REGULAR SESSION OF THE SCHERTZ CITY COUNCIL APRIL 18, 2000 The Schertz City Council convened in Regular Session on Tuesday, April 18, 2000 at 7:00 p.m. in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Schertz, Texas. Those present were as follows: Mayor Hal Baldwin, presiding; Councilmembers: Pia Jarman; Joe Potempa and Ken Greenwald. Absent: Councilmembers Reginna Agee and Glyn D. Williams and Ken Greenwald. Staff present were City Manager Kerry Sweatt and City Secretary Norma Althouse. #1 HEARING OF RESIDENTS: Those citizens wishing to speak on agenda items (other than public hearing items) or items not on the agenda, will be heard at this time. No one had signed up to speak. #2 ORDINANCE: Consider and take action on final reading of Ordinance regarding required sewer connections and fixtures and unlawful disposal of wastewater. Mayor Baldwin introduced an ordinance and read the caption as follows: ORDINANCE NO. OO-F-ll e BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, PROVID~NG THAT THE CODE OF ORDINANCES OF THE CITY OF SCHERTZ, TEXAS BE AMENDED BY REVISING CHAPTER 19, WATER, WASTEWATER AND WASTE DISPOSAL, ARTICLE II, WATER SERVICE, SECTION 19-69, REQUIRED SEWER CONNECTIONS AND FIXTURES AND UNLAWFUL DISPOSAL OF WASTEWATER; AND PROVIDING A REPEALING CLAUSE. Mr. Sweatt explained this is an amendment to the existing ordinance, which requires that you tie into the City sewer system if you are within 300 feet. This would change it to 500 feet for residential and 1500 feet for commercial. This amendment will aid those customers in the area of the new lift station. Mrs. Jarman moved to approve the final reading of an Ordinance regarding required sewer connections and fixtures and unlawful disposal of wastewater. Mr. Potempa seconded the motion. Before the vote, Mr. Greenwald said it should be pointed out that those currently on a septic system are not being told they have to tie into the sewer system now. The City policy is that when the septic system fails, then they have to tie in. . -169- . The vote was then taken and the motion carried as follows: AYES: Councilmembers Jarman, Potempa and Greenwald. NAYS: None. #3 PUBLIC HEARING DATE: Consider and take action setting a public hearing date for drought contingency plan. Mr. Sweatt stated there was confusion at the last meeting because of information from the Texas Natural Resource and Conservation Commission (TNRCC). They recently informed us that even though our plan meets the Edwards requirements, we must adopt a plan according to their general guidelines. The difference is in the trigger levels and they're trying to get that resolved. It is recommended the Council set a public hearing date of May 16,200. Mrs. Jarman moved to setting a public hearing date for the drought contingency plan for May 16, 2000. Mr. Greenwald seconded the motion. Mayor Baldwin asked why not insist all of us adopt the same plan. Mr. Sweatt answered the bureaucracy in Austin is very confusing in our case. . At this time the vote was taken and the motion carried as follows: AYES: Councilmembers Jarman, Potempa and Greenwald. NAYS: None. #4 PUBLIC HEARING DATE: Consider and take action setting a public hearing date for a zoning change in Oak Trails Subdivision, Unit 3. Mr. Sweatt advised that Planning and Zoning recommended denial of the request to change the zoning from R-l to R-6 based primarily on the traffic analysis. The developer, however, has asked City Council to move forward, so it is appropriate to set a public hearing date. May 2, 2000 is the recommended date. Mrs. Jarman moved to set the public hearing date for a zoning change in Oak Trails Subdivision, Unit 3 for May 2,2000. Mr. Greenwald seconded the motion, which carried with the following votes: AYES: Councilmembers Jarman, Potempa and Greenwald. NAYS: None. . #5 POLICY: Consider and take action on policy regarding security for use of public facilities. -170- . Police Chief Jerry Smith had revised the City's policy to read as follows: Security at City Facilities It shall be the policy of the City to require users/renters of City facilities to provide security under certain circumstances when renting these facilities. All security at City facilities will be provided by the Schertz Police Department either using off-duty officers or by adding on-duty officers whom will be working in an overtime capacity. Rates for off-duty officers will be determined by the Schertz Police Department off-duty work coordinator. In the event on-duty officers are used, the City shall bill the user the overtime rate for the individual officers being used. Security will be required under the following circumstances unless waived by the Police Chief or City Manager: 1) When alcohol is served/provided/present and there are ten (10) or more persons in attendance, regardless of the type of event or age of attendees. . 2) When the Chief of Police or City Manager deems that it is in the best interest of the City to ensure the safety of those using the facility or in the best interest of the safety of the community based upon the size of the group or type of event. The number of officers required at any facility shall be determined by the Chief of Police or City Manager based upon the number of persons attending, type of event or public safety considerations. Security payments for any event shall be paid in advance unless otherwise agreed to by written contract. Mr. Potempa moved to adopt the Policy for Security at City Facilities. Mr. Greenwald seconded the motion, which carried with the following votes: AYES: Councilmembers Jarman, Potempa and Greenwald. NAYS: None. #6 BID AWARD: Consider and take action awarding bid for River Road Street and Drainage Improvement Project. . Mr. Sweatt stated he had asked the City Engineer to prepare the plans and specifications. Two bids were received on the project. They were amazed and shocked at the 40% increase of the bid over the original estimate. It is recommended City Council reject the bid and re-advertise. They haven't heard from CCMA regarding the cost increase. -171- . Mayor Baldwin admitted it's a sizeable increase due to the price of fuel and also because asphalt costs have gone up. He commented he seriously doubts if fuel prices will come down. River Road is a horrible mess and needs to be tended to so that situation can be resolved. The Mayor stated he's not sure they shouldn't go ahead with the improvements. Mr. Potempa agreed. Mr. Sweatt pointed out the situation is not life-threatening, although certainly unpleasant. If it were an emergency, he would make a different recommendation. Mr. Potempa commented he thinks the project deserves action now. Mr. Potempa then moved to award the bid for the River Road Street and Drainage Improvement project to ACS Paving in the amount of$81,656.32. Mr. Greenwald seconded the motion, which carried with the following votes: AYES: Councilmembers Jarman, Potempa and Greenwald. NAYS: None. #7 BID AWARD: Consider and take action awarding bid on building renovation work adjacent to FM 78 parking project. . Mr. Sweatt noted that when the City acquired the property, it was necessary to remove a building. They now need to waterproof and refinish certain walls. One bid was received. They could probably reject the bid and re-advertise and possibly get a lower bid, but they need to get on with the project. Approval of the bid is recommended. Mr. Greenwald moved to award the bid for building renovation work adjacent to FM 78 parking project to Pronto Sandblasting & Coatings, Inc. in the amount of $49,777.00. Mr. Potempa seconded the motion, which carried with the following votes: AYES: Councilmembers Jarman, Potempa and Greenwald. NAYS: None. #8 CITY MANAGER'S REPORT . Once again reminded everyone of the Annual Easter Egg Hunt, sponsored by the Herald Newspaper, this coming Saturday morning at the City Park at 9:00 a.m. . Noted later in the day this coming Saturday is the Employee Picnic at the City Park. There will be games, dinner and presentation of service awards. Mr. Potempa jokingly said he heard a rumor there will be a dunking booth at the picnic. Mr. Sweatt thought that rumor was untrue. . . Mentioned the Employee Remembrance Day ceremony, which will be held April 24th at the Public Works facility at Noon. -172- . . Distributes copies of plans and specifications for the playing fields and parking lot project. . Related that on April 19th at 5:00 p.m. there will be an emergency exercise near Lower-Seguin Road.
