SPECIAL WORKSHOP SESSION OF THE SCHERTZ CITY COUNCIL
JANUARY 13, 1999
The Schertz City Council convened in Special Workshop Session on
Wednesday, January 13, 1999 at 7:00 p.m. in the Municipal Complex Council
Chambers, 1400 Schertz Parkway, Schertz, Texas. The following members
were present: Mayor Hal Baldwin, presiding; Councilmembers Pia Jarman; Joe
Potempa; Norman W. Agee, Sr.; Timothy Swinney and Ken Greenwald. Staff
present were City Manager Kerry Sweatt and City Secretary Norma Althouse.
#1 HEARING OF RESIDENTS
There was standing room only in the Council Chambers and Mayor Baldwin
discovered that all those who had signed up were wanting to speak about the
flood, so he informed them Mr. Gignac was making a presentation regarding
flood matters and if it was okay, they could speak following that. Everyone
agreed.
#2 Presentation by William J. Gignac regarding flood abatement matters.

Mr. Gignac stated he was not here to usurp anyone's authority and he is not
politically inclined. He used poster boards and an easel containing support
documents, press releases, engineering data and photos as part of his
presentation. He referred to the Dietz Creek Study and the 1996 Corps of
Engineers Floodplain Study several times during his presentation. He also made
several suggestions as to what needs to be done to try and prevent this from
happening again.
First, the City needs to convene a meeting with the City Engineer and various
surrounding entities regarding solutions. Mr. Gignac said he walked the creek all
the way down from the MKT Railroad. He is also familiar with an organization
that would fit admirably into the clean-up needs of the Cibolo Creek. The only
cost to the City would be fuel and one meal per day. Has the City looked into the
development of an FM 78 overpass? He thinks the State Senators would help.
Second, they need to develop a watershed district. That woutd knock off two
years of the time that it would take TNRCC to clean the creek. Does the City
have an ordinance that requires developers to assure water runoff does not
impact existing properties? He referred to the new GVEC building and how
runoff from it has an impact on properties in the area. He also referred to what
he called the two round mounds of trash, namely the old Gutierrez landfill and the
Beck landfill. Mr. Gignac briefly explained levee erosion spots. He also stated
no one was warned about the flood even though the Fire Department has a built-
in warning system with their siren.

Third, they definitely do not need to build a third round mound of trash. As an .
aside, Mr. Gignac mentioned the City needs to ask Beck Concrete to run their
machinery in the daytime and give the residents in the area a break.
Mayor Baldwin thanked Mr. Gignac for his presentation. The Mayor admitted
there's lots of work to do in the City and they have discussed what needs to be
done. The bottom line is big money and it's hard to come up with millions of
dollars. Never in the recorded history of Schertz has 22 inches of rain fallen in
24 hours. The Mayor thanked Mr. Gignac again and told him he has some good
ideas.
Mr. Gignac commented he heard Bexar County has started to do property
buyouts. Some of that might make a beautiful watershed. Mayor Baldwin
remarked anything in the 100-year floodplain cannot be rebuilt unless it can be
brought up out of the floodplain. The City applied for a grant to buy the Palms
Apartments and correct that situation, but unfortunately, one building that has to
go is the Scout Hut. Mr. Gignac suggested not putting any more money into the
existing park.
A lady in the audience (name not given) asked why the Beck landfill was allowed
to be built. Mayor Baldwin answered it was supposedly approved by TNRCC.
David Black of 201 Pecan reported he is not in the flood zone, but received six .
feet of water in his house. He was startled and pleasantly surprised by the
response of the City. Mountains of debris were picked up for two months,
Inspector Truitt helped him get his electricity turned back on, and emergency
funds set up at two Schertz banks, from donations, were available to citizens
through applications to the City. He thanked the City for everything they did.
Mayor Baldwin observed that the City did yeoman work after the flood.
George Mower of 501 Brooks related it is incumbent upon him to report attending
a TIF meeting where Ed Ford, City Engineer, was asked why the Schertz
Parkway Project went up from 2.4 million dollars to 2.9 million dollars. Mr. Ford's
response was he hadn't figured on all those homes being in there and now the
TIF has to provide extra money.
Johnny Sanchez of 306 Second Street mentioned he lives behind Sonic and for
two years now he has had to leave his home because of flood waters. He
blames the Beck landfill. All summer long there are buzzards flying over the
dump. Why would they fly over if it weren't a garbage dump? Why does it
smell? Mayor Baldwin explained if there is garbage and there are dead animals
in the landfill, then Beck is in a lot of trouble.
Mrs. Sanchez of the same address listed above noted that when there was 20
inches of rain, the water never reached the bottom of the railroad trestle. Mayor
Baldwin commented on some of the rescues he had seen with his own eyes and .

George Mower requested the Mayor let the lady finish speaking. Mrs. Sanchez
concluded her remarks by maintaining that the Beck landfill is a major problem.
Janie Ulbrich of 309 Second Street indicated nothing has been done about
cleaning up and there's always lots of noise from Beck Concrete. Mayor
Baldwin suggested she call the Police Department about the noise.
Louise Thomas of 512 Marilyn who had signed up to speak wished to pass at this
time.
Marilyn and Marcus Montgomery of 605 Morningview who had also signed up to
speak were no longer present at the meeting.
Patricia Jahnke of 305 Second Street complained that she did not see any
emergency personnel in her neighborhood. She said the City needs to train non-
emergency personnel how to handle situations such as flooding. Because of all
the debris, they had water backing up into their house. Regarding the smell from
the Beck landfill, they get a lot of lip service, but never any help. Mayor Baldwin
related the City can call the State of Texas and they can also spot check.

Edward Gaines of 1313 Oak Street (speaking for Ruby Gaines who had signed
up) expressed concern about not being warned. He felt the Fire Department
should have sounded the siren. Also, trucks go non-stop to the landfill and are
not policed.
Roman Froboese of 4513 FM 3009 indicated his main concern is the drainage
issue. Where is the water supposed to go from Forest Ridge Subdivision? The
more that's built, the more drainage there will be from as far away as Boerne.
The culvert under the buzzard roost was plugged up and there is insufficient
drainage from Forest Ridge. He proposes no more housing additions until this
problem is corrected. He would like to meet with City officials to discuss this
situation. Mr. Sweatt gave Mr. Froboese his telephone number and asked him to
call and make an appointment. Mr. Sweatt said he would be glad to meet with
him.
Billy Wilson of 104 Church Street asked if the City knew that Beck was once a
waste dump for Randolph Air Force Base medical waste. It can be researched
through records. Also, he has to contend with at least a quarter of an inch of
dust every day from Beck. They are building up a berm and it's against the law.
Mr. Wilson then emphasized that the landfill is a pain in the posterior. As far as
the flood goes, he got water up to his steps this time.
Carolyn Del Toro of 619 Main Street asked how many years are left on the Beck
landfill permit and Mr. Sweatt replied he does not know.

Merle Boenig (address not given) reported that her great-grandfather had a
family cemetery on the knoll behind the Smoke Pit and it never flooded. This
time it was covered with debris. Also, Schertz has always been a flood problem
and some people, even if they are warned, will wait out the storm. She is with
the Red Cross and they operated a shelter for nine days. Mr. Sweatt and Mayor
Baldwin were very cooperative.
A lady in the audience (name not given) mentioned the floodplain is a moving
plan - no one really knows where it is.
Janie Ulbrich of 309 Second Street remarked FEMA sets the rules so the City
can follow guidelines and lower insurance rates. Her house was previously in the
500-year floodplain. Now it is in the 100-year floodplain. Mr. Sweatt informed
everyone they have the latest floodplain studies from 1996 at City Hall for anyone
who's interested.
Howard Hall of 233 Meadow Lane related that in 1972 they had no water, in 1982
and 1997 they had water above their shed, and in 1998 they had four and one-
half feet of water in their house.

A gentleman named Max (last name and address not given) stated he heard Mr.
Gignac's presentation. A lot of people had damage from the flood and they are
expecting City Council to do something about it. The biggest problem is apathy _
they all need to get involved.
Tony Mays (address not given) stated they can't fight it by themselves. They
need a concerted effort by Schertz and neighboring entities to help get the
problems corrected. They need a task force similar to the CCMA Board.

been some discussion by City and County officials about cloud seeding. Did they
seed? Mr. Sweatt replied they did not.
Merle Boenig (address not given) suggested that maybe the citizens need to get
the attention of Beck by filing a class action suit as suggested previously at this
meeting.
Lula Mae Schertz of 321 Main Street stressed that something needs to be done
immediately while the Legislature is in session or it will be another two years
before anything is accomplished.

George Mower of 501 Brooks remarked on three things. First, numerous trucks
traveling to the landfill need to be required to have a cover over their load.
Second, Beck Concrete is cleaning off their cement and their trucks at 5:00 a.m.
Third, the City needs to have a big bridge as an escape route in times of flooding.

all of south Texas and will eventually be the managerial dispatch headquarters
for this side of town.
Mr. Potempa mentioned he is almost positive the City has an ordinance
prohibiting trash/garbage pick-up before 7:00 a.m. and they have been picking it
up earlier than that. Mr. Sarem promised to correct the problem.
Mr. Potempa then noted he considers it unsafe to back a truck all the way up a
street and they are doing that in Mobile Villa. Mr. Sarem indicated he would
need more information on the location and also commented they are in the
process of acclimating drivers from the previous company to their way of doing
things.
Mr. Potempa then inquired who Mission is because he had seen them in his area
and also commented they drive like maniacs. Mr. Sarem answered Mission is
part of U.S.A. Waste and their trucks will be repainted and renamed. In regard to
the driving, Mr. Sarem stated he will say something to the drivers and then told
Mr. Potempa that any time he has a problem, to give him a call.
Mrs. Jarman referring to the recycling, said they usually put the papers on top,
but when it rains that's a problem. Could the truck for papers be sent first? Mr.
Sarem replied that's not cost effective, but they will be picking up everything at
once from now on.

Mr. Swinney inquired if it's correct that they won't take wet papers. Mr. Sarem
answered yes, but his suggestion was if it's raining, to keep the papers for the
next week.
Mayor Baldwin commented they need to know the rates if they are going to
consider approving an extension. Mr. Sarem indicated there are no current plans
to increase the rates, but they would like the option in case it's necessary. Mayor
Baldwin then added that if they went out for bids, they might get a lower rate. Mr.
Sarem noted that most normally, you get what you pay for.
Mr. Greenwald listed the gripes they get from Carolina Crossing: (a) they don't
have recycling bins; (b) some of them have no garbage pick-up; and, (3) those
that have pick-up say it is picked up late in the day. Mr. Sarem admitted that
during the Christmas and New Year holidays they had heavy amounts of trash
and had to work long hours, but this is two weeks later and he wasn't aware the
lateness was still happening.
Mr. Greenwald then remarked that on Gettysburg they leave cans in the yard and
trash in the street. Mr. Sarem stated that would be corrected.

The last thing Mr. Greenwald brought up was that he had just. gotten the letter
today about the recycling schedule. Mr. Sarem corrected his previous statement

and said the new recycling schedule will begin next week. Mr. Sweatt informed .
Council that Mr. Sarem had volunteered to withdraw the letter because of the
lateness of the mailing, but he advised him not to do that.
Mr. Sarem mentioned that perhaps they could do a quarterly mail out of the City's
Newsletter. They are in the process of renewing their permit. Mayor Baldwin
expressed his appreciation to Mr. Sarem for the nice offer.
Mr. Agee indicated he is in favor of accepting the name change, but he's not sure
about approving the extension of the Franchise Agreement. Mrs. Jarman felt
they should be voted on in two separate motions.
Mr. Sweatt asked for direction from Council because if the extension is approved,
the Charter requires 30 days between readings in the newspaper. Mayor
Baldwin suggested putting it on the agenda as two separate items. Council
agreed with the Mayor and was ready for it to be placed on next Tuesday night's
agenda.
#4 Discuss appointments to Library Board.
Mr. Sweatt advised that Juan Thorn, Barbara Ricks and Pattie Lovelady need to
have their terms renewed. Norma Head is the new person replacing John
Grosskopf who moved to Austin and her term needs to be approved. He then
added there is a new position open, vacated by Barbara Quates, who will be
traveling much of the year and unable to attend meetings. The Board is seeking
a new member to replace Ms. Quates. Also, the Board is asking for the
appointment of a liaison from Council. Mrs. Jarman volunteered to be the liaison.

Council indicated their readiness for this item to be placed on next Tuesday
night's agenda.
#5 Discuss tax abatement request from Victory Packaging.
Mr. Sweatt reminded Council they have a memo from him and copies of the
proposed tax abatement agreement in their packets. The Economic
Development Commission has unanimously recommended approval of a 90%
tax abatement for Victory Packaging over a period of ten years.
Mark Marquez noted Victory Packaging was put through the standard evaluation
process. They will be bringing 30 jobs to the City and an annual payroll of
$860,000. They easily fit the City's criteria for tax abatement and Victory
Packaging is a good company. Mr. Rick Bruns, General Manager for the San
Antonio region, is here tonight representing them.
Mr. Bruns introduced himself to Council and commented he is glad to be in the
City. He said their company will be competition for Alamo Packaging, but Alamo

is also a good company. Mr. Greenwald asked if thy are just a distributor and not
a manufacturer and Mr. Bruns answered that's correct. Mayor Baldwin told him
they appreciate having his business in the City.
Council agreed they were prepared for this item to be included on next Tuesday
night's agenda.
#6 Discuss first reading of Ordinance regarding traffic signals/traffic
lights.
Mr. Sweatt, pointing out this is for the most part a housekeeping activity,
explained they simply want to confirm, by ordinance, the City's authority to write
citations for violations of traffic signal regulations on all roads within the City of
Schertz city limits. This ordinance covers all existing traffic signals and will cover
any that may be placed in the City in the future.
Council was ready for this item to be placed on next Tuesday night's agenda.
#7 RESOLUTION: Consider and take action on Resolution authorizing
Depository Signatories for the City's Texas CDBG Disaster Recovery
Initiative Funds for purchase of the Palms Apartments.

Mayor Baldwin introduced a resolution and read the caption as follows:

A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS
AUTHORIZING THE DEPOSITORY SIGNATORIES FOR THE CITY'S TEXAS
COMMUNITY DEVELOPMENT PROGRAM BLOCK GRANT, DISASTER
RECOVERY INITIATIVE FUNDS FOR THE PURCHASE OF THE PALMS
APARTMENTS IN THE CITY OF SCHERTZ, TEXAS.
Mr. Sweatt reported they had been working on this project since 1997 and it does
require action tonight. It's just another step in the process and they can close by
January 21 st"
Mr. Potempa moved to approve . the Resolution authorizing Depository
Signatories for the City's Texas CDBG Disaster Recovery Initiative Funds for
purchase of the Palms Apartments. Mrs. Jarman seconded the motion, which
carried with the following votes:
AYES: Councilmembers Jarman, Potempa, Agee, Swinney and Greenwald.
NAYS: None.

#8 CITY MANAGER'S REPORT
.
· Announced there will be a public hearing by the City of Schertz and TXDoT
on January 28, 1999 to discuss improvements to Lower Seguin Road.
· Expressed the hope they will have bids by next week on the Animal Control
construction.
· Reported the Census Bureau has notified them that they are hiring five part-
time people to help in the area.
#9 ITEMS BY COUNCIL
Mrs. Jarman:
· Commented on Norman Slocum's letter, copies of which are in their packets,
about showing appreciation and recognizing individuals that show why
Schertz is the "Friendly City." Mayor Baldwin thought it was a good idea and
worth giving a try.
Mr. Greenwald:
· Stated the Schertz/Seguin Local Government Corporation meets on the first .
and third Thursdays of the month and will be meeting here in Schertz next
Thursday at 1 :30 p.m.
#10 ITEMS BY MAYOR
· Reported attending the initial meeting of the Schertz/Seguin Local
Government Corporation and was very pleased with the nominees from both
cities.
· Related he had a chance to see some pictures of street damage in the older
section of Schertz as a result of 18-wheelers and the flood. Mr. Sweatt
added that he forgot to mention they have budgeted money this year for
major street repair."
· Referred to meetings about the flood situation and suggested there be an
agenda item on the next workshop for purposes of brainstorming that subject.
Michael Spain stressed that if they want some legislation sponsored, the
sooner the better.
