REGULAR SESSION OF THE SCHERTZ CITY COUNCIL
DECEMBER 15,1998
The Schertz City Council convened in Regular Session on Tuesday,
December 15, 1999 at 7:00 p.m. in the Municipal Complex Council
Chambers, 1400 Schertz Parkway, Schertz, Texas. Those present
were as follows: Mayor Hal Baldwin, presiding; Councilmembers Pia
Jarman; Joe Potempa; Norman Agee, Sr.; Tim Swinney and Ken
Greenwald. Staff present were: City Manager Kerry Sweatt, Mark
Marquez, Economic Development Coordinator and Deputy City
Secretary Dolores Butler.
Mayor Baldwin asked everyone to rise and join him in the Pledge of
Allegiance to the Flag.
Prior to the meeting, Mayor Baldwin commented on the Christmas
decorations in the city this year and with the assistance of Kim Moss,
Chairman of the Decorating Committee, presented awards to those
present as Mr. Sweatt announced the following:

#1 HEARING OF RESIDENTS
No one had signed up to speak.
#2 PUBLIC HEARING: To receive citizen comments on a request
from Continental Homes to rezone 50 acres from R-2 and GB to R-6.
Mr. Sweatt advised. that notices were mailed to 67 property owners in
the requisite required distance and as of the 11th, three (3) were
returned in favor and one (1) was returned with an incorrect address.
Mr. Paul Denham, representing the applicant is here to answer
questions. The property is located of off Schertz Parkway. The master
plan calls for a design in which the gated community entranceway
would be off Schertz Parkway and Savannah Drive.
Mr. Denham circulated exhibits to better explain the planned project.
Continental Homes is basically designing a subdivision that mirrors
exactly what they've done to date. Units 1 through 5 have been very
successful. Savannah Drive will be extended across and will be gated
off of that.

Mayor Baldwin inquired as to how far back Savannah Drive will go
when everything is completed.
Mr. Denham said it is about 300 - 400 at this time. It follows the major
thoroughfare plan.
Mr. Greenwald asked if the emergency breakaway was back in there
and Mr. Denham replied that this part does not have a secondary
breakaway.
Mayor Baldwin inquired if the northern boundary abutted Live Oak Hills
Subdivision or is there another tract between. Mr. Denham stated it
does but the overhead power lines serve as a buffer as no development
will likely go in 100' back from that boundary.
The consensus was that an emergency entrance is necessary to be
included in the plan and with that, Mayor Baldwin closed the public
hearing.

#3 ORDINANCE: Consider and take action on first reading of
Ordinance rezoning 26.9 acres from Single-Family Residential Dwelling
District (R-2) to Gated Community (R-6) and 23.1 acres from General
Business (GB) to Gated Community (R-6). [Continental Homes]
Mayor Baldwin introduced an ordinance and read the caption as
follows:
AN ORDINANCE
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS
AMENDING THE UNIFIED DEVELOPMENT CODE (UDC)
ORDINANCE NO. 96-5-28 BY REZONING 50 ACRES OF LAND OUT
OF GUADALUPE COUNTY AND REFLECTING SUCH CHANGES ON
CERTAIN ZONING MAPS IN ACCORDANCE WITH THE SCHERTZ
UDC ORDINANCE.
Mayor Baldwin asked for a motion.

Mr. Greenwald moved to approve first reading of an ordinance
rezoning 26.9 acres from Single-Family Residential (R-2) to Gated
Community (R-6) and 23.1 acres from General Business (GB) to Gated
Community (R-6). Mrs. Jarman seconded the motion, which carried
with the following votes:
AYES: Councilmembers Jarman, Potempa, Agee, Sr., Swinney and
Greenwald.
NAYS: None
#4 ORDINANCE: Consider and take action on final reading of
Ordinance authorizing a Tax Abatement and Tax Abatement
Agreement with Keaco, Inc.
Mayor Baldwin introduced an ordinance and read the caption as
follows:
AN ORDINANCE
BY THE CITY OF SCHERTZ, TEXAS, APPROVING A TAX
ABATEMENT AND A TAX ABATEMENT AGREEMENT FOR AND

Mrs. Jarman moved that Council adopt the final reading of ordinance
regarding revision of Tax Abatement Guidelines and Criteria. Mr.
Greenwald seconded the motion which carried with the following votes:
AYES: Councilmembers Jarman, Potempa, Agee, Sr., Swinney and
Greenwald
NAYS: None
#6 APPOINTMENTS: Consider and take action appointing two
Commissioners for the Housing Authority of the City of Schertz.
Mr. Sweatt noted a letter is in Council's packet from the Executive
Director of the Housing Authority to Mayor Baldwin recognizing that two
members of Board have expressed their willingness to be re-appointed
and their terms of office would be for a two-year period of time. Mr. Earl
Sawyer would serve until December 31, 2000 and Mr. Lawrence Dixon
succeeding as Resident Representative.
Mayor Baldwin asked for a motion.

Mr. Greenwald moved to approve the appointment of two
Commissioners to the Housing Authority, being Earl Sawyer and
Lawrence Dixon. Mr. Potempa seconded the motion, which carried with
the following votes:
AYES: Councilmembers Jarman, Potempa, Agee, Sr., Swinney and
Greenwald
NAYS: None
#7 ITEMS BY COUNCIL
Mrs. Jarman:
· Mentioned that the lady who had won second place for the best
theme (in the decorating contest) is a neighbor of hers and urges
everyone to go by and take a look at the decorations.
· Wished everyone a happy holiday.
Mr. Potempa:

· Commented he enjoyed the Northeast Partnership Luncheon but is
concerned about the Chancellor for the college not making an effort

to locate in the Metrocom area. Mark and Steve gave a good
presentation and so did Live Oak Mayor, Paula Stakes.

· Extended a Merry Christmas to all from his family.
Mr. Aaee:
· Expressed his family's holiday wishes to all.
Mr. Swinney:
· Commented the traffic light at Woodland Oaks and FM 3009 is a
beautiful sight.
· Wished everyone a Merry Christmas and Happy New Year!
Mr. Greenwald:
· Inquired of Mr. Sweatt regarding a meeting of the Schertz/Seguin
Local Government Corporation.
Mr. Sweatt replied that tentatively the ih of January, 1999 is scheduled
probably in Seguin but a time has not been set.

· Mentioned there was an ad in the paper for Slim's Automotive in
Garden Ridge.
· Wished everyone a good, safe holiday.
#8 ITEMS BY MAYOR:
· Extended his and Barbara's best wishes for the holidays and
expressed his appreciation for all the support through Barbara's
health problems.
Mr. Sweatt asked Council's authority and permission to schedule a brief
action meeting on December 30th. We really need to conduct a public
hearing on an application to the Texas Department of Community
Development (TDCD) in the amount of $115,000. We made application
to FEMA (flood mitigation) for the Palms Apartments for the 1997 flood.
We have received that grant from FEMA (75% of the estimated cost)
and we have made aware the additional 25% might be available from
the TDCD if we get an application processed pretty quickly. The public
hearing is to authorize us to apply.
