REGULAR SESSION OF THE CITY COUNCIL
FEBRUARY 6, 1996
The Schertz City Council convened in Regular Session on
Tuesday, February 6, 1996 at 7:00 p.m. in the Council
Chambers of the Municipal Complex, 1400 Schertz Parkway,
Schertz, Texas. The following members were present: Mayor
Hal Baldwin, presiding; Charles McDonald; Joe Potempa;
Earl Sawyer; Timothy Swinney and Ken Greenwald. Staff
present were City Manager Kerry Sweatt and City Secretary
Norma Althouse.
Mayor Baldwin asked everyone to rise and join him in the
Pledge of Allegiance to the flag.
#1 APPROVAL OF MINUTES: A. Special Session 1-10-96
B. Regular Session 1-16-96
Mr. Sawyer moved to approve the minutes, as written, for
the Special Session 1-10-96 and the Regular Session
1-16-96. Mr. Greenwald seconded the motion, which carried
with the following votes.
AYES: Councilmembers McDonald, Potempa, Sawyer, Swinney
and Greenwald.

#3 BID AWARD: Consider and take action awarding bid
for mowing equipment.
Mr. Sweatt advised bids had been opened at 10:00 a.m.
January 25, 1996 for a 50 horse power tractor with a 10
foot mower. Three bids were received. Ewald Tractor, Inc.
submitted a bid of $21,500, Hilbert Implements, Inc.
submitted a bid of $22,975 and Mission Equipment submitted
a bid of $23,110. After review, it is recommended the bid
be awarded to Ewald Tractor, Inc. in the amount of
$21,500.
Mr. Sawyer asked if this is a budgeted item and was
informed by Mr. Sweatt it is.
Mr. Greenwald moved to award the bid for mowing equipment
to Ewald Tractor, Inc. in the amount of $21,500. Mr.
sawyer seconded the motion, which carried with the
following votes:

and Greenwald.
NAYS: None.
#4 BID AWARD: Consider and take action awarding bid
for Animal Control transportation unit.
Mr. Sweatt related bids were also opened for this
transportation unit on January 25, 1996 at 10:00 a.m. Two
bids were submitted. Deerskin Manufacturing Co. submitted
a bid of $8,760 and Swab Wagon Co., Inc. submitted a bid
of $9,180. This item is also a budgeted item. After
review, it is recommended the bid be awarded to Deerskin
Manufacturing Co. in the amount of $8,760.
Mr. Potempa inquired if this is a box that you. put on the
Animal Control truck and Mr. Sweatt answered yes it is.
Mr. Swinney asked the estimated service life of the unit
and Mr. Sweatt noted the City has had the current unit for
ten years and it's still in good shape. It will go into
reserve and probably outlast the vehicle it's located on.
Mr. Greenwald wondered if the unit has a fan for
circulating the air and was informed it does.
Mr. McDonald moved to award the bid for an Animal Control
transportation unit to Deerskin Manufacturing Co. in the
amount of $8,760. Mr. Potempa seconded the motion, which
carried with the following votes:
AYES: Councilmembers McDonald, potempa, Sawyer, Swinney
and Greenwald.
NAYS: None.

Mayor Baldwin introduced an ordinance and read the caption
as follows:
ORDINANCE NO. 96-E-l
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS, CALLING AN ELECTION TO BE HELD ON MAY 4,
1996 FOR THE PURPOSE OF ELECTING A MAYOR AND TWO
(2) COUNCILMEMBERS FOR SAID CITY, AND DECLARING
AN EMERGENCY.
Mr. Swinney moved to approve the ordinance ordering an
election for May 4, 1996, and declaring an emergency. Mr.
Sawyer seconded the motion, which carried with the
following votes:

AYES: Councilmembers McDonald, Potempa, Sawyer, Swinney
and Greenwald.
NAYS: None.
#6 AGREEMENT: Consider and take action regarding BVYA
annual operating agreement.
Mr. Sweatt mentioned this agreement is similar to past
agreements with BVYA. The allowable kilowatt hour usage at
the field has been increased primarily to recognize the
ball schedule. This agreement reflects the cooperation and
discussion between BVYA and SCUC ISD. The agreement also
establishes the time due for their annual financial report
as being after their fiscal year ending in October.
Approval of the agreement is recommended.
Mr. Greenwald moved to approve the BVYA annual operating
agreement. Mr. Swinney seconded the motion.
Before the vote, Mayor Baldwin asked if this includes the
building use agreement and Mr. Sweatt replied the building
use agreement had inadvertently been left off the agenda
and with Council's permission, he would like to include it
as an action item on next week's workshop agenda. Council
gave their permission.
The vote was then taken with the following results:
AYES: Councilmembers McDonald, Potempa, Sawyer, Swinney
and Greenwald.
NAYS: None.
#7 ORDINANCE: Consider and take action on first
reading of an ordinance amending the Traffic Code, Section
18-32, Stop Intersections, Section 18-33, All-Way Stops,
and Section 18-35, Yield Intersections.
Mayor Baldwin introduced an ordinance and read the caption
as follows:
AN ORDINANCE
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS, PROVIDING THAT THE CODE OF ORDINANCES,
CITY OF SCHERTZ, TEXAS BE AMENDED BY REVISING
SECTION 18-32, STOP INTERSECTIONS, SECTION 18-33,
ALL-WAY STOPS, AND SECTION 18-35, YIELD
INTERSECTIONS.
Mr. Sweatt informed Council the purpose of this ordinance
is to authorize placement of traffic control signs mainly
in the new subdivisions within the City.

#8 CITY MANAGER'S REPORT: A. Invited all the
Councilmembers to the fire station tomorrow evening at 7:00
p.m. to sample the Fire Chief's wild hog barbeque cooking
in celebration of delivery of the new fire truck.
B. Reviewed, again, the fact the BVYA building use
agreement will be on next week's workshop agenda for action
if Council doesn't object.
C. Mentioned he had received notice about the celebration
of the Texas Sesquicentennial on February 19th in Austin.
TML is encouraging elected and appointed officials to
gather at the walkway entrance to the Capitol at the corner
of 11th and Congress Streets at 9:45 a.m. for the Future
of Texas parade. The last act of the Republic of Texas
will be commemorated. He will be happy to include copies
of the information in Council's next packet.
#9 ITEMS BY COUNCIL: Mr. Sawver: A. Told Mr. Sweatt
that on his Information Activity Report he has an error
there are two #302's and no #303.
B. Asked if Dove Meadows is across the creek from
Silvertree and if the City is putting in a walkway there
and a small park. The answer to all his questions was yes.
He then inquired if the City is doing anything with the
stand of trees on the other end of Dove Meadows and if
that's going to be part of the park. Mr. Sweatt replied
the City's xeriscape park is almost two acres that fronts
on Borgfeld Road and sides to the drainage ditch. The
stand of trees across the creek is private property. Mr.
Sawyer then asked who maintains the walkway and Mr. Sweatt
replied the walkway in the park is maintained by the City.
There is a jogging path, but it is the responsibility of
the Homeowners Association. Mr. Sweatt added that future
plans for the xeriscape park include a parking lot, a
gazebo and some planting beds.
C. Complimented the staff on it's quiCk action after Alice
Austin's death. He knows the City had to come up with the
pallbearers for her funeral.
Mr. Swinnev: A. Introduced his dauther, Lauren, who was
in the audience.
B. Invited Mayor Baldwin to his swearing-in ceremony at
the VFW next Monday at 7:30 p.m.

Mr. Greenwald: Also complimented the staff for their
quiCk response after the death of Alice Austin. It was
very sad to see her pass. It seems that when one life
ends, another starts. John Bierschwale and his wife had a
baby boy on January 31st.
