REGULAR SESSION OF THE SCHERTZ CITY COUNCIL
JANUARY 4, 2000
(Preceeding the meeting, a reception for Ruth Tienor was held at 6:30 p.m. in the
Conference Room. Mrs. Tienor was selected as the 1999 Paragon Hometown
Hero for the City of Schertz and had been honored by Paragon at a ceremony in
November. The Mayor and his wife, Councilmembers, the City Manager, the City
Secretary, other members of City staff, family, friends, co-workers and fellow
board members attended the reception to show her their appreciation.
Refreshments were served and there was opportunity for conversation with Mrs.
Tienor.)
The Schertz City Council convened in Regular Session on Tuesday, January 4,
2000 at 7:00 p.m. in the Municipal Complex Council Chambers, 1400 Schertz
Parkway, Schertz, Texas. The following members were present: Mayor Hal
Baldwin, presiding; Councilmembers Pia Jarman; Joe Potempa; Reginna. Agee;
Glyn D. Williams and Ken Greenwald. Staff present were City Manager Kerry
Sweatt and City Secretary Norma Althouse.

Mayor Baldwin asked everyone to rise and join him in the Pledge of Allegiance to
the Flag. Following the Pledge, the Mayor declared this was a great evening and
explained that a reception had just been held for Mrs. Tienor. He then introduced
some of the members in the audience - County Attorney Bob Covington, County
Commissioner Jim Wolverton, Judge Paul Finley, Judge LeRoy Cinnamon and
his wife, and Ruth Tienor and her husband. Mayor Baldwin went on to say Mrs.
Tienor has served the community, and especially the youth of the community,
well. She is currently, and has been for a number of years, a physical education
teacher at Schertz Elementary, she was one of the founding persons of the
Schertz Library, and was the force behind getting a 1/3 walking mile track on the
campus of Schertz Elementary. She even sold raffle tickets to get 7 stations
established around the track with chinning bars and other exercise activities.
At this time, Councilmember Jarman introduced members of the Library Board
who were present - Margaret Riley, Julie Parr, Norma Head, Barbara Ricks,
Mary McAllister and of course, Ruth Tienor. Mayor Baldwin asked everyone to
stay for a brief ceremony honoring Judge Cinnamon upon his retirement from the
City.

A plaque from the City was presented to Judge Cinnamon. Then County
Attorney Bob Covington also presented him with a plaque and read a letter from
a young man in the military who was grateful to the Judge for helping him get into
the military after some problems with the law. Judge Cinnamon thanked Council
for the opportunity to serve the City and said it had been a pleasure. He then
introduced Stacy Padgett and said she will be the new Court Administrator.

. Mayor Baldwin also introduced Wyatt Agee, a member of the board of the
Samuel Clemens High School Student Council.
#1 HEARING OF RESIDENTS: Those citizens wishing to speak on agenda
items (other than public hearing items) or items not on the agenda, will be heard
at this time.
No one had signed up to speak.
#2 ORDINANCE: Consider and take action on final reading of Ordinance
rezoning 5.71 acres from GB to M-1.
Mayor Baldwin introduced an ordinance and read the caption as follows:
ORDINANCE NO. 00-S-1
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS AMENDING
THE UNIFIED DEVELOPMENT CODE (UDC) ORDINANCE NO. 96-S-28 BY
REZONING 5.71 ACRES OUT OF GUADALUPE COUNTY AND REFLECTING
SUCH CHANGES ON CERTAIN ZONING MAPS IN ACCORDANCE WITH THE
SCHERTZ UDC ORDINANCE.
. Mr. Sweatt mentioned that representatives of Pro-Logis were at the meeting to
answer any questions by Council.
Mrs. Jarman moved to approve the final reading of an Ordinance rezoning 5.71
acres from GB to M-1. Mr. Greenwald seconded the motion, which carried with
the following votes:
AYES: Councilmembers Jarman, Potempa, Agee, Wiliams and Greenwald.
#3 ORDINANCE: Consider and take action on final reading of Ordinance
revising the Unified Development Code (UDC).

BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS PROVIDING
THAT THE UNIFIED DEVELOPMENT CODE, ORDINANCE NO. 96-S-28, CITY
OF SCHERTZ, TEXAS BE AMENDED BY REVISING ARTICLE VII, SPECIAL
DISTRICTS, SECTION 2, ROY RICHARD DRIVElFM 3009 OVERLAY
DISTRICT AND SECTION 3, SCHERTZ PARKWAY DISTRICT; AND
PROVIDING A REPEALING CLAUSE.

Mr. Greenwald moved to approve the final reading of an Ordinance revising the
Unified Development Code. Mr. Potempa seconded the motion. Mr. Sweatt,
before the vote, stated he would be glad to answer any questions. Mr. Potempa
asked if the bandit sign violations of this Ordinance would be listed in the
quarterly report and Mr. Sweatt replied yes - once the Ordinance is in effect. At
this time the vote was taken and the motion carried as follows:
AYES: Councilmembers Jarman, Potempa, Agee, Williams and Greenwald.
NAYS: None.
#4 CITY MANAGER'S REPORT
. Mentioned C.H. "Pokey" Matthies, a Councilmember from Seguin, passed
away over the weekend. Funeral services are scheduled for 2:00 p.m.
January 6th. A floral arrangement was sent on behalf of the City.
. Pointed out we are here regardless of Y2K The library had a few small
glitches in that there were some units we had identified under the study as
being non-compliant.
#5 ITEMS BY COUNCIL
. Mrs. Jarman:
. Reported that at the Library Board meeting of January 3rd, the computer
glitches that Mr. Sweatt mentioned were discussed. The treasurer mentioned
that as of the end of November they had $18,905 in the investment account
and the cash was something over $3,000. They hope to fix the roof from the
investment account. As far as membership on the Board is concerned, Pattie
Lovelady had resigned at one point, but she is now back. The new member
is Henry Gutierrez. Mayor Baldwin verified that Pattie Lovelady had resigned,
but is now back on the Board. Mrs. Jarman stated whatever circumstances in
Ms. Lovelady's life had caused her to resign have now been resolved.

. Indicated the last time she had reported a sad thing as far as the Schertz
Humane Society about the 3 dogs they took down to the Wal-Mart adoption
that were not adopted. However, two families who had seen the dogs down
there came into the shelter and adopted them. So, it has a happy ending.
Also, because of the successful adoption that the Animal Defense League
had that same Sunday when they adopted out over 200 animals, the Animal
Defense League then came and took 28 animals (dogs and cats combined)
from our facility. She understands the Bexar County Humane Society also
took a total of 10 puppies and kittens combined. One other interesting thing
she heard is that there are big baskets of rawhide and other items at the
animal control facility that were donations. Apparently someone had donated

a bunch of those to the Seguin Humane Society and they in turn were going
to distribute them to other shelters and gave them to a gentleman who was
going to do so. Obviously he didn't do so, because a couple weeks later they
found them being sold at the flea market. The individual responsible for
giving them to the gentleman removed them from the flea market and gave
some to our facility.
Mr. Potempa:
. Related that his garbage was picked up at 6:30 p.m. this evening. On
December 21st, it was not picked up until 8:45 p.m. Mr. Sweatt promised to
check into the situation.
Mr. Greenwald:
. Suggested we need someone to push the banning of fireworks in the State at
the next legislative session - perhaps Edmund Kuempel. People have to
realize lives are worth more than tax dollars.
#6 ITEMS BY MAYOR
.
. Jokingly noted that his watch still works, his VCR still works, and the
computer rolled over. He then referred to a letter in the San Antonio Express-
News that said we can expect YK10 problems in the year 2010.

There being no further discussion, Mayor Baldwin adjourned the meeting at
7:37 p.m.
