11-14-2006-Workshop SessionMINUTES WORKSHOP SESSON November 14, 2006 The Schertz City Council convened in Regular Session on Tuesday, November 14, 2006 in the Municipal Complex Council Chambers at 7:00 p.m., 1400 Schertz Parkway Building #4, Schertz, Texas. The following members were present: Mayor Hal Baldwin presiding, Council Members Jim Fowler, David L. Scagliola, Reginna Agee, Tony Wilenchik and Mayor Pro Tern Michael Carpenter. Also present were City Manager Don Taylor, Assistant City Manager John Bierschwale, Assistant city Manager David Harris, City Secretary Judy Tokar and City Attorney Michael Spain. 41 CALL TO ORDER. Mayor Pro Tern Carpenter called the meeting to order at 7:00 p.m. #2 HEARING OF RESIDENTS Sharon Pennington, Chamber President reported on the following events: • Thanked Mayor Baldwin for attending ribbon cutting for Zone.lct • Ribbon Cutting for VIP Staffing on Thursday, Nov. 16th • Upcoming Chamber monthly membership luncheon on Friday Robert Brockman, 1001 Elbel Road: • Asked about library project status • Asked about status on interconncctivity at HEB Shopping Center • Lights on welcome sign at IH 35 are out again • Commended staff on Festival of Angels signs on Schertz Parkway, they looked nice Henry Gutierrez, Bexar Waste • Passed out resolution from Guadalupe County Commissioners Court being sent to San Antonio's Mayor Hardberger. Mr. Gutierrez said all waste haulers were not being charged the same fee for traveling on San Antonio streets. He asked for support from the City by preparing a resolution to the City of San Antonio. Mayor Pro Tern Carpenter moved up Item #6, the presenters had to go another meeting. 96 Discussion on Street and Drainage projects and presentation by Ford Engineering, McCrary & Associates and Patricia Ramirez, Professional Edge Engineering. Workshop Session II -14 -06 29 Larry Dublin, Ford Engineering, gave a brief history of the company, reviewed major projects and their qualifications. Mayor Baldwin arrived at 7:23 p.m. Don McCrary, McCrary & Associates gave a brief history of the company and introduced other principals with the firm. Pat Ramirez, Professional Edge Engineering, partnering with McCrary & Associates, Eddie McNew and Jim Bray briefed the Council on major projects and their qualifications, and outlined how they would manage our projects. Mr. Bierschwale commented all the engineering companies are very qualified and it would be a difficult decision to select just one. Staff decided to divide the drainage and street projects between the engineering firms. The staff recommends Don McCrary to partner with EDGE to be awarded street improvement projects 41 (Doerr Lane Reconstruction), #2 (Schertz Parkway Reconstruction), 44 (Dimrock Street Resurface), #5 (Woodland Oaks Drive Resurface) and #6 (Rural Roads FM 78 South & North IH 35 Rest Stop). Ford Engineering be awarded street project #3 (Wiederstein — Chelsea Intersection) and drainage projects #1 (Drainage Improvements in Village Unit I &11) , #2 (West Dietz Creek Upstream to City Limits), and 43 (Clyde Ford and Gettysburg Drainage Improvements. Action will be taken at the next regular meeting. #3 Discussion on reconstruction of the Miss Sweetheart Court. Presenter: Sharon Pennington. Ms. Pennington, coordinator of the court introduced Jennifer Bishop as assistant coordinator. Ms. Pennington said she has a vision to make this court something more and change the qualifications and the make up of the court to serve only the Schertz community. The new name of the court is "The Youth Ambassadors of Schertz Scholarship Program." The court applicants must be residents of Schertz. There will be an agreement between the City of Schertz and Schertz Chamber of Commerce for co- sponsorship detailing each entities' responsibility. City of Cibolo has organized their own youth program with sponsorship by corporation donations. #4 Update on the Festival of Angels event. Presenters: Jonette Ellis and Erin Matlock. Ms. Ellis presented a brief update on the activities for the Festival of Angels on Friday evening and the events in the park on Saturday. All the money raised will go toward the Blue Santa program. She asked Council to allow the Pony Express in the park since horses are prohibited in the park. Council gave consensus to allow horses in the park for the event. 45 Presentation by Earl & Associates on the Schertz (PID) Public Improvement District. Workshop Session 11 -14 -06 30 Mr. Bierschwale explained that Earl and Associates representing Crestmark Homes has contacted the city about a new residential development located on Lower Seguin Road and FM 1518 south. Since the development is in our Et1' a public improvement district is being created. Juan Gonzales, Earl & Associates presented the financing growth plan for the development. The public benefits in creating the PID are improved infrastructure along Lower Seguin Road and I'M 1518, additional water rights transferred to City at no cost, 1400 water and sewer connections for City, self - sustained Public Safety, EMS and Fire protection, new tax base for City when annexed and no additional costs to Schertz taxpayers. Crestmark Homes is planning 1,400 custom homes at the price of $200,000 and up, on % to 1 acre lots with parks within the communities, 15 acre park with Community Center and pool, security fencing, and planned elementary and junior high school sites. Mr. Gonzales said it is important to the developer that all construction complies with City codes. It was agreed that developer bring their own water which is from Edward Aquifer. The PID will finance and maintain the infrastructure. The approximate build out is 5 years. Mr. Gonzales has asked the City to support the project, requested a representative from the City for PID Board and have an agreement regarding annexation. Scott Webber, owner of Crestmark Homes was present to answer questions. The next step is for further negotiations between the developer and the City. Councilmember Wilenchik left the meeting at 8:50 p.m. #7 Discussion on first reading of an ordinance amending certain provisions of Chapter 50, Miscellaneous Offenses and Provisions, Article V, Alarms systems, False Alarms, formerly Chapter 10, Article V. Presenter: Beverly Todd. Asst. Chief Todd said the problem they are having is with commercial accounts on false alarms and the difficulty in being paid. She would like to increase residential and commercial alarm service fees. Action will be taken at the next regular meeting. Asst. ChiefTodd asked to move up Item 411. #11 Discussion on first reading of an ordinance amending Chapter 86, Article III, Traffic and Motor Vehicles, Traffic Control Devices, to add Sections 86 -94 through 86 -100, Photographic Traffic Enforcement System, Establishing a Photographic Traffic Enforcement System; establishing certain defenses and penalties; providing a nonjudicial administrative hearing process with appeal to the municipal court. Presenter: Beverly Todd Workshop Session 11 -14-06 31 Mr. Spain said the ordinance presented was to put the system in place, and contract with a company to implement, maintain and administer the system. A private company would be hired in a separate ordinance. The ordinance needs to be reviewed by Judge Padgett before the final reading since the violation is civil. Sgt. Bane said he just received information today that Texas House of Representatives filed a bill banning camera systems. #8 Discussion on first reading of an ordinance amending the Code of Ordinances by revising section 14 -213, inoculation & sterilization of adopted animals; Section 14- 218(b). Presenter: Beverly Todd. Asst. Chief Todd explained the ordinance was being amended to reflect the type of vaccine required by law and sterilization requirements. Action to be taken at the next meeting. #9 Discussion on first reading of an ordinance amending the Code of Ordinances by amending Chapter 50, Miscellaneous Offenses and Provisions, Article IV, Guns, BB Guns, Pellet Guns, Section, 50 -125, exception, formerly Chapter 10, Article IV, Section 10 -70. Presenter: Beverly Todd. Mr. Spain pointed out one of the major changes to the ordinance; all shooting prohibited between IH 35 and FM 78. Council's concern was if the areas in the ETJ and annexed areas after 1981 prohibited enforcement of the ordinance. Mr. Spain was directed to verify those parcels in the EJT so the ordinance was not a violation of state statute and the City could enforce and defend it. Action to be taken at the next meeting. #10 Discussion on first reading of an ordinance amending Section 86 -118, Maximum limits in school zones. Presenter: Beverly Todd. Asst. Chief Todd said the portion of Savannah Drive from Schertz Parkway was not originally designated as a school zone. Action to be taken at the next meeting. #12 Discussion on Transportation Safety Advisory Commission (TSAC) recommendations regarding traffic and speed equipment. Mr. Taylor said TSAC would like to purchase equipment to monitor the speed and a time counting unit. Councilmember Scagliola said when the speeder see the speed trailer they slow down immediately. The Commission would like to purchase equipment to be more effective in slowing down speeders in problem areas of the City. It is not feasible to have an officer at every location in the City. #13 Items by City Manager Taylor and Staff - Workshop Session 11 -14 -06 32 Attended a meeting with Mr. Harris and Councilmember Wilenchik regarding the Governor's Task Force relating to municipality's revenue cap. He is in constant contact with the owner of the library property; he is waiting finalization of the contract. #14 Items by Council Councilmember Fowler— No comment Councilmember Scagliola • Wanted to know the process for putting items before TSAC for review • Schertz Humane Society had the golf tournament; they did an awesome job organizing it • Wanted to know when the Strategic Plan was ready review • Is the current Thoroughfare Plan on City website? Councilmember Agee — • Put on next agenda, to consider resolution in support of Mr. Gutierrez • Out of town for next meeting Mayor Pro -tem Carpenter • Out of town for next meeting #15 Items by Mayor Ken Greenwald is doing better but recovery is slow.
