ccreg 09-16-1997 SCHERTZ CITY COUNCIL REGULAR SESSION A~....,~A SEPTEMBER 16, 1997 The Schertz City Council convened in Regular Session on Tuesday, September 16, 1997 at 7:00 p.m. in the Municipal Complex Council Chambers, 1400 Schertz parkway, Schertz, Texas. The following members were present: Mayor Hal Baldwin presiding; Councilmembers Charles McDonald; Joe Potempa, Norman Agee, Sr.; Timothy Swinney; and Ken Greenwald. Staff present were City Manager Kerry Sweatt and City Secretary Norma Althouse. Mayor Baldwin asked everyone to rise and join him in the Pledge of Allegiance to the flag. Following the Pledge, Marcus Pridgeon of GVEC presented the City with a check for $2,302.37. This was the result of a deal whereby the economic development departments of each entity were involved and the City sold a lot to GVEC at a reduced price, they put a building on the lot and then sold the property. The check was the splitting of the profit from the sale. #1 APPROVAL OF MINUTES: Special Session 7-23-98 Regular Session 9-02-97 Mr. McDonald moved to approve the minutes for the Special Session of 7-23-97 and the Regular Session of 9-02-97. Mr. Greenwald seconded the motion, which carried with the following votes: AYES: Councilmembers MCDonald, Potempa, Agee, SWinney and Greenwald. NAYS: None. ABSTENTIONS: Councilmember Agee for Special Session 7-23-97. '2 BEARING OF RES.~'~~.S: Those citizens wishing to speak on agenda items (other than public hearing items) or items not on the agenda, will be heard at this time. A. Tommy MarShall, a student at Samuel Clemens High School, made a presentation asking Council to extend the curfew on October 24th for the Homecoming Dance. Council consented to extend the curfew. B. John Thompson of 2453 Grove Park spoke about the City park in woodland Oaks saying it is not kept up to par. There is lots of playground equipment and a gazebo, but the grass is high, there are dead trees and the trash is not removed on a regular basis. Council can either address this or table it to take a look at the situation. -413- Mayor Manager park. Mr. Sweatt advised this park was dedicated to the City by the developer and is maintained on the same regular basis as other City parks. They are not able to give it a higher level of service than the others. Perhaps some of the homeowners would like to enter into an agreement with the City to provide service to the park. Mr. Thompson asked if Mr. Sweatt meant the homeowners association or individuals and Mr. Sweatt replied both. Baldwin indicated they would like time for the City to check into the trash pick-up schedules for the Mr. Swinney told Mr. Thompson the homeowners association in Lone Oak provides service to the City park there and it has been a good experience. He gave Mr. Thompson Max Hernandez's name for getting some ideas. C. Marvin Rutkowski of 1133 Mossy Lane spoke about the drainage problems in Berry Creek and Ashley Place and asked if the City has done anything. The problem is getting worse and his ,suggestion is to shut down construction until the problem is corrected. Mr. Sweatt explained to Mr. Rutkowski what has recently taken place regarding this problem. Mr. McDonald commented Ashley Place is not fixed, but they think Berry Creek is fixed. They have pictures showing the problems. He agrees with Mr. Rutkowski that if the problem isn't solved in the next 10 days, then construction should be shut down. Mayor Baldwin commented they need to know where the water is coming from - buildout would help. They will keep an eye on the problem and if they have to shut down construction again, they will. .3 PUBLIC HEARIRG: To regarding FY 1997-98 budget. Mayor Baldwin explained the procedures to be followed for the public hearing. receive citizen comments Mr. Sweatt related that the budget had been filed with the City Secretary on August 1st in accordance with the requirements of the City Charter. Then Mr. Sweatt, along with L.J. Cott, the Comptroller, gave a presentation of the budget using various slides consisting of pie charts and bar charts. These charts showed, among other things, historical tax values, historical tax rates, fund incomes, fund expenditures and total City revenue. Karen Williams (address unknown) mentioned she had driven by City Hall the other day and noticed quite a few police cars. Mr. Sweatt related the City has 16 patrol officers, the vehicles are not driven on a twenty-four hour ,basis, and they don't have individuals take the patrol cars home.' He went on ,'- _1l11L to say there are two new patrol officer positions proposed for the coming budget year. Todd Evans of 2473 Grove Park commented he noticed that money left over from last year's budget was put in this year's budget and wondered if there is any way to get to it for a particular project. Mayor Baldwin answered that reserves are just that. The auditor has recommended they have a 2-3 month reserve and they are moving toward a 5 month reserve, although they are not quite there yet. Mr. Potempa pointed out that last year one of the City's wells went out and they were able to replace it without taking on a lot of financial burden. Mr. Swinney added it is prudent not to zero out. The City has an outstanding financial rating and that has helped them with the bonds. Dickie Day of 820 Brooks asked if there's anything in the future for parks and recreation since the bond issue didn't quite work out. Mr. Sweatt acknowledged they know there will be demands for leisure activities and hopes by mid-year they will have some recommendations to bring forward. Jim Elders of 2547 Grove Park asked for a clarification between the pulte Park in Woodland Oaks and the Ashley Place Park. Mr. Sweatt explained that according to the requirements of the UDC Ordinance, a developer is required to donate park land or give money to the City in lieu of land. Pulte chose to put in the playground equipment in their park, even though they did not have to, and the developer of Ashley place only donated land. There is only one bicycle lane in Schertz - he hasn't found any other. Is there some requirement to put in bicycle lanes and/or walking paths? They definitely enrich the community. Mr. lanes pass. Sweatt noted the bond issue contained money for bicycle and walking paths, but unfortunately, that part didn't ~ , There was some further discussion about bicycle lanes and walking paths such as not necessarily needing for them to be asphalt. Mr. Sweatt indicated the City is working with the Forest Ridge Subdivision to try and put in some type of hiking/biking trails. NAYS: None. -416- #6 BID AWARD: Consider and take action awarding bid for street sweeper and approving financing arrangement. Mr. Sweatt acknowledged this item had already been taken care of at the last meeting and it was an oversight that it got put on the agenda again this time. .7 ORDINANCE: Consider and take action on final reading of ordinance regarding parking regulations at Main street and Corbett Junior High School. Mayor Baldwin introduced an ordinance and read the caption and changes as follows: ORDINANCE NO. 97-D-25 BY THE CITY COUNCIL OF THE CITY OF SCHER'l'Z, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES BE AMENDED BY REVISING SECTION 18-91, PARKING PROHIBITED; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT. Parking will be prohibited on Main Street as follows: North side from Lindbergh Ave. to Curtiss Ave. North side 65' west from Curtiss Ave. North side 395' east from Oak St. South side from Lindbergh Ave. to Aviation Ave. South side from Aviation 300' west. South side beginning 300' west of the intersection of Aviation Ave. to Oak St. during school hours. Mr. McDonald moved ordinance regarding Corbett Junior High motion, which carried to approve the final reading of parking regulations at Main Street School. McDonald, Potempa, Agee, Swinney and NAYS: None. #8 BID AWARD: Consider and take action on award of bid for a 3/4 ton pick-up for Animal Control. Mr. Sweatt advised they had advertised for bids and didn't receive any, so they readvertised. This time they received one (1) bid from Seguin Motor, Inc. in the amount of $37,671.84. This vehicle will be funded from the Guadalupe County Animal Control contract and represents bids for both _11 17_ the City of Seguin and the City of Schertz. The City of seguin concurs with our recommendation that the bid be awarded to Seguin Motor, Inc. in the amount of $37,671.84. Mayor Baldwin asked if these are just the chassis and they will have to build in the boxes. Mr. SWeatt answered that's correct. Mr. Greenwald asked about the delivery time and Mr. Sweatt replied 90 days or less. Mr. McDonald moved to award the bid for a 3/4 ton pick-up for Animal Control to Seguin Motor, Inc, in the amount of $37,671.84. Mr. Greenwald seconded the motion, which carried with the following votes: AYES: Councilmembers McDonald, Potempa, Agee, Swinney and Greenwald. NAYS: None. #9 BID AWARD: Consider and take action on award of bid for Animal Control transport unit. Mr. .Sweatt reported that the City advertised for bids and two (2) were received. This will also be funded from the intergovernmental contract. Jones Trailer Co. Inc. submitted the lowest bid, but does not meet all specifications and is not as well qualified. After a careful review, it is recommended the bid be awarded to Deerskin Manufacturing Co. in the amount of $10,642.00. Mr. Greenwald moved to award the bid for an Animal Control transport unit to Deerskin Manufacturing Co. in the amount of $~0,642.00 contingent on approval by the City of Seguin. Mr. Swinney seconded the motion, which carried with the following votes: AYES: Councilmembers McDonald, Potempa, Agee, Swinney and Greenwald. NAYS: None. #10 CITY MANAGER'S REPORT: A. Pointed out that due to the way the calendar falls, the next Council meeting will not be until the workshop on October 1st. B. Reminded Council the tour of FM 3009 and Schertz Parkway to determine the need for sidewalks has been rescheduled for Saturday, September 27th at 8:00 a.m. Everyone will meet at City Hall. C. Noted that the last workshop in October conflicts with TML. What is Council's pleasure? The consensus of Council was to waive the workshop unless the need arises for a meeting. ~ -418- #11 ITEMS BY COUNCIL: Mr. Swinnev: be placed on a future agenda to discuss the library. Asked that an item giving more space to Mr. Aaee: Remarked how entirely different it is being on Council and reviewing the budget compared to being a staff member and having to prepare your department's budget.
