ccreg 02-16-1999 . . . ,oill~~ REGULAR SESSION OF THE SCHERTZ CITY COUNCIL FEBRUARY 16, 1999 The Schertz City Council convened in Regular Session on Tuesday, February 16, 1999 at 7:00 p.m. in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Schertz Texas. The following members were present: Mayor Hal Baldwin, presiding; Councilmembers Pia Jarman; Joe Potempa; Timothy Swinney and Ken Greenwald. Absent: Councilmember Norman W. Agee, Sr. Staff present were City Manager Kerry Sweatt and City Secretary Norma Althouse. Mayor Baldwin asked everyone to rise and join him in the Pledge of Allegiance to the Flag. He then presented two Proclamations to representatives of the VFW Post in Schertz. The first was to recognize the 100th Anniversary of the Veterans of Foreign Wars of the United States. The second was to proclaim the week of February 14, 1999 as "Salute to Hospitalized Veterans Week" in the City of Schertz. #1 APPROVAL OF MINUTES: Regular Session Regular Session Regular Session Regular Session Special Workshop Session Regular Session 10-06-98 10-20-98 11-03-98 11-17 -98 11-25-98 12-01-98 Mrs. Jarman asked that in the minutes of the Regular Session of 11-03-98, fifth paragraph under ITEM #5, PUBLIC HEARING, the sentence: She then asked if the former Chief of Police had any problem with only one way in and out and Mr. Conrad indicated there had been no probtem- be- c-hanged to read: She then asked former Chief of Police Aaee if he had any problem with only one way in and out and Mr. Aaee indicated he had no problem with that. Mr. Greenwald moved to approve the minutes, as presented, for the Regular Session of 10-6-98, the Regular Session of 10-20-98, the Regular Session of 11-17-98, the Special Workshop Session of 11-25-98 and the Regular Session of 12-1-98 and to approve the minutes, as amended, for the Regular Session of 11-3-98. Mrs. Jarman seconded the motion, which carried with the following votes: AYES: Councilmembers Jarman, Potempa, Agee, Swinney and Greenwald. NAYS: None. -99- #2 HEARING OF RESIDENTS: Those citizens wishing to speak on agenda . items (other than public hearing items) or items not on the agenda, will be heard at this time. No one had signed up to speak. #3 Presentation by GVEC of Franchise Fee check. Marcus Pridgeon of GVEC presented a check to the City in the amount of $38,849.36, which represented Jhe Franchise Fee for October 1, 1998 through December 31, 1998. Mayor -Baldwin th~nked Me Pridgeon and then comment~d they have a beautiful new building going up in Schertz. When is it anticipated it will open? Mr. Pridgeon answered hopefully in April or May of this year. Mr. Swinney commented he enjoys reading the monthly articles in the GVEC Review on deregulation. He than asked Mr. Pridgeon for any comments. Mr. Pridgeon remarked Senate Bill 7 appears to be getting a favorable response, but they are starting to tag things onto it. He is not opposed to the programs, but he is opposed to the tagging. Mr. Swinney then questioned the difference between a cooperative and other utilities. Mr. Pridgeon pointed out that a one-size-all mentality does not fit cooperatives. Some consideration has to be given for rural areas. . #.4 ORDINANCE: Consider and take action on final reading of Ordinance revising Code of Ordinances regarding unsanitary, unsightly conditions on private premises. Mayor Baldwin introduced an ordinance and read the caption as follows: ,- ORDINANCE NQ. 9.9-H-5 BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS PROVIDING THAT THE CODE OF ORDINANCES OF THE CITY OF SCHERTZ, TEXAS, CHAPTER 10, MISCELLANEOUS OFFENSES AND PROVISIONS, ARTICLE ll, UNSANITARY. UNSIGHTLY, ETC. CONDITIONS ON PRIVATE PREMISES, BE AMENDED BY REVISING SECTION 10-19, NOTICE TO OWNER TO REMOVE OR REMEDY, AND SECTION 10-20, REMOVAL OR CORRECTION BY CITY; AND PROVIDING A REPEALING CLAUSE. Mrs. Jarman moved to approve the final reading of an Ordinance revising the Code of Ordinances regarding unsanitary, unsightly conditions on private premises. Mr. Greenwald seconded the motion, which carried with the following votes: . -100- . AYES: Councilmembers Jarman, Potempa, Agee, Swinney and Greenwald. NAYS: None. #5 AMENDMENT: Consider and take action on proposed amendment to Guadalupe County Underground Conservation District Legislation. Mr. Sweatt reminded Council they have copies of the proposed amendment in their packets. The last session of the legislature generated this Underground District. The amendment was briefly reviewed with Mr. Sweatt pointing out several things. First, it allows the District to establish fees and second, it consists of a seven-person board who will run for election. Mr. Sweatt then added they didn't feel it was correct to be in two districts, so some changes are appropriate. If Council approves the amendment, that approval will be pending on approval by the Local Government Corporation. Mr. Greenwald moved to approve the proposed amendment to the Guadalupe County Underwater Conservation District Legislation pending approval by the Schertz/Seguin Local Government Corporation. Mr. Swinney seconded the motion, which carried with the following votes: AYES: Councilmembers Jarman, Potempa, Agee, Swinney and Greenwald. . Mayor Baldwin introduced a Resolution and read the caption as follows: RESOLUTION NO. 99-R-5 BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS CALLING FOR COOPERATION AND A COMMITMENT TO ESTABLISH A TWO (2) YEAR COMMUNITY COLLEGE IN THE NORTHEAST AREA OF BEXAR COUNTY. Mr. Potempa moved to approve the Resolution supporting the goal of locating an Alamo Community College District campus in the northeast area. Mr. Swinney seconded the motion, which carried with the following votes: AYES: Councilmembers Jarman, Potempa, Agee, Swinney and Greenwald. NAYS: None. . -101- #7 CITY MANAGER'S REPORT Stated that in January a Waste Management representative had mentioned the possibility of distributing the Newsletter, but things haven't worked out yet. . #8 ITEMS BY COUNCIL Mrs. Jarman: · Extended congratulations and commendations to Gail Martin of the Animal Control Department on a nice letter written about him by a lady who went to obtain a license for her dog. She-hasafways found the workers at the Animal Control Facility to be extremely professional and polite. Mr. Greenwald: · Referred to the Legislative Update brochure and mentioned the Craddock Bill regarding property taxation. Mr. Sweatt said he has a feeling that's taxation on automobiles. #9 ITEMS.BY MAYOR · Indicated he had received a note from the City Secretary saying former employee, Debbi Klein, wanted to distribute a tetter to Council.
