an article in the Express-News regarding a Y2K glitch that
showed up in the state of Maine. It had to do with a regulation prior to 1916
regarding the horseless carriage.
. Related that 20/20 had a sixteen minute dissertation the other evening on
AMR (the new ambulance service for Randolph AFB). One of Juan
Guerrero's employees taped it if anyone is interested.
. Indicated he's going to get copies for Council of a letter and a news article
about Bexar Metro drilling a well in Gonzales County.
#9 ITEMS BY MAYOR
. Advised that at the next Northeast Partnership meeting at the Dragon Lake
restaurant in Universal City, one of the items on the agenda is discussion of
the status of air quality in Bexar County and what non-attainment status will
do to the area.
. Stated that several gentlemen from Walgreen's who were at the Annual
Business Appreciation Dinner approached him about support from the
Council regarding a traffic signal on FM 3009 at the intersection of FM 3009
and Savannah Drive.

There being no further business to discuss, Mayor Baldwin adjourned the
meeting at 8:40 p.m.
