ccswks 08-13-1997 SPECIAL WORKSHOP SESSION OF THE CITY COUNCIL AUGUST 13, 1997 The Schertz City Council convened in Special Workshop Session on Wednesday, August 13, 1997 at 7:00 p.m. in the Council Chambers of the Municipal Complex, 1400 Schertz Parkway, Schertz, Texas. (The meeting was convened in the Chambers instead of the Conference Room because of the number of visitors in the audience.) The following members were present: Mayor Hal Baldwin, presiding; Councilmembers Charles McDonald; Joe Potempa; Norman Agee, Sr.; Timothy Swinney and Ken Greenwald. Staff present were City Manager Kerry Sweatt and City Secretary Norma Althouse. Mayor Baldwin asked everyone to rise and join him in the Pledge of Allegiance to the Flag. '1 BEARING OF RES..."'......... Tim Condor of 1113 MOssy Lane thanked Council for the action taken on behalf of the homeowners in Woodland Oaks affected by drainage from Berry Creek. It appears someone is trying to correct the problem, but of course they won't know if it works until it rains. Are they going to see anything as far as plans for grading? Don McCrary, engineer for Berry Creek, commented he was prepared to address some of the findings tonight, but he has not finished his evaluation of Ashley Place. Mayor Mr. Ford, Baldwin asked if Council needs to do something tonight. SWeatt advised him that both Mr. MCCrary and Mr. Ed the City's Engineer, are here tonight. Mr. McCrary reported they had done some significant detail surveying and one of the things they found were some high spots which would not allow the water to drain properly. One high spot in particular was between Berry Patch and Smokey Creek. He is still looking at Ashley Place and suspects there are some high spots there also. Mr. McCrary also mentioned they had a good meeting about the problems and received help from lots of people. Mr. McDonald Woodland Oaks Hillview. expressed concern about too much water in the drainage ditch and too much water draining to Don Kossl, representing Berry Creek, asked if the moratorium on construction could be lifted. Mayor Baldwin asked Council if they had any problem with lifting the moratorium. Mr. Greenwald, noting they won't see rain for a while, indicated he had no problem lifting it. Don Martin of 1016 Jasper Hill Lane congratulated Don McCrary for acknowledging there was a problem, evaluating it and solving it. He said he would like the option of bringing it -379- up later if the problem reoccurs. Mayor Baldwin thanked the developers for their cooperation and Don MCCrary thanked the citizens and staff for all their input. The consensus of Council was to lift the moratorium on construction (all five members were in favor). #2 ELECTION RETURNS: A. Canvassinq of Sales Tax Election Returns B. Canvassinq of Bond Election Returns C. Resolution: Consider and take action on a Resolution Canvassing the returns and declaring the results of an election concerning the adoption of an additional sales and use tax as permitted by the provisions of section 4B, as amended, Texas Revised Civil Statutes Annotated Article 5190.6; and other matters in. connection therewith. D. Resolut!on: Consider and take action on a Resolution canvassing the returns and declaring the results of a Bond Election; and other matters in connection therewith. A. and B. At this time Council canvassed the results of the Sales Tax Election and the Bond Election. J.R. Perez, Guadalupe County Elections Administrator, was unable to be present, but had provided all the results for Council to review. Mr. Swinney stated he was pleased at the turnout of and thought the election was well publicized. Mr. McDonald seconded the motion, which carried with the following votes: AYES: Councilmembers McDonald, Potempa, Agee, Swinney and Greenwald. Mr. Potempa seconded the motion, which carried with the following votes: AYES: Councilmembers McDonald, Potempa, Agee, Swinney and Greenwald. NAYS: None. At this time Dickie Day and leadership as Committee. 'Ms. Mayor Baldwin presented a Proclamation to Ramon Cook acknowledging their hard work and members of the Capital Improvement Study Day and Mr. Cook thanked everyone. #3 Discuss Tax Distribution Group. Abatement regarding Interplastic Mr. Sweatt Development Interplastic related that on Commission met met all the July 19th the Schertz Economic to consider this request and guidelines and criteria. -181- Interplastic is a distributor of resins used in the plastics industry. These resins are used in the production of a wide variety of products from sinks to bowling balls. The company is currently in leased space in San Antonio. The Commission unanimously recommended approval of a 35.66% tax abatement on capital impr~.~_ents for a five-year period. Mark Marquez of the staff and Erv Nothnagel of Interplastic were both present to answer questions. Mr. Nothnagel passed out some brochures for Council to review. Mr. Swinney asked, if in regard to fire safety, they are required to have any special equipment. Mr. Nothnagel responded they do not process the resin so he doesn't know, but assumes they could handle a fire. Mr. Swinney then asked if their trucks are required to follow hazardous cargo roads and Mr. Nothnagel answered they do follow hazardous cargo roads, but they are able to use regular highways. Nashville is the only city where they have had to obtain a permit. Mayor Baldwin asked what part of Tri-County they will be located in and Mr. Nothnagel replied Corridor Parkway. Crockett Camp reported they are at the end of Phase I and have come back for a recommendation to go ahead with Phase II. The study has gone well up to now and the results are favorable. There was some concern about the mixing of waters, but it appears there is no problem with that. Mr. Camp went on to say they had cross sections showing elevations in both Gonzales and Wilson counties. You are looking at greater capital costs in Wilson County and they are asking Council to extend some of Phase I to allow them to study Wilson County. Mayor Baldwin asked if Wilson County is also the same aquifer and Mr. Camp replied it is under a different underground water authority. He thinks Wilson County is a little closer and the elevations are better. Mr. Schoefel, one quality of water deep the wells are of the consultants, indicated is excellent. There was discussion about ways to acquire ownership, about how to get the water up, and about where they would look in Wilson County. Mr. McDonald wanted to know if they are asking Council if they should spend another $5,000 to look at Wilson County. Mr. Sweatt replied it will be on next Tuesday night's agenda for formal action if Council is ready. Mr. McDonald then asked when Phase II will start and Mr. Camp replied now. Council was ready to have this item placed on next Tuesday night's agenda. #5 Discuss renewal of terms for BOA members. Mr. Sweatt noted the terms of Earl Hartzog, Ted Duigon and Joe Potempa (alternate) are up for renewal. The official letter from the BOA has not been received yet, but everyone has agreed to serve. When asked by Mayor Baldwin if they were ready for this item to be placed on next Tuesday night's agenda, Council agreed they were prepared. Having inadvertently skipped it, Mayor Baldwin then moved to ITEM #4. #4 Discuss UDC Ordinance those changes. public hearing regarding changes to the and first reading of ordinance authorizing -383- Mr. Sweatt explained that a lot of the changes are merely housekeeping items, but there are several points of interest. One of those is that all developers of new subdivisions will be required to submit a Traffic Impact Analysis. Another is that in gated communities, residential access systems shall be established in accordance with City of Schertz requirements as outlined in Ordinance 96-M-33 passed in November of 1996. Mr. Sweatt went on to sayan Article on Telecommunications AntennalTower siting has been added so Planning and Zoning can try and keep a tighter control on these towers. Mr. McDonald mentioned, again, he is adamantly opposed to using City streets for drainage ditches and thinks Planning and Zoning should look at tighter controls on drainage also. Mr. Sweatt reminded Council they have a copy of the budget in their packets. There is a slight difference between Comal County and Guadalupe County charges. He is not always sure what the City's part is in this process. Mr. Agee commented it's to make sure the City gets share of communications out of Bexar Metro 911. A. Announced the City's population category at the B. Mentioned, if it's Council's pleasure, he would like to include on next Tuesday night's agenda an ordinance establishing a three-way stop at Savannah Drive and Inglewood and a four-way stop at Davenport and Savannah Drive. They will continue to monitor the situation and see if other traffic control measures are needed. Council gave their consensus for this item to be on the agenda. #9 ITEMS BY COUNCIL: Mr. McDonald: Thanked Mr. Sweatt for going out with him to look over the drainage problems. Mr. Potempa: A. Reported there's still a smell over by Metro Ambulance and Mr. Greenwald agreed. Mr. Sweatt agreed to look into it. -384- B. Mentioned the Schertz Fire Department was on the news tonight about something to do with old trailers being pulled into the truck stop on 1-10. Mr. Sweatt acknowledged the City has no control over this other than the water - it's not in their ETJ, it's in Bexar County and it's a real mess. Mr. Aaee: Inquired if the parking situation at Corbett has been solved. Mr. Sweatt commented according to the ordinance parking is prohibited, but he thinks the ordinance is doing just the opposite of what it intended. They are currently working on an amendment to the ordinance. In the meantime, complaints continue to come in and some warning tickets have been issued. Mr. Swinney: A. Related he had enjoyed the Region 7 meeting. Seguin has offered to host the next one. B. Asked gun bil1. if anyone knew the status of Jerry Mr. Sweatt promised to check on it. Patterson's C. Passed out some information he had gotten in how to get City Council.business done. Included information were also some City Manager evaluation Waco on in the forms. D. Noted that with the failure of the town center proposition on the bond election, they need to be creative in giving the library more space. A juvenile reading room is still important. Mr. McDonald asked if they still have to move the old buildings and Mr. Sweatt replied yes - they may ask for help from the Historical Society. Mr. McDonald then wondered what it would cost to move the old shoe store near the library. Mr. Sweatt admitted they may suggest demolition of the old shoe store. Mr. Potempa asked the time frame for starting new construction on the emergency services facilities. Mr. Sweatt answered they are looking at land, evaluating it and should be bringing some information to Council. Mr. Potempa together and there are some asked if they're trying to keep them Mr. Sweatt replied they would like to, restrictions on availability of land. all but Mr. McDonald questioned if it would be wise to engage an individual to look into obtaining grants for the City and Mr. Sweatt replied. they don't have an individual to do that right now. Mr. Greenwald: A. Distributed an article from the Express-News regarding an ordinance in Sugar Land, Texas. -385- B. Stated Planning and Zoning received a plat last night from Taco Cabana. no ITEMS BY MAYOR: A. Related Mr. Dicker has synopsized the election and he will ask Mr. Sweatt to make copies for everyone. B. Announced Mr. Agee will be the Mayor next week as he will be in the hospital for a surgical procedure. Council took a short break before moving to the Conference Room for the Budget Workshop. #11 BUDGET WORKSHOP Although there was discussion about the tax rate, about sales tax, about salary increases and about offering increases for advanced certificates for the Police Department, the majority of the time at the Budget Workshop was spent talking about longevity pay. Mr. Sweatt, saying there is no money in the budget this coming fiscal year for an across the board salary increase for the employees, proposed increasing the longevity pay from $4.00 per month to $8.00 per month. He felt it was the least they could do. Mr. McDonald disagreed and there was a lot of discussion about it. He asked Mr. Sweatt to get some figures together on how much that would cost the City versus certain percentages of salary increases.
