SPECIAL WORKSHOP SESSION OF THE SCHERTZ CITY COUNCIL DECEMBER 1, 1999 The Schertz City Council convened in Special Workshop Session on Wednesday, December 1, 1999 at 7:00 p.m. in the Municipal Complex Conference Room, 1400 Schertz Parkway, Schertz, Texas. The following members were present: Mayor Hal Baldwin, presiding; Councilmembers Pia Jarman; Joe Potempa and Ken Greenwald. Absent: Councilmembers Reginna Agee and Glyn D. Williams. Staff present were City Manger Kerry Sweatt and City Secretary Norma Althouse. Mayor Baldwin didn't arrive at the meeting until 7:20 p.m., so Mayor Pro-Tern Joe Potempa called the meeting to order. #1 HEARING OF RESIDENTS No one had signed up to speak. #2 Discuss final reading of Ordinance regarding no parking designation on portions of Woodland Oaks Drive. Mr. Sweatt reminded Council they had already approved the first reading of this Ordinance. It designates no parking on either side of Woodland Oaks Drive from the eastern City limits to the western City limits. Council agreed they were ready for this item to be included on next Tuesday night's agenda. #3 Discuss a bond Resolution to be adopted by the Board of Directors of the Schertz/Seguin Local Government Corporation authorizing the issuance of obligations designated as "Schertz/Seguin Local Government Corporation Contract Revenue Bonds Series 1999"; acknowledging that these obligations will be sold to the First Southwest Company, as the authorized representative of a group of underwriters; discuss the provisions of a regional water supply contract executed between the City of Schertz, Texas, the City of Seguin, Texas, and the Schertz/Seguin Local Government Corporation; and other matters in connection therewith. Mr. Sweatt explained this is the second discussion preparatory to next Tuesday, when Council will be asked to take action on the Resolution. Schertz and Seguin are equal partners - each will share 50% of the debt service. The City Attorney, Michael Spain, has prepared a take-or-pay contract. Both he and Mark McLlney of Southwest Securities are present this evening. Mr. Spain advised Council to review the key points of the take-or-pay contract before having to make a decision next week. The City of Schertz is entitled to 50% of the water, therefore, they will share 50% of the cost. The new water -45- . . . system will serve both the cities of Schertz and Seguin. Mr. Spain went on to say electric and gas system language has been added to the contract. Mr. Spain then pointed out several other highlights of the contract as follows: the City of Schertz is not pledging any property taxes; the City of Schertz is assisting the Local Government Corporation in the acquisition of property for an alternate water supply; no franchises will be offered to competitors; the Local Government Corporation holds title to the water until it passes through the meter; annual financial information will be provided; and the Local Government Corporation can't issue additional bonds without the consent of Schertz. Mr. McLlney advised they had gone to the rating agencies and the insurance companies and he feels it was time well spent. Mr. Sweatt added that the first element of the total project is estimated at $40,000,000. The Council needs to be in a position to authorize progression of the project. The Local Government Corporation will meet on December 3rd to have the same discussion Council is having tonight and then they will meet again on December 7th to act formally. Mr. Spain commented, that assuming the insurance companies don't ask for more information, they think these documents are ready to go. Mr. Greenwald mentioned if there's a major change, they will have to go back to the Attorney General's office and start over. Mayor Pro-Tern Potempa expressed the hope this project will be approved - it is badly needed. There has been lots of hard work on it by everyone. Mayor Pro- Tern Potempa further stated he appreciates the efforts of the City Managers of both Schertz and Seguin. Mr. McLlney observed he thinks the rating agencies and the insurance companies were impressed by the cooperation between the two cities. Council agreed they were ready for this item to be included on next Tuesday night's agenda. Mayor Pro-Tern Potempa 'welcomed students from Ms. Briscoe's government class and then turned the meeting over to Mayor Baldwin. -46- . #4 Discuss Uniform Services bid. Mr. Sweatt noted GK Uniforms had submitted the lowest and most optimal bid and the recommendation is they be awarded the bid. Eric Perry of GK Uniforms is here tonight to answer any questions Council may have. Council indicated they were prepared for this item to be included on next Tuesday night's agenda. #5 CITY MANAGER'S REPORT · Reported the discussion on the Interlocal Agreement regarding Fire Protection Services for Bexar County had been held several weeks ago and was inadvertently left off the agenda for approval. It will be on next Tuesday night's agenda for action. · Stated the City received a thank you from June Krause for a sympathy basket sent upon the death of her husband. · Reminded everyone of the Tree Lighting ceremony this Friday evening at 6:30 p.m. here in front of the Municipal Complex. . #6 ITEMS BY COUNCIL Mr. Greenwald: · Mentioned the trip to visit the ratings agencies and the insurance companies had been an eye-opening experience. They had some pointed questions and we had some answers. · Recommended that anyone who has a chance needs to take the Citizens Police Academy course. Mrs. Jarman: · Commented she attended the Paragon Hometown Hero ceremony on November 17th and it was very nice. Navarro Williams apologized for the bad communications between Paragon and the City. She then read a letter from Ruth Tienor thanking the City for all their efforts on her behalf and saying how much she appreciated it. · Noted the Schertz Humane Society met on the 23rd of November and there were lots of complaints about the smell being back at the Animal Control facility. A suggestion was made that volunteers from the Humane Society go . in and help clean and also groom animals on Friday, December 17th. -47- . Mr. Potempa: · Told Edmond Ortiz from the Herald that he likes his articles about Schertz - he tells it like it is. #7 ITEMS BY MAYOR · Reported he had been asked to represent the City at the Tree Lighting Ceremony on Randolph Air Force Base last night. It was very interesting. They had a barbershop quartet perform. There was a drill team of children from the Resurrection Baptist Church. They had also held an essay contest about what "Christmas Means to Me." · Informed Council the last leg for acquiring Union Pacific right-of-way for the widening of FM 78 has been accomplished. · Noted, regarding the robbery at FM 1103 and IH-35, the police chased two occupants of the vehicle who ran and were able to get the driver and one occupant. . · Questioned if the police had any luck finding the Thanksgiving day IH-35 shooter. Mr Sweatt replied they had not. · Related Mrs. Schneider, who lives on Zuehl Street, had called him about the house next to her running a chop shop. She called the Police Chief and he investigated the situation and the Police Department was able to put them out of business. The Police Department has done another wonderful job. At this time Will Holford, reporter from the Seguin Gazette-Enterprise, introduced Lena Zies who will be replacing him.
