REGULAR MEETING OF THE CITY COUNCIL
MARCH 21, 1995
The Schertz City Council convened in Reqular Session on
Tuesday, March 21, 1995 at 7:00 p.m. in the Council
Chambers of the Municipal Complex, 1400 Schertz Parkway,
Schertz, Texas. The fOllowinq members were present: Mayor
Hal Baldwin, presidinq; Charles McDonald; Joe Potempa;
Mary Marsh and Ken Greenwald. Absent: Councilmember
Barbara Stanhope. Staff present were City Manaqer Kerry
Sweatt and City Secretary Norma Althouse.
Mayor Baldwin asked everyone to rise and join him in the
Pledqe of Alleqiance to the flaq.

Special Meetinq 1-25-95
Mrs. Marsh moved to approve the minutes of the Reqular
Meetinq of 1-17-95 and the Special Meetinq of 1-25-95. Mr.
McDonald seconded the motion, which carried with the
followinq votes:

'#2 HEARING OF RBSIDBNTS: Those citizens wishinq to
speak on aqenda items and those havinq matters they wish to
discuss with Council, which have not previously been
submitted to the City Manaqer, will be heard at this time.
A. George Mower of 501 Brooks reported that a couple of
weeks aqo a little boy on a bicycle was hit by a car at
the corner of Lindberqh and Brooks. Fortunately, he was
not hurt. He sees the children all the time ridinq their
bicycles without thouqht for requlations or their own
safety. He, the Mayor and the Principal of Schertz
Elementary talked about this very thinq and he was told the
school has a bicycle safety proqram. Mr. Mower submitted
the proqram is not effective and he hopes Council sees fit
to encouraqe the Police Department to cite these children
who are violatinq requlations - perhaps throuqh Teen Court.

Mayor Baldwin commented the Police Department should be
ever-vigilant for children riding bicycles when they see
them doinq danqerous thinqs and admitted Mr. Mower made a
good recommendation.
Mr. Potempa asked if this could be handled through Teen
Court and Mr. Sweatt replied yes it could if they chose to
say they were cited and if they chose to plead guilty.
There are some restrictions on how Teen Court operates.
B. Ray Wofford of 1200 Spicewood asked why the frontage
roads along IH-35, north of FM 3009, are not one way. It
would be a lot safer if they were one way. When you are
driving southbond on IH-35 after dark and exiting FM 3009,
you are staring at a bunch of headlights and it's hard to
see. Traffic going north on IH-35 gets backed up because
of people exiting and trying to turn 120 to 130 degrees
attemptinq to get into the parking lot at Bussey's Flea
Market. Since FM 2252 has an overpass and FM 3009 has an
overpass, it seems like the traffic between those two areas
could be one way and it would solve a lot of problems as
far as safety is concerned.
Mr. Potempa mentioned that it's his understanding once the
construction is finished, the frontage roads along IH-35 in
that area will be one way. Mr. Sweatt noted there will be
an additional overpass constructed at Wiederstein Road
which will reduce the distance between the circular routes
and after all the widening is completed, the frontage roads
will be one way.
Mr. Greenwald thought we had received a tentative schedule
from TXDoT and Mr. Sweatt aCknowledged we had, and then
said they will fund and go out for bids first on the
section from FM 2252 to Solms Road. Then within a short
time they will fund and go out for bids on the second phase
from FM 3009 to FM 2252. Both are expected to be under
construction during the next year.
Mayor Baldwin pointed out one of the most dangerous
traffic situations is people traveling southbound on IH-35
and exiting FM 3009 and makinq a U-turn back to Garden
Ridge Pottery. Mr. Sweatt commented that, initially, the
Highway Department had looked at relocating some
ingress/egress roadways in the interim, but apparently
funding and other sources didn't come through.
Mayor Baldwin wondered, if aside from upsetting Garden
Ridge Pottery and San Antonio Shoe, could we ask the
Hiqhway Department to make that area one-way before
construction is completed and would they respond. Mr.
Sweatt replied they might respond and he thinks it is of
some concern to the businesses there to be able to get
ingress/egress. If there were an overpass at the normal
one mile interval, it wouldn't be quite so difficult for
those businesses, but until the Wiederstein overpass is
completed, it is quite a distance.

Mr. Greenwald, referring to the FM 3009 exit for Garden
Ridge Pottery, stated that several years ago we had asked
the State to designate there be no U-turn at that exit, but
they refused.
#3 ORDINANCE: Consider and take action on the first
reading of an ordinance amending the City Code of
Ordinances regarding Swimming Pool Schedule of Fees and
Programs.
Mayor Baldwin introduced an ordinance and read the caption
as follows:
AN ORDINANCE
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS, PROVIDING THAT THE CODE OF ORDINANCES,
CITY OF SCHERTZ, TEXAS, BE AMENDED BY REVISING
CHAPTER 12 1/2, ATTACHMENT "B" OF SAID CODE,
PROVIDING FOR THE USE AND REGULATIONS OF SWIMMING
POOL FACILITY; REPEALING ALL ORDINANCES OR PARTS
OF ORDINANCES IN CONFLICT.
Mr. Potempa moved to approve the first reading of an
ordinance amending the City Code of Ordinances regarding
Swimming Pool Schedule of Fees and Programs. Mrs. Marsh
seconded the motion.
Before the vote, Mr. Sweatt pointed out this ordinance
makes three changes. One, it adds a pre-SChool/day care
section under season passes allowing one teacher or day
care attendant and five students per pass. Two, it reduces
the number of operating days for the pool, due to the
calendar, from 90 to 89. Three, it provides for a
Lifeguard Certification Course to be offered at a cost of
$80 for Schertz residents and $85 for non-residents.
The motion carried unanimously with the following votes:

#4 RESOLUTION: Consider and take action on a
resolution appointing two representatives to the Board of
Trustees of Canyon Regional Water Authority.
Mayor Baldwin introduced a Resolution and read it as
follows:

BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS, APPOINTING TWO REPRESENTATIVES TO THE
BOARD OF TRUSTEES OF CANYON REGIONAL WATER
AUTHORITY.

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS:
THAT Kenneth W. Greenwald and John E. Bierschwale are
appointed to serve as their representatives to the Board of
Trustees of Canyon Regional Water Authority.
BE IT FURTHER RESOLVED:
THAT the above named representatives are authorized
to represent, and act in behalf of, the best interest of
the City of Schertz in the process of the maintaining and
conducting of business of the Canyon Regional Water
Authority, and to cast its vote on all issues related to
the Canyon Regional Water Authority.
Mr. Potempa moved to approve the resolution appointing two
representatives to the Board of Trustees of Canyon Regional
Water Authority. Mr. McDonald seconded the motion, which
carried unanimously with the following votes:

#5 RESOLUTION: Consider and take action on a
resolution appointing a representative to serve on the

BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS, APPOINTING A REPRESENTATIVE TO SERVE ON
THE BOARD OF MANAGERS OF CANYON REGIONAL WATER
AUTHORITY.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS:
THAT Samuel D. Willoughby is
representative to serve on the Board
Canyon Regional Water Authority.

Mr. Greenwald moved to approve the resolution appointing a
representative to serve on the Board of Managers of Canyon
Regional Water Authority. Mr. Potempa seconded the

Mr. Greenwald noted that either he or John Bierschwale
could serve on the Board of Managers and the Board of
Trustees also, but after some discussion, they felt it wise
to have a third opinion and a third set of eyes.
#6 ORDINANCE: Consider and take action on the first
reading of an ordinance amending the Code of Ordinances by
providing for speed limits on Interstate 35 main lanes and
Interstate 35 frontage roads.
Mayor Baldwin introduced an ordinance and read the caption
as follows:
AN ORDINANCE
BY THE CITY COUNCIL OF THE CITY OF SCHBRTZ,
TEXAS, PROVIDING THAT THE CODE OF ORDINANCES,
CITY OF SCHERTZ, TEXAS, BE AMENDED BY REVISING
SECTION 18-76, OF SAID CODE; PROVIDING FOR SPEED
LIMITS ON INTERSTATE 35 MAIN LANES AND INTERSTATE
35 FRONTAGE ROADS.
Mayor Baldwin explained the ordinance is providing for a
maximum speed limit of 55 mph and a minimum speed limit of
45 mph on IH-35 from the north City limits to the south
City limits. It also provides for a 45 mph speed limit on
the IH-35 frontage roads from the north City limits to the
south City limits.
Mr. McDonald moved to approve the first reading of an
ordinance amending the Code of Ordinances by providing for
speed limits on Interstate 35 main lanes and Interstate 35
frontage roads. Mrs. Marsh seconded the motion, which
carried unanimously with the following votes:

Mr. Greenwald pointed out we do not make the decisions on
these speed limits, but we have to have the ordinance to
enforce them.

#7 CITY MANAGER'S REPORT: Informed Council that the
City is having a small retirement party for Tax
Assessor/Collector, Tom Dovey, who is retiring at the end
of April. The party will be April 10th in the Municipal
Complex Conference Room, starting at 5:15 p.m. Everyone is
invited to stop by and wish Mr. Dovey well in his
retirement.
#8 ITEMS BY COUNCIL: There were none.
Before adjournment, Mr. Sweatt mentioned one more item.
He had told the Council he would come back to them and let
them know if the SAFES contract with Randolph Air Force
Base was going beyond the six months. We are reviewing it
now and it appears it will go forward under the same terms
and conditions.
