REGULAR SESSION OF THE SCHERTZ CITY COUNCIL
MARCH 16, 1999
The Schertz City Council convened in Regular Session on Tuesday,
March 16, 1999 at 7:00 p.m. in the Municipal Complex Council
Chambers, 1400 Schertz Parkway, Schertz, Texas. Those present
were as follows: Mayor Hal Baldwin, presiding; Council members Pia
Jarman; Joe Potempa; Norman Agee, Sr.; and Ken Greenwald.
Members absent, Tim Swinney. Staff present were City Manager Kerry
Sweatt and Deputy City Secretary, Dolores Butler.
Mayor Baldwin asked everyone to rise and join him in the Pledge of
Allegiance to the Flag.
#1 APPROVAL OF MINUTES: Workshop Session 12-30-98
Mr. Greenwald moved to approve the minutes as presented for the
Workshop Session of 12-30-98. Mrs. Jarman seconded the motion,
which carried with the following votes:
AYES: Councilmembers Jarman, Potempa, Agee and Greenwald
NAYS: None

#2 HEARING OF RESIDENTS
No one had signed up to speak.
#3 TEMPORARY FUNDING: Consider and take action regarding
temporary funding to Schertz/Seguin Local Government Corporation.
Mrs. Jarman moved that Council approve temporary funding to
Schertz/Seguin Local Government Corporation. Mr. Potempa
seconded the motion, which carried with the following votes:
AYES: Councilmembers Jarman, Potempa, Agee and Greenwald
NAYS: None
#4 ORDINANCE: Consider and take action on final reading of
Ordinance rezoning two tracts of land, 4.68 acres and 6.14 acres, from
General Business (GB) to Neighborhood Services (NS).

Mayor Baldwin introduced an ordinance and read the caption as
follows:

AN ORDINANCE
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS
AMENDING THE UNIFIED DEVELOPMENT CODE (UDC)
ORDINANCE NO. 96-5-28 BY REZONING TWO TRACTS, 4.68
ACRES AND 6.14 ACRES, OUT OF GUADALUPE COUNTY AND
REFLECTING SUCH CHANGES ON CERTAIN ZONING MAPS IN
ACCORDANCE WITH THE SCHERTZ UDC ORDINANCE.
Mayor Baldwin asked for a motion.
Mr. Greenwald moved to amend the ordinance rezoning two tracts, 4.68
acres and 6.14 acres of land from General Business to Neighborhood
Services. Mrs. Jarman seconded the motion which carried with the
following votes:
AYES: Councilmembers Jarman, Potempa, Agee and Greenwald
NAYS: None
#5 ORDINANCE: Consider and take action on final reading of
Ordinance amending the Unified Development Code (UDC).

Mayor Baldwin introduced an ordinance and read the caption as
follows:
AN ORDINANCE
By THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS
PROVIDING THAT THE UNIFIED DEVELOPMENT CODE;
ORDINANCE NO. 96-5-28, CITY OF SCHERTZ, TEXAS BE
AMENDED BY REVISING ARTICLE XI, PLATTING, SECTION 33,
ACKNOWLEDGEMENTS AND CERTIFICATES REQUIRED;
DELETING ARTICLE VII, LANDSCAPING AND SCREENING,
SECTION 4, TREE REMOVAL, AND REPLACING SAME WITH A
REVISED ARTICLE VIII, LANDSCAPING AND SCREENING,
SECTION 4, TREE PRESERV A TION/REMOV AL; DELETING
ARTICLE XIII, FLOODPLAIN MANAGEMENT, AND REPLACING
SAME WITH A REVISED ARTICLE XIII, FLOODPLAIN
MANAGEMENT; AND PROVIDING A REPEALING CLAUSE.

Mrs. Jarman moved that Council adopt the final reading of ordinance
amending the Unified Development Code. Mr. Potempa seconded the
motion which carried with the following votes:
AYES: Councilmembers Jarman, Potempa, Agee and Greenwald
NAYS: None
#6 APPLICATION FORMS: Consider and take action approving
application forms for Special Exception to Zoning Ordinance and
Specific Use Permit.
Mr. Sweatt advised the city attorney has been busy with his pen again.
We've made some last minute grammar and punctuation changes to
the original application form.
Mr. Potempa moved to approve application forms for Special Exception
to Zoning Ordinance and Specific Use Permit. Mr. Greenwald
seconded the motion which carried with the following votes:
AYES: Councilmembers Jarman, Potempa, Agee and Greenwald

#7 RESOLUTION: Consider and take action regarding technology
issues related to the year 2000 problem.
Mayor Baldwin introduced a Resolution and read the caption as follows:
RESOLUTION NO. 99-R-2
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS
DIRECTING CITY STAFF TO TAKE THOSE ACTIONS NECESSARY
TO INSURE THAT CITY SERVICES ARE NOT DISRUPTED OR
ADVERSELY AFFECTED BY TECHNOLOGY ISSUES RELATED TO
THE YEAR 2000 PROBLEM.
Mayor Baldwin asked for a motion.
Mr. Potempa moved to direct city staff to take actions necessary
regarding technological issues related to the year 2000 problem. Mr.
Greenwald seconded the motion which carried with the following votes:
AYES: Councilmembers Jarman, Potempa, Agee and Greenwald

#8 CITY MANAGER'S REPORT
.
· Reminded Council of the BVY A opening parade on the 2yth from
8:00 to 10:00 a.m.
· Reported water billing cycles are changing. A sixth cycle has been
added because of growth, in order to more evenly divide the work
load.
· Informed Council that asbestos in the Palms Apartments and two
other buildings has delayed demolition and there will be additional
costs for asbestos removal ($15,000 to $20,000).
· Reminded Council the next meeting will be March 31st.
#9 ITEMS BY COUNCIL
Mrs. Jarman:
· Reported that Friday, Saturday and Sunday, Schertz police officers
were doing fingerprinting at Garden Ridge Pottery and she was
impressed the way Officer Anderson handled the children.

· Advised there is a aftermath flood conference scheduled in San
Marcos on April 30, 1999.
· Commented on the health report regarding rats in the roof at
Sycamore Creek apartments. No humans had been attacked.
· Stated she was afraid to eat at local restaurants after reading the
Health Department Reports.
· Mentioned she appreciated the E-mail from Crockett Camp.
Mr. Potempa:
· Inquired as to how the One Star (convenience store) could stay in
business without current licensing and health cards.
· Stated Mr. Leroy Muenchow (Oak Forest) seemed to be concerned
about four (4) trees on city property that are full of moss and he's
afraid it will attack his trees - wants the city to take care of the
problem.

#10 ITEMS BY MAYOR
. Reported he had received the same complaint from Mr. Muenchow
and asked Mr. Sweatt to have Public Works look into the location of
the trees as he believes they are in the TXDo T ROWand the city is
not responsible.
Mr. Sweatt advised the ordinance states anything within 50' is the
homeowner's responsibility.
#11 ADJOURNMENT: There being no further business to discuss,
Mayor Baldwin adjourned the meeting at 7:45 p.m.
