ccreg 06-01-1999 . REGULAR SESSION OF THE SCHERTZ CITY COUNCIL JUNE 1, 1999 The Schertz City Council convened in Regular Session on Tuesday. June 1, 1999 at 7:00 p.m. in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Schertz, Texas. Those present were as follows: Mayor Hal Baldwin. presiding; Councilmembers Pia Jarman; Joe Potempa; Glyn D. Williams and Ken Greenwald. Staff present were City Manager Kerry Sweatt and City Secretary Norma Althouse. Mayor Baldwin asked everyone to rise and join him in the Pledge of Allegiance to the Flag. Following the Pledge, Pastor Clark Sloneker of the Randolph Christian Church offered a prayer. #1 HEARING OF RESIDENTS: Those citizens wishing to speak on agenda items (other than public hearing items) or items not on the agenda, will be heard at this time. No one had signed up to speak. . #2 BID AWARD: Consider and take action awarding bid for asbestos removal and site demolition (Palms Apartments 100-1/2 FM 78 & Buildings 110 FM 78. 202 FM 78 and 104 FM 78.). Mr. Sweatt advised they had discussed this at the workshop last week. A number of qualified bids were received and after review, they are recommending the bid be awarded to Robles and Sons in the amount of $66,529. The bid includes asbestos removal and demolition of the buildings. Mrs. Jarman moved to award the bid for asbestos removal and site demolition to Robles and Sons in the amount of $66,529. Mr. Potempa seconded the motion, which carried with the following votes: AYES: Councilmembers Jarman, Potempa, Williams and Greenwald. NAYS: None. #3 AUDIT SERVICES AGREEMENT: Consider and take action authorizing audit services agreement for fiscal year ending September 30, 1999. Mr. Sweatt reminded Council a copy of the proposed agreement was included in their packets for the workshop last week. The firm of Thompson, Williams, Biediger, Kastor & Young has performed the audit for the past several years and he recommends, due to all the changes, they be retained for one more year. . -202- Mr. Greenwald moved to authorize the audit services agreement with the firm of Thompson, Williams, Biediger, Kastor & Young for the fiscal year ending September 30, 1999. Mr. Williams seconded the motion, which carried with the following votes: . AYES: Council members Jarman, Potempa, Williams and Greenwald. NAYS: None. #4 APPOINTMENT: Consider and take action regarding appointment to Schertz Economic Development Commission. Mr. Sweatt related that the Economic Development Commission met and is recommending that John Torres, Vice-President of the State Bank & Trust. be appointed to the Commission for a term of two years. Mrs. Jarman moved to appoint John Torres for a term of two years to the Schertz Economic Development Commission. Mr. Williams seconded the motion, which carried with the following votes: AYES: Councilmembers Jarman, Potempa, Williams and Greenwald. NAYS: None. #5 Consider and take action on the following: A. Appointment to fill vacancy (Place #3) on Council; and B. Swearing in of appointed Councilmember. . A. Mayor Baldwin stated he had been asked to approach Reginna Agee about the possibility of filling her deceased husband's term on the Council and he did approach her and she agreed to do it. Mr. Potempa moved to appoint Reginna Agee to fill the vacancy on the Council. Mrs. Jarman seconded the motion, which carried with the following votes: AYES: Councilmembers Jarman, Potempa, Williams and Greenwald. NAYS: None. B. Mayor Baldwin gave the Oath of Office to Reginna Agee and congratulated her on her appointment. . -203- . #6 CITY MANAGER'S REPORT · Welcomed Reginna Agee aboard. · Remarked that, fortunately, the Legislature is out of session. He has placed before Mayor Baldwin and Councilman Greenwald a letter asking Governor Bush to veto HB 2045. The City feels that bill would reduce income from capital recovery fees by approximately $300,000 per year. Also noted lots of other bills didn't pass that would have been bad for cities. Mr. Potempa asked about the annexation bill and was told by Mr. Sweatt it passed, but is not as bad as the original bill. Mr. Greenwald inquired about the homeowners association bill and was told it did not pass. · Announced the TML Legislative Revue Session will be held on June 28th. If anyone wishes to attend, please RSVP to him. #7 ITEMS BY COUNCIL Mrs. Jarman: · Welcomed Reginna Agee and said she is glad to no longer be a minority of . one. Mr. Potempa: · Welcomed Reginna Agee as a new Councilmember. Mr. Williams: · Stated he was out and about on Friday trying to learn some things about the City. Then asked if Waste Management is the only solid waste company with which the City has a franchise agreement and Mr. Sweatt replied yes. Commented he has observed containers from other waste management companies in several places where new construction is taking place. One location was on Tri-County Parkway in the industrial park where he saw a container from Texas Waste Systems. The other location was in Greenshire where he saw a container from Statewide Waste. Mr. Sweatt asked Mr. Williams to furnish him the addresses so he could check into the situation. Mr. Potempa questioned if developers who get building permits are informed they have to use Waste Management. Mr. Sweatt answered they should be told that and he doesn't know how the Inspectors missed these ones Mr. Williams mentioned. . -204- . Welcomed Reginna Agee aboard and pointed out he is now not the newest . member of the Council. Mr. Greenwald: . Referred the Councilmembers to the Legislative Update in their packets and said the brochure gives a brief synopsis of some of the Senate and House Bills. It is interesting reading. . Welcomed Reginna Agee as the newest member of Council. Mrs. AQee: . Thanked the Council for her appointment and stated she hopes to accomplish as much as her husband did during his tenure with the City and his time on City Council. #8 ITEMS BY MAYOR . Welcomed ReginnaAgee to the Council and commented he knows she will do a good job. #9 ADJOURNMENT .
