REGULAR MEETING OF THE CITY COUNCIL
SEPTEMBER 7, 1999
The Schertz City Council convened in regular session on Tuesday, September 7,
1999 at 7:30 p.m. following the Public Hearing on the Tax Rate in the Municipal
Complex Council Chambers, 1400 Schertz Parkway, Schertz, Texas. Those present
were as follows: Mayor Hal Baldwin, presiding; Councilmembers Pia Jarman, Joe
Potempa, Reginna Agee, Glyn D. Williams and Ken Greenwald. Staff present were
City Manager Kerry Sweatt and Deputy City Secretary Dolores Butler.
Mayor Baldwin announced this week we celebrate the 11th year of Kerry Sweatt's
tenure as city manager. He's done an outstanding job and we want to see him
continue until we decide it's time for him to retire.

APPROVAL OF MINUTES:
Special Workshop Session 6/30/99

Special Workshop Session 7/28/99
Mr. Greenwald moved to approve the minutes as written for the Special Workshop
Session of 6-30-99, the Regular Session of 7-06-99, and the Special Workshop
Session of 7-28-99. Mrs. Jarman seconded the motion, which carried with the
following votes:
. AYES: Councilmembers Jarman, Potempa, Agee, Williams and Greenwald
NAYS: None
#2 HEARING OF RESIDENTS: Those citizens wishing to speak on agenda
items (other than public hearing items) or items not on the agenda will be
heard at this time.
No one had signed up to speak.
#3 Consider and take action regarding architectural agreement.
Mr. Sweatt noted that Norris Fletcher is here representing burns f1etcher gill,
architectural firm involved with the three emergency services buildings. As a part of
our overall plans and action under the building program, there is also an element of
the remodeling of the police portion of this building when the police move into their
new facilities. We have done some preliminary work defining square footage and
possible layout and we would like to employee the firm of burns f1etcher gill to help us
finalize remodeling details and prepare plans and specifications for the remodeling
work. We have submitted a proposed professional services agreement with that firm
asking you consider authorizing us to enter into a contract for architectural service
work on the remodeling project.

Mr. Greenwald moved to approve the architectural agreement with burns fletcher and .
gill architects in the amount of $20,000 plus expenses. Mr. Potempa seconded the
motion, which carried with the following votes:
AYES: Councilmembers Jarman, Potempa, Agee, Williams and Greenwald

#4 Consider and take action on first reading of Ordinance establishing a
Municipal Court technology fund.
Mayor Baldwin introduced an Ordinance and read the caption as follows:
AN ORDINANCE
BY THE CITY OF SCHERTZ, TEXAS, ESTABLISHING A MUNICIPAL COURT
TECHNOLOGY FUND. PROVIDING FOR THE ASSESSMENT AND COLLECTION
OF A MUNICIPAL COURT TECHNOLOGY FEE; PROVIDING FOR
SEVERABILITY; PROVIDING FOR PUBLICATION AND EFFECTIVE DATE;
PROVIDING FOR EXPIRATION DATE.
Mr. Sweatt stated this is patterned after the authorizing legislation of this past
legislative session that allows the creation of a technology fund based on collection .
of fees as a part of the overall punishment for conviction of certain offenses. These
funds are dedicated specifically for the use of technology including computer
systems, networks, hardware, software, imaging systems - all of the related activity of
a data processing system or technology purposes for the services of municipal court.
These fees can be used for no other purpose and are to be held as a dedicated fund.
The proposed fee is $4.00 per offense.
Mrs. Agee moved to approve first reading of an Ordinance establishing a Municipal
Court technology fund. Mrs. Jarman seconded the motion, which carried with the
following votes:
AYES: Councilmembers Jarman, Potempa, Agee, Williams and Greenwald.
#5 Consider and take action on first reading of Ordinance regarding Pro-
Logis request for Tax Abatement.
Mayor Baldwin introduced an Ordinance and read the caption as follows:
AN ORDINANCE
BY THE CITY OF SCHERTZ, TEXAS, APPROVING A TAX ABATEMEDNT AND A
TAX ABATEMENT AGREEMENT; BY THE CITY COUNCIL, FOR AND WITH PRO-
LOGIS TRUST, A PROPERTY OWNER IN THE CITY OF SCHERTZ. .

Mr. Brown, representing Pro-Logis Trust is here tonight. Council is aware Pro-Logis
Trust is a real estate investment trust, by another name has been a major investor in
our community and we are pleased they continue to find this a profitable community
in which they are willing to continue to invest. They are proposing to build 160,000
square foot building in Tri-County Business Park, used primarily for warehouse and
distribution purposes. The Economic Development Commission has recommended
approval of a 10-year abatement at 80% on capital improvements alone. This is an
interesting situation in that the property sits astride the county line and will be fairly
equally divided between Guadalupe and Comal County.
Mayor Baldwin asked if both counties will be offered the opportunity to participate in
the abatement.
Mr. Potempa moved to approve first reading of Ordinance regarding Pro-Logis
request for Tax Abatement of 80% for 10 years. Mr. Greenwald seconded the
motion, which carried with the following votes:
AYES: Councilmembers Jarman, Potempa, Agee, Williams and Greenwald.
#6 Consider and take action on bids for asphalt overlay work.
Mr. Sweatt reminded members this is part of continuing street maintenance for this
fiscal year, bids have been solicited and Ford Engineering has recommended we
award the low bid from J.D. Ramming Company, Inc. of $30,850.00.
Mrs. Jarman moved to award J.D. Ramming Paving Company, Inc. the bid for
overlay work in the amount of .$30,850. Mr. Williams seconded the motion, which
carried with the following votes:
AYES: Councilmembers Jarman, Potempa, Agee, Williams and Greenwald.
#7 CITY MANAGER'S REPORT
· Following the discussion of the last workshop, we had a pump go out in our well
field and were able to find a pump but it is only getting installed now. We were
able to equalize the pressure and keep up with demand. Hopefully, this minor
emergency will be resolved.
· Mentioned we are soliciting proposals for the telephone systems for the new
emergency services buildings. We are looking into new equipment as opposed to
extending our current service and feel there is an advantage to going with a new
system. Those should be in between the 1 st and 15th of October.

ITEMS BY COUNCIL

Mrs. Jarman:
· Advised the Library Board will meet next Monday because last Monday was Labor
Day.
Mr. Potempa:
· Expressed concern about the number of (bandit) signs on FM 3009. It is starting
to look like San Pedro Avenue. Right now, in front of Deer Creek there are more
signs posted out there, and this is not the weekend.
Mayor Baldwin reminded Mr. Potempa that Deer Creek is in Cibolo. Mr. Sweatt
commented that they have met the criteria of the Planning & Zoning Commission and
those who have residential developments off the main thoroughfare are entitled to
place signs. Mr. Greenwald stated they are authorized 10 signs and one at each
entrance, so if he has two entrances, that is 12 signs. They aren't supposed to put
them up until about 3:00 p.m. on Friday and have them down on Monday by about
10:00 a.m.
Mrs. Aaee:
· Mentioned that a high school student had asked her why the City doesn't have .
student representatives to the City Council.
Following some discussion in favor, Mayor Baldwin suggested Mrs. Agee might
check at the school and see if someone can and will organize a youth committee.
Mr. Greenwald:
· Mentioned that San Antonio has fallen into the clean air non-attainment status.
They maintained attainment for many years so EPA dropped the requirements
now nobody will be able to comply. There is only one monitoring station that is in
northeast San Antonio where most of the traffic is, yet everyone in Guadalupe,
Comal and Wilson County is going to pay higher inspection fees, higher gasoline
prices and that isn't fair. If they are going to call it a statistical area, why aren't
there more sensors so they get an average. It is his opinion that we ought to
support the counties in whatever they are going to do.
Mayor Baldwin said he had read this also and felt we are a part of the problem. Our
residents live in Guadalupe County and enjoy the lower tax rate and many work in
San Antonio. Schertz doesn't contract with VIA to cut down on the automobile traffic
going into San Antonio.

#10 EXECUTIVE SESSION: Called under Chapter 551 Texas Government
Code, Sub-5ection 551.071, Consultation with Attorney regarding pending or
contemplated litigation.
An Executive Session was held from 7:45 p.m. until 8:35 p.m.
#11 Action, if any, on above Executive Session.
No action was required.
#12 ADJOURNMENT
There being no further business to discuss, Mayor Baldwin djourned the meeting at
8:39 p.m.
