REGULAR SESSION OF THE SCHERTZ CITY COUNCIL
NOVEMBER 2, 1999
The Schertz City Council convened in Regular Session on Tuesday, November
2, 1999 at 7:00 p.m. in the Municipal Complex Council Chambers, 1400 Schertz
Parkway, Schertz, Texas. The following members were present: Mayor Hal
Baldwin, presiding; Councilmembers Pia Jarman; Joe Potempa; Reginna Agee;
Glyn D. Williams and Ken Greenwald. Staff present were City Manager Kerry
Sweatt and City Secretary Norma Althouse.
Mayor Baldwin asked everyone to rise and join him in the Pledge of Allegiance to
the Flag. Following the Pledge, he welcomed students from Mrs. Blair and Ms.
Briscoe's government classes.

APPROVAL OF MINUTES:

Mr. Greenwald moved to approve the minutes, as written for the Regular Session
of 8-17-99, the Special Workshop Session of 9-15-99, the Regular Session of
9-21-99 and the Special Workshop Session of 9-29-99. Mrs. Jarman seconded
the motion, which carried with the following votes:
AYES: Councilmembers Jarman, Potempa, Agee, Williams and Greenwald.
NAYS: None.
#2 HEARING OF RESIDENTS: Those citizens wishing to speak on agenda
items (other than public hearing items) or items not on the agenda, will be heard
at this time.
No one had signed up to speak.
#3 BID AWARD: Consider and take action awarding bids for Remounted
Type 1 Ambulance.
Mr. Sweatt advised this is the second time around for these bids. Due to some
problems, they were rejected the first time. New specifications were written when
they were rebid and the second set of specifications asked for a 2000 chassis
versus a 1999 one. After review, it is recommended the bid be awarded to San
Antonio Ambulance Sales in the amount of $46,772.00. This is not the lowest bid
by $284.50, but due to the same problems as before with Professional
Ambulance Sales and their listing of a service center with which they do not have
business dealings, it is felt the bid should go to San Antonio Ambulance Sales.

Mrs. Jarman moved to award the bid for a Remounted Type 1 Ambulance to San
Antonio Ambulance Sales in the amount of $46,772.00. Mr. Williams seconded
the motion, which carried with the following votes:
AYES: Councilmembers Jarman, Potempa, Agee, Williams and Greenwald.
NAYS: None.
#4 BID AWARD: Consider and take action awarding bids for Telephone
System.
Mr. Sweatt explained six bids were received ranging from $49,770 to $138,000.
Based on terms and specifications, they are recommending the bid be awarded
to Brice Systems, the second lowest bidder, in the amount of $49,995. Certain
information was excluded by the lowest bidder which would have cost the City an
additional $12,000, so that moved them out of the lowest bidder position.
Mrs. Jarman asked if this price includes the current Municipal Complex and the
three new emergency services buildings and Mr. Sweatt replied yes it does.
Mr. Williams expressed some concerns about security because telephone use
by computers is still in its infancy, about sophisticated multi-media software
conflicts, and about fiber optics. He also stated he still has a problem with the
consultant being allowed to bid on the contract. Mr. Sweatt, saying he
understands his concern, pointed out if they hadn't let the consultant bid, they
would have to spend more money. The lowest bidder didn't anticipate using fiber
optics and hadn't included a separate server or licensing.
Mr. Potempa mentioned he also has a problem with the consultant being allowed
to bid. He feels the consultant is only an advisor. Mr. Potempa then asked how
much is in the budget for this project and Mr. Sweatt replied $85,000.
Mayor Baldwin asked how much we're paying the consultant and Mr. Sweatt
answered $2,000 per month. He then asked how long the consultant is going to
work for the City and Mr. Sweatt indicated for some time yet. Mayor Baldwin
then commented he also has some concerns about the consultant being allowed
to bid.
After more discussion on the subject of the consultant, Mr. Williams asked if the
bid price of $49,995 includes both the equipment and the installation of it. Mr.
Sweatt answered it does.

Mrs. Agee moved to award the bid for the Telephone System to Brice Systems in
the amount of $49,995.00. Mrs. Jarman seconded the motion, which carried with
the following votes:
AYES: Councilmembers Jarman, Agee and Greenwald.
NAYS: Councilmembers Potempa and Williams.
#5 BID AWARD: Consider and take action awarding bid for Uniforms.
Mr. Sweatt related four bids were received, but apparently there was some
confusion and the specifications need to be clarified. They are suggesting the
bids be rejected and be readvertised.
Mr. Greenwald moved to reject all bids for Uniforms and readvertise. Mrs. Agee
seconded the motion, which carried with the following votes:
AYES: Councilmembers Jarman, Potempa, Agee, Williams and Greenwald.
NAYS: None.
#6 ORDINANCE Consider and take action on final reading of Ordinance
regarding Community Center rates.
Mayor Baldwin introduced an Ordinance and read the caption as follows:
ORDINANCE NO. 99-M-23
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS AMENDING
ATTACHMENTS 3 AND 4 TO ORDINANCE 92-M-8, WHICH AUTHORIZED
THE USE OF THE MUNICIPAL COMMUNITY CENTER; PROVIDING AN
EFFECTIVE DATE; AND REPEALING ALL ORDINANCES IN CONFLICT.
Mr. Greenwald moved to approve the final reading of an Ordinance regarding
Community Center rates. Mrs. Jarman seconded the motion, which carried with
the following votes:
AYES: Councilmembers Jarman, Potempa, Agee, Williams and Greenwald.
NAYS: None.
#7 ORDINANCE: Consider and take action on final reading of Ordinance
regarding Food Establishment Rules.

Mayor Baldwin introduced an Ordinance and read the caption as follows: '
ORDINANCE NO. 99-H-24
BY THE CITY COUNCIL OF TH.E CITY OF SCHERTZ, TEXAS PROVIDING
THAT THE CODE OF ORDINANCES OF THE CITY OF SCHERTZ, TEXAS,
CHAPTER 7 %, HEALTH, ARTICLE IT, FOOD ESTABLISHMENTS, BE
AMENDED BY REVISING SECTION 7 %-1, OFFICE OF HEALTH OFFICER;
REVISING SECTION 7 %..11, DEFINITIONS; REVISING SECTION 7 %-14,
PERMITS REQUIRED, ETC; ADDING SECTION 7 %-19, FOOD HANDLER
SANITATION TRAINING COURSE; ADDING SECTION 7 %-20, PENALTY;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE;
AND PROVIDING A REPEALING CLAUSE.
Mr. Sweatt commented they feel this provides a good change from the Heal~h
Card to the course on food handling. Also, the effective date is January 1,2000.
Gary Davis pointed out that all entities have been required to adopt the new
Texas Code and Mr. Sweatt added they also cleaned up some of the antiquated
definitions as part of this Ordinance. Mr. Potempa remarked the Staff has done a
good job on this Ordinance.

Mrs. Jarman moved to approve the final reading of an Ordinance regarding Food
Establishment Rules. Mr. Williams seconded tRe motion, which carried with the
following 'votes:
AYES: Councilmembers Jarman, Potempa, Agee, Williams and Greenwald.
NAYS: None.
#8 APPOINTMENTS: Consider and take action regarding appointments to
Schertz Economic Development Corporation Board.
Mr. Sweatt noted that the terms of Pia Jarman, Glyn Williams and Johnie McDow
had all expired on September 30th and they have expressed the desire to serve
again.
Mrs. Agee moved to appoint Pia Jarman, Glyn Williams and Johnie McDow to
the Schertz Economic Development Corporation Board. Mr. Potempa seconded
the motion, which carried with the following votes:

NAYS: None.
ABSTENTIONS: Councilmembers Jarman and Williams.
After the vote, Mayor Baldwin questioned the legality of Councilmembers
appointing themselves to a Board. Mr. Sweatt assured him this matter had been
referred to the City Attorney and was verified it is legal. He will retrieve the letter
from Michael Spain for the Mayor to read.
#9 CITY MANAGER'S REPORT
. Announced the Schertz Business Association has set December 3rd as the
date for the Christmas Tree Lighting Ceremony. It begins at 6:30 p.m.
#10 ITEMS BY COUNCIL
Mrs. Jarman:
.
. Mentioned that the ceremony where Ruth Tienor will receive her Hometown
Hero award is Wednesday, November 17th at the Marriott Rivercenter. So
far, she is the only one invited from Schertz. She stated we need someone to
go and she volunteered if she can get an invitation. Mayor Baldwin assured
her he would get her an invitation. She then asked if it would be appropriate
to honor Mrs. Tienor in December at a meeting. Mr. Sweatt suggested asking
her to attend a meeting and having Council acknowledge her award. Mayor
Baldwin liked the idea of a reception before the meeting in the Conference
Room. Something could be read at the Regular meeting and we could invite
the Library Board and some of her friends from the school district.
. Remarked the Library Board unanimously loves the newly renovated building.
It is classy and beautiful. The bookstore is doing very well in its new location.
The only thing they don't like is the blue and yellow sign on Schertz Parkway.
Mr. Potempa:
.
. Related that Channel 5 News this a.m. had a very interesting report on our
Animal Control Department. Matt Braughton was on and he looked good.
They showed some animals that had been mistreated. There are lots of cute
animals up for adoption. .He didn't like what the Sheriff had to say about the
situation where the animals that were confiscated from the people on 1-10 out
in the County.

Mr. Williams:
. Reported someone dumped a cement mixer not too far from Tiger Tote on
Woodland Oaks Drive and the cement is running down onto the asphalt. Mr.
Sweatt promised they would take care of it.
. Noted that in the ordinance book, there's "No Parking" on Woodland Oaks
Drive only down as far as Cotton King. Mr. Sweatt said they will be
submitting an ordinance to Council, which will bring that up-to-date.
. Stated he has been gone for several weeks and is glad to be home. The City
looks nice.
Mr. Greenwald:
. Commented he's had lots of questions about when they are going to sweep
up the rocks from the overlay project. Mr. Sweatt acknowledged they have
been out looking at the situation.
#11 ITEMS BY MAYOR
. Announced the Senior Citizen Christmas Bazaar is this Saturday at the
Community Center and he needs some help with judging at 9:00 a.m.
#12 ADJOURNMENT
There being no further business to discuss, Mayor Baldwin adjourned the
meeting at 7:58 p.m.
