REGULAR SESSION OF THE SCHERTZ CITY COUNCIL JULY 18,2000 The Schertz City Council convened in Regular Session on Tuesday, July 18, 2000 at 7:00 p.m. in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Schertz, Texas. Those present were as follows: Mayor Hal Baldwin, presiding; Councilmembers Norma Head; Joe Potempa; Reginna Agee; Glyn Williams and Ken Greenwald. Staff present were City Manager Kerry Sweatt and Deputy City Secretary Dolores Butler. Mayor Baldwin asked everyone to rise and join him in the Pledge of Allegiance to the Flag. 1. HEARING OF RESIDENTS: Mr. David Richmond inquired as to the status of the recommendations provided in early May by the Beautification Committee appointed for the FM 78 beautification project. Have any of those recommendations have been pursued or are they still being considered? Mayor Baldwin stated that at this point none have been completed. There are some excellent suggestions but some are just very expensive. . Mr. Sweatt stated there was a request for information from GVEC regarding the cost of relocating lighting or placing underground. Mayor Baldwin said it was a good report and we'd like to see all of those things happen. We will look into it and see what we can do economically and see what we can get the businesses along FM 78 to contribute. Mr. Richmond's concern was the lighting issue, thinking GVEC would be more likely to get involved while the roadway is torn up during the widening process. #2 ORDINANCE: Consider and take action on second reading of Ordinance rezoning 41.97 acres from GB and R-2 to R-S and R-2. AN ORDINANCE BY THE CITY OF SCHERTZ, TEXAS AMENDING THE UNIFIED DEVELOPMENT CODE (UDC) ORDINANCE NO. 96-5-28 BY REZONING APPROXIMATELY 41.97 ACRES OUT OF GUADALUPE COUNTY AND REFLECTING SUCH CHANGES ON CERTAIN REZONING MAPS IN ACCORDANCE WITH THE SCHERTZ UDC ORDINANCE. . Mr. Greenwald noted that at the last meeting, Mr. Aiken agreed to present some architectural renderings in response to questions from some of the people. -247- . Mr. Aiken reiterated his former proposal at the July 12 meeting, displaying the formal plat. Mr. Greenwald moved Council approve the second reading of the ordinance rezoning 41.97 acres of land from GB and R-2 to R-5 and R-2. Mr. Williams seconded the motion. The vote was as follows: AYES: Councilmembers Head, Potempa, Agee, Williams and Greenwald #3 ORDINANCE: Consider and take action on second reading of Ordinance rezoning 14.57 acres from R-2 to R-5. AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS AMENDING THE UNIFIED DEVELOPMENT CODE (UDC) ORDINANCE NO. 96-5-28 BY REZONING APPROXIMATELY 14.57 ACRES OUT OF GUADALUPE COUNTY AND REFLECTING SUCH CHANGES ON CERTAIN ZONING MAPS IN ACCORDANCE WITH THE SCHERTZ UDC ORDINANCE. Mr. Aiken showed an illustration of the conceptual plan for the garden homes as presented at the July 12 meeting. . Mr. Sweatt said it should be pointed out that there is only one entry, this is purely conceptual and hasn't cleared the Planning & Zoning Commission. Mrs. Niland stated she is still concerned about the number of homes being built in that small area and the parking for residents and guests. Mr. Greenwald moved to approve the second reading of the ordinance rezoning approximately 14.57 acres from R-2 to R-5. Mr. Williams seconded the motion and the vote was as follows: AYES: Councilmembers Potempa; Agee; Williams and Greenwald NAYS: Councilmember Head #4 ORDINANCE: Consider and take action on second reading of Ordinance regarding rate increase by Waste Management. AN ORDINANCE . BY THE CITY COUNCIL OF THE CITY OF SCHERT, TEXAS PROVIDING THAT THE CODE OF ORDINANCES, CITY OF SCHERTZ, TEXAS BE AMENDED BY REVISING SECTION 71/2-54, EXHIBIT 2, GARBAGE RATE -248- . SCHEDULE; PROVIDING AN EFFECTIVE DATE; AND PROVIDING A REPEALING CLAUSE. Mr. Williams moved to approve the second reading of the ordinance regarding the rate increase by Waste Management. Mr. Greenwald seconded the motion and the vote was as follows: AYES: Councilmembers Head, Potempa, Agee, Williams and Greenwald NAYS: None #5 Discuss water billing matters. Mr. Sweatt said that everything is on schedule and all the deposits have been made. Everything is working correctly. We haven't gone through all cycles but we expect the bugs to be ironed out. Mr. Potempa inquired of Mr. Sweatt regarding the consumption rate being on the bill. Mr. Sweatt replied that has been addressed. As far as we can determine, all the problems have been addressed including getting the deposits. Some bills may have gone out before the checks were deposited but they have been credited to the accounts. . Mr. Greenwald asked if the bills will now show credits and Mr. Sweatt stated they will. The only issue will be that it shows the term "arrears" which is an accounting term that may be a plus or a minus. If a person has an arrears and a credit, it will show as a minus but not as a "red". #6 CITY MANAGER'S REPORT: Mr. Sweatt distributed a proposed draft of program/invitation for use of the dedication ceremonies for the new public safety facilities. Please give us direction soon so that we may print and mail timely. If you have persons you would like to send this to, let me have your list as soon as possible. #7 ITEMS BY COUNCIL Mr. Greenwald: Noted that if water keeps dropping in J-17 like it is now, come Monday or sooner, we will be in Stage II water conservation. #8 ITEMS BY MAYOR: Mayor Baldwin commented that the signs that have been put up regarding Stage I are good, reminding people of the severity of water conservation. Mayor Baldwin adjourned the regular session at 7:26 p.m. . -249- - #9 EXECUTIVE SESSION: Called under Chapter 551 Texas Government Code, Sub-Section 551.074, Personnel Matters, consultation with attorney to deliberate the employment, evaluation, and employment contract of the City Manager. #10 Action if any, on above Executive Session. City Council consulted with their attorney on the city manager's contract, discussed the city manager's evaluation and will not at this time take any action. #11 ADJOURNMENT There being no further business to discuss, Mayor Baldwin called for a motion to adjourn. Mrs. Agee moved to adjourn the regular session of July 18, 2000. Mr. Greenwald seconded the motion and the vote was unanimous. The meeting was adjourned at 9:00 p.m. Mayor, City of Schertz, Texas .
