REGULAR SESSION OF THE SCHERTZ CITY COUNCIL
DECEMBER 7, 1999
The Schertz City Council convened in Regular Session on Tuesday, December
7, 1999 at 7:00 p.m. in the Municipal Complex Council Chambers, 1400 Schertz
Parkway, Schertz, Texas. The following members were present: Mayor Hal
Baldwin, presiding; Councilmembers Pia Jarman; Joe Potempa; Reginna Agee;
Glyn D. Williams and Ken Greenwald. Staff present were City Manager Kerry
Sweatt and City Secretary Norma Althouse.
Mayor Baldwin asked everyone to rise and join him in the Pledge of Allegiance to
the Flag. Following the Pledge, he introduced Commissioner Jim Wolverton and
Ramon Cook, a member of the Board of Directors of the Schertz/Seguin Local
Government Corporation as well as a member of the Schertz Economic
Development Corporation.
Mr. Sweat then introduced Mr. Vijay Jain, the new Comptroller for the City. Mr.
Jain is replacing the retired L.J. Cotto

#1 HEARING OF RESIDENTS: Those citizens wishing to speak on agenda
items (other than public hearing items) or items not on the agenda, will be heard
at this time.
Theresa Crouch, representing Guadalupe Martinez of 808 Aero, explained she
was present to ask Council's permission to hold a ceremony under her carport
honoring Our Lady of Guadalupe. There would be singing and praying from
11 :30 p.m. until 12:30 a.m. on the night of December 12th. Mayor Baldwin
asked how many people are expected to participate and Ms. Crouch answered
between 35 and 40.
Mayor Baldwin indicated he wasn't sure they have an ordinance to cover this
situation. Mr. Sweatt pointed out there is the noise ordinance, but Council can't
act on it because it's not on the agenda. After some discussion, Mayor Baldwin
told Ms. Crouch if they contact their neighbors to make them aware of this
ceremony, then the City will contact the Police Department to make them aware.
The consensus of Council was approval of the request with the provisions stated
above.

Chuck Sharpe of 1200 Antler wished everyone a Merry Christmas. He noted
there are lots of lights up all over the City and it looks very nice. He then played
a little joke on the Mayor by giving him an envelope with some money in it, which
he said was for personal services. It turned out Mr. Sharpe found himself at a
convenience store getting gasoline and didn't have his wallet, so the Mayor
loaned him some money. This was the repayment of the loan.

#2 RESOLUTION: Consideration and approval by the City Council of the City
of Schertz, Texas of a Bond Resolution to be adopted by the Board of Directors
of the Schertz/Seguin Local Government Corporation authorizing the issuance of
obligations designated as "Schertz/Seguin Local Government Corporation
Contract Revenue Bonds, Series 1999"; "acknowledging that these obligations
will be sold to the First Southwest Company, as the authorized representative of
a group of underwriters pursuant to the provisions of a purchase contract;
approving the provisions of a Regional Water Supply Contract executed between
the City of Schertz, Texas, the City of Seguin, Texas and the Schertz/Seguin
Local Government Corporation; authorizing the Mayor, City Secretary, and the
City Manager of the City of Schertz, Texas to execute on behalf of the City of
Schertz, all documents in connection with this transaction; and other matters in
connection therewith.
Mayor Baldwin introduced a Resolution and read the caption as follows:

CONSIDERATION AND APPROVAL BY THE CITY COUNCIL OF THE CITY
OF SCHERTZ, TEXAS OF A BOND RESOLUTION TO BE ADOPTED BY THE
BOARD OF DIRECTORS OF THE SCHERTZ/SEGUIN LOCAL GOVERNMENT
CORPORATION AUTHORIZING THE ISSUANCE OF OBLIGTIONS
DESIGNATED AS "SCHERTZ/SEGUIN LOCAL GOVERNMENT
CORPORATION CONTRACT REVENUE BONDS, SERIES 1999";
ACKNOWLEDGING THAT THESE OBLIGATIONS WILL BE SOLD TO THE
FIRST SOUTHWEST COMPANY AS THE AUTHORIZED REPRESENTATIVE
OF A GROUP OF UNDERWRITERS PURSUANT TO THE PROVISIONS OF
PURCHASE CONTRACT, APPROVING THE PROVISIONS OF A REGIONAL
WATER SUPPLY CONTRACT EXECUTED BETWEEN THE CITY OF
SCHERTZ, TEXAS, THE CITY OF SEGUIN, TEXAS AND THE
SCHERTZ/SEGUIN LOCAL GOVERNMENT CORPORATION; AUTHORIZING
THE MAYOR, CITY SECRETARY, AND THE CITY MANAGER OF THE CITY
OF SCHERTZ, TEXAS TO EXECUTE ON BEHALF OF THE CITY OF
SCHERTZ, TEXAS ALL DOCUMENTS IN CONNECTION WITH THIS
TRANSACTION; AND OTHER MATTERS IN CONNECTION THEREWITH.
Mr. Sweatt advised that Mark McLlney has been working with the Local
Government Corporation and with both City Councils. Mr. McLlney stated that
MBIA had the best grasp of it all - they gave a good insurance quote and surety
bond policy. The Local Government's Corporation's bonds are able to go out to
market, they are bank-qualified and he doesn't think there were any penalties
because of Y2K issues.

Mr. Sweatt emphasized that part of the action tonight is acknowledging the sale
of the bonds and also the take-or-pay contract. It is a requirement that both cities

approve the Resolution. This is a monumental time for the City and approval of
the Resolution will have a definite impact on the future.
Mr. Greenwald pointed out this has been two years in the making and is one of
the most significant actions the members of Council will take in their lifetimes.
Mr. Greenwald moved to approve the Resolution as presented in the caption
read by Mayor Baldwin. Mr. Potempa seconded the motion, which carried with
the following votes:
AYES: Councilmembers Jarman, Potempa, Agee, Williams and Greenwald.
NAYS: None.
Mayor Baldwin expressed appreciation to Mr. McLlney for all his efforts and also
commended the City of Seguin for joining the quest.. Mr. McLlney admitted it
had been an exciting time for him. Commissioner Wolverton thanked the Council
for looking to the future. Mr. Cook commented he was pleased to be on the
committee that will bring it about.
#3 INTERLOCAL AGREEMENT: Consider and take action on Interlocal
Agreement regarding Fire Protection Services for Bexar County.
Mr. Sweatt noted that some of the area this covers is from FM 1518 to the Cibolo
Creek on 1-10, and the Lakewood area. The Fire Department receives $900 per
month as part of this agreement and approval is recommended.
Mrs. Jarman moved to approve the Interlocal Agreement regarding Fire
Protection Services for Bexar County. Mr. Greenwald seconded the motion,
which carried with the following votes:
AYES: Councilmembers Jarman, Potempa, Agee, Williams and Greenwald.
NAYS: None.
#4 ORDINANCE: Consider and take action on final reading of Ordinance
regarding no parking designation on portions of Woodland Oaks Drive.
Mayor Baldwin introduced an Ordinance and read the caption as follows:
ORDINANCE NO. 99-D-26
BY THE CITY COUNCIL 'OF THE CITY OF SCHERTZ, TEXAS PROVIDING
THT THE CODE OF ORDINANCES, CITY OF SCHERTZ, TEXAS BE
AMENDED BY REVISING SECTION 18-91, PARKING PROHIBITED; AND
PROVIDING A REPEALING CLAUSE.

Mr. Sweatt advised this designates no parking on either side of Woodland Oaks
Drive from the eastern City limits to the western City limits. It is an extension of
the current Ordinance. Approval is recommended.
Mr. Williams moved to approve the final reading of an Ordinance regarding no
parking designation on portions of Woodland Oaks Drive. Mrs. Jarman
seconded the motion, which carried with the following votes:
AYES: Councilmembers Jarman, Potempa, Agee, Williams and Greenwald.
NAYS: None.
#5 BID AWARD: Consider and take action awarding bid for Uniform Services.
Mr. Sweatt commented that after review, they determined the lowest and best
bid was submitted by G.K. Uniforms in the amount of $262.89 per week. It is
recommended they be awarded the bid. John Bierschwale is here to answer any
questions.
Mr. Williams moved to award the bid for Uniform Services to G.K. Uniforms in the
amount of $262.89 per week. Mr. Greenwald seconded the motion, which
carried with the following votes:
AYES: Councilmembers Jarman, Potempa, Agee, Williams and Greenwald.
NAYS: None.
#6 Consider and take action setting a public hearing date on a request from
Halff Associates to rezone 5.71 acres.
Mr. Sweatt noted this is simply action to set a public hearing date on the request
from Halff Associates. Planning and Zoning already held a public hearing on this
request and is recommending approval of the rezoning. The City Secretary has
advised that December 21st would be the next possible date for a public hearing.
Mr. Greenwald moved to set December 21,1999 as the public hearing date on a
request by Halff Associates to rezone 5.71 acres. Mr. Williams seconded the
motion, which carried with the following votes:
AYES: Councilmembers Jarman, Potempa, Agee, Williams and Greenwald.
NAYS: None.

#7 Consider and take action setting a public hearing date on a request from
Schertz Planning and Zoning Commission to revise the Unified Development
Code (UDC).
Mr. Sweatt advised once again that the City Secretary has indicated December
21st would be the next possible date for a public hearing. This revision to the
UDC would help clarify the bandit sign issue.
Mrs. Jarman moved to set December 21, 1999 as the date for a public hearing
regarding a request from the Planning and Zoning Commission to revise the
UDC. Mr. Potempa seconded the motion, which carried with the following votes:
AYES: Councilmembers Jarman, Potempa, Agee, Williams and Greenwald.
NAYS: None.
#8 CITY MANAGER'S REPORT
· Reported that former City employee, Tom Dovey, is in the hospital and had a
toe amputation due to complications of diabetes. He has the address if
anyone's interested in visiting or sending a card.

#9 ITEMS BY COUNCIL
Mrs. Jarman:
· Related attending the Library Board meeting and said they paid off the book
drop. Also at the library, starting December 11th, is the opening of Billy
Keen's exhibit of his Santas. They are worried about a light turnout because
of the "big football game." The morning is covered, but the artist will also be
there in the afternoon.
Mr. Williams:
· Thanked everyone who voted on the resolution tonight regarding bonds for
the water project.
· Mentioned he is a 1963 Samuel Clemens High School graduate, so GO
BUFFALOES!
Mr. Greenwald:
· Noted that the vote on the bond resolution tonight is the most significant thing
this City has done since it was incorporated. It is a real milestone. We can
. divorce ourselves from the Edwards and do our own thing. He enjoyed the

trip to New York to the insurance and rating agencies, but he's glad to be
home.
#10 ITEMS BY MAYOR
. There were some students in the audience from Samuel Clemens High
School and he asked if any of them had information about the upcoming
football game. The Mayor was informed the game is this Saturday,
December 11th, at Texas A&M Kyle Field at 5:30 p.m. The Mayor wished
them all the best and said he is looking forward to a 4A Division
Championship sign at the City limits.
#11 ADJOURNMENT
There being no further business to discuss, Mayor Baldwin adjourned the
meeting at 8:02 p.m.
