SPECIAL MEETING OF THE CITY COUNCIL
JUNE 12, 1996
The Schertz City Council convened in Special Workshop
Session on Wednesday, June 12, 1996 at 7:00 p.m. in the
Conference Room of the Municipal Complex, 1400 Schertz
Parkway, Schertz, Texas. The following members were
present: Mayor Hal Baldwin, presiding; Councilmembers
Charles McDonald; Joe Potempa; Earl Sawyer and Ken
Greenwald. Absent: Councilmember Timothy Swinney. Staff
present were City Manager Kerry Sweatt and Deputy City
Secretary Dolores Butler.
tl HEARING OF RESIDENTS
A. Charles Eddleman of 4822 Winthrop, San Antonio
commented he owns lots in the Live Oak Hills Subdivision
and needs some questions answered regarding the cost of
improvements. Mayor Baldwin informed Mr. Eddleman that
agenda Item t4 deals with that subject and suggested he
wait to ask his questions at that time. Mr. Eddleman was
agreeable to that.
B. Bill Neller of 305 Koch Street suggested the City look
into making a designated turn lane at East Aviation and FM
1518.
Mr. Neller also mentioned he isn't in charge of burning
old flags and indicated that would be a good project for
the Boy Scouts.
#2 ORDINANCE: Consider and take action on final
reading of ordinance rezoning approximately 14 acres (10.74
from GB to R-2) (3.25 from GB to NS) in the Live Oak Hills
Subdivision.
Mayor Baldwin introduced an ordinance and read the caption
as follows:
ORDINANCE NO. 96-5-18
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS, AMENDING THE ZONING ORDINANCE NO. 87-5-1
BY REZONING APPROXIMATELY 14 ACRES OF LAND OUT OF
GUADALUPE COUNTY AND REFLECTING SUCH CHANGES ON
CERTAIN ZONING MAPS IN ACCORDANCE WITH THE
SCHERTZ ZONING ORDINANCE.
Mr. Potempa moved to approve the final reading of an
ordinance rezoning approximately 14 acres (10.74 from GB to
R-2) (3.25 from GB to NS) in the Live Oak Hills
Subdivision. Mr. Greenwald seconded the motion which
carried with the following votes:

#3 Discuss final reading of ordinance regarding
traffic control measures in Dove Meadows Unit 14.
Mr. Sweatt stated this ordinance

#4 Discuss public hearing on special benefits to be
received from proposed improvements to streets and avenues
or portions thereof, and on matters with reference thereto
in the Live Oak Hills Subdivision.
Mr. Sweatt advised the intent of the developer of Live Oak
Hills Phase 1 seems to be the only workable plan in which
centralized improvement costs can be done and the
neighborhood brought up to development standards. The
estimated assessment cost for the streets and drainage is
approximately $91.63 per front foot. There will also be an
assessment for water/sewer costs. That will be
approximately $4500 per lot. The water/sewer fee is not
due by the lot owner until such time as they decide to
build on the lot and tap into the water system. The
developer will pay that up front and enter into an
agreement with the City for the City to collect the money
and return it to him at a subsequent date as connections
are made. The streets and drainage assessment fee can be
paid lump sum or in three installments. One-third is due
at the time the improvements are completed. An additional
one-third is due at the end of one year and the third
installment is due one year after that.
Mr. Eddleman referred to a letter he received from Ron
Wood extending an offer to purchase the lots of owners who
do not wish to pay the assessment fee. Who did the
engineering estimates? Mr. Sweatt replied the developer's
engineer calculated the estimates and they were approved by
the City's engineer.
Mr. Sweatt reminded Council the public hearing for
approval of the assessments is scheduled for next Tuesday,
June 18th at 7:00 p.m. Council agreed they were ready to
move forward to the public hearing on this matter.
#5 Discuss Stage IV of Water Conservation Program.
Mr. Sweatt confirmed the City of Schertz is in Stage III
as is the City of San Antonio. They are keeping an eye on
San Antonio to see what they do about moving into Stage IV.
With Council's approval, he will include an action item on
next week's agenda which has some changes to the stage IV

#6 Discuss Planning and zoning's recommendations
regarding annexation matters.
Mr. Sweatt reminded Council they have in their packets a
copy of a memo from Planning and Zoning regarding
annexation and a map outlining the areas they are
recommending be annexed. (Copies of the letter and the map
are included with these minutes.) Council instructed the
City Manager to ask the City Engineer to obtain the meets
and bounds for items Ib,lc, Id, Ie and 3b shown on the map
as areas proposed for annexation.
#7 CITY MANAGER'S REPORT: A. Distributed a ~emo about
the control of secured gated communities and reported an
agenda item regarding a 60-90 day moratorium on the
submission of applications for a gated communities will be
prepared for the meeting next week.
B. Declared he had submitted Tim swinney's name for
nomination to the Hall of Honor in the SCUC ISD.
#8 ITEMS BY COUNCIL: Mr. Greenwald: Commented Cliff
Johnson will be submitting a request for a zoning change
from RIA to M/H to develop a 30 acre tract of land into a
Mobile Home Subdivision in the Schirmerville area.
Mr. McDonald: Announced the Charter Review Committee will
hold it's first meeting June 17th and they will have a
public hearing in July. All meetings are open to the
public.
Mr. Sawyer: Reported seeing a sign on a light pole
advertising a Mariachi band.
~r. Potemoa: A. Wondered if statistics are available on
alcohol related accidents in the City.
B. Noted the weeds are high at the corner of the IH-35
access road and Plaza Drive.
C. Recommended a stop Sign versus the Yield Sign already
there be placed on the access road up by Mobile Villa.
Last Sunday he was coming off IH-35 trying to turn onto
Irola Drive and no one yielded.
#9 ITEMS BY MAYOR: Noted there was water standing
in the ditch between FM 3009 and IH-35. Was there a leak?
#10 EXECUTIVE SESSION: Called under Chapter 551 of
the Texas Government Code:
A. Sub-Section 551.071, Consultation with Attorney,
regarding pending or contemplated litigation;

#12 ADJOURNMENT: Mayor Baldwin ad ourned the meeting
at 9:35 p.m.
