REGULAR SESSION OF THE SCHERTZ CITY COUNCIL
OCTOBER 6, 1998
The Schertz City Council convened in Regular Session on Tuesday, October 6,
1998 at 7:00 p.m. in the Municipal Complex Council Chambers, 1400 Schertz
Parkway, Schertz, Texas. The following members were present: Mayor Hal
Baldwin, presiding; Councilmembers Pia Jarman; Joe Potempa and Ken
Greenwald. Absent: Councilmemb~rs Norman W. Agee, Sr. and Timothy
Swinney. Staff present were City Manager Kerry Sweatt and City Secretary
Norma Althouse.
Mayor Baldwin asked everyone to rise and join him in the Pledge of Allegiance to
the Flag.
#1 APPROVAL OF MINUTES: Special Workshop Session 07-15-98

Mr. Greenwald moved to approve the minutes of the Special Workshop Session
of 7-15-98, the Regular Session of 7-21-98 and the Joint Session of 7-22-98. Mr.
Potempa seconded the motion, which carried with the following votes:

#2 HEARING OF RESIDENTS: Those citizens wishing to speak on agenda
items (other than public hearing items) or items not on the agenda will be heard
at this time.
George Mower of 501 Brooks Ave. spoke regarding City notices of meetings. Mr.
Mower stated the TIF agenda for October 5th had not been posted. Mr. Potempa
advised that the meeting was cancelled. Mr. Mower then inquired-if there are
other Councilmembers on any other Boards illegally. Mayor Baldwin answered
there are not.
#3 ORDINANCE: Consider and take action on first reading of Ordinance
regarding TMRS and the continuing automatic updated service credit calculations
and increases in the contribution rate.
Mayor Baldwin introduced an ordinance and read the caption as follows:

TEXAS MUNICIPAL RETIREMENT SYSTEM
AN ORDINANCE AUTHORIZING AND ALLOWING, UNDER THE ACT
GOVERNING THE TEXAS MUNICIPAL RETIREMENT SYSTEM, "UPDATED
SERVICE CREDITS" IN SAID SYSTEM ON AN ANNUAL BASIS FOR
SERVICE PERFORMED BY QUALIFYING MEMBERS OF SUCH SYSTEM
WHO AT THE EFFECTIVE DATE ,OF THE ALLOWANCE ARE IN TH
EMPLOYMENT OF THE CITY OF SCHERTZ; PROVIDING FOR INCREASED
PRIOR AND CURRENT SERVICE ANNUITIES FOR RETIREES AND
BENEFICIARIES OF CONTRIBUTIONS TO THE CURRENT SERVICE
ANNUITY RESERVE AT RETIREMENT OF THE EMPLOYEES OF THE CITY;
AND ESTABLISHING AN EFFECTIVE DATE FOR THE ORDINANCE.
Mr. Sweatt briefly reviewed the highlights which had already been discussed at
the workshop.
Mr. Potempa moved to approve the first reading of an Ordinance regarding
TMRS and the continuing automatic updated service credit calculations and
increases in the contribution rate. Mr. Greenwald seconded the motion, which
carried with the following votes:
AYES: Councilmembers Jarman, Potempa and Greenwald.

#4 PUBLIC HEARING: To receive citizen comments on a request by
Affordable Residential Community (ARC) to rezone 2.109 acres from
Manufactured Home (MH) to General Business (GB).
Mayor Baldwin explained the procedures to be followed for the public hearing.
Mr. Sweatt stated this request had been reviewed by Planning and Zoning. They
held a public hearing and are recommending approval of the rezoning. He
pointed out the location of the property on the map and reminded Council they
also have a map in their packets. Eight (8) letters were sent to property owners
within the required distance with two (2) being returned in favor and none being
returned in opposition. Mr. Steve Horowitz is here this evening to answer any
questions Council may have.
There being no questions or comments, Mayor Baldwin closed the public hearing
at this time.

#5 ORDINANCE: Consider and take action on first reading of Ordinance.
rezoning 2.109 acres from MH to GB.
Mayor Baldwin introduced an ordinance and read the caption as follows:

BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS AMENDING
THE UNIFIED DEVELOPMENT CODE (UDC) ORDINANCE NO. 96-5-28 BY
REZONING 2.109 ACRES OF LAND OUT OF GUADALUPE COUNTY AND
REFLECTING SUCH CHANGES ON CERTAIN ZONING MAPS IN
ACCORDANCE WITH THE SCHERTZ UDC ORDINANCE.
Mr. Potempa moved to approve the first reading of an Ordinance rezoning 2.109
acres from MH to GB. Mr. Greenwald seconded the motion , which carried with
the following votes:
AYES: Councilmembers Jarman, Potempa and Greenwald.
NAYS: None.
#6 PUBLIC HEARING: To receive citizen comments on a request by M.W.
. Cude, on behalf of ABG Investments, to rezone two parcels of land - 0.969 acres
,..p~ Single-Famil~~esidential Dwelling District (R-2) to General Business (GB)
and 0.127 acres 1ftn General Business (GB) to Single-Family Residential
Dwelling District (R-2).
Mayor Baldwin explained the same procedures would apply as followed for the
previous public hearing.
Mr. Sweatt pointed out the location on the map and stated four (4) letters were
sent to property owners within the required distance. One (1) letter was returned
in favor and none were returned in opposition. He stated Mr. Cude is present to
answer any questions Council may have.
Mr. Cude explained briefly they are rezoning back to GB to facilitate some lots
and showed Council the Master Plan for the Woodbridge Subdivision.
There being no further comments or questions, Mayor Baldwin closed the public
hearing at this time.
#7 ORDINANCE: Consider and take action on first reading of Ordinance

#8 Consider and take action setting a public hearing date on a request from
Stone Creek RV Park, 18905 IH-35 N, to rezone property to allow manufactured
homes to be placed within a portion of the RV Park.
Mr. Sweatt advised that, according to the City Secretary, the earliest possible
date for a public hearing on this request would be November 3rd.

Mr. Greenwald moved to set November 3, 1998 as the public hearing date on a
request by Stone Creek RV Park to rezone property allowing manufactured
homes to be placed within a portion of the RV Park. Mrs. Jarman seconded the
motion, which carried with the followign votes:
AYES: Councilmembers Jarman, Potempa and Greenwald.
NAYS: None.
#9 INTERLOCAL AGREEMENT: Consider and take action regarding Interlocal
Agreement for library service with Guadalupe County.
Mr. Sweatt related Guadalupe County has agreed on enhanced services for the
library and, if this is approved, will pay the City a monthly sum of $7,067.75.
Approval is recommended.

subdivisions. It was mentioned that several of the Homeowners Associations
distribute the Newsletters to their particular subdivision. Rachel Drady from
the Herald Newspaper informed Council they are jumping their circulation by
about 2,000, but it is still their policy not to distribute the Herald to
subdivisions where the building is not completed. Mr. Sweatt promised to get
a list for Council's next packet of the Homeowners Associations that are
currently receiving the Newsletter.
Mr. Potempa:
. Mentioned seeing something good on the way to the meeting - a police
officer was patrolling the IH-35 access road between the La Pasadita
Restaurant andHEB.
. Announced he will not be at the November 3rd meeting because he will be
TDY for schooL
Mr, Greenwald:
· Noted the Christmas Lighting Committee was lucky enough to get some more
participation as a result of Steve Simonson's article in the Newsletter.
