ccswks 05-10-1995 .;211 SPECIAL MEETING OF THE CITY COUNCIL MAY 10, 1995 The Schertz city Council convened in Special Workshop Session on Wednesday, May 10, 1995 at 7:00 p.m. in the Conference Room of the Municipal Complex, 1400 Schertz Parkway, Schertz, Texas. The following members were present: Mayor Hal Baldwin, presidingj Councilmembers Charles McDonaldj Joe Potempaj Barbara Stanhope and Ken Greenwald. Absent: Councilmember Mary Marsh. Staff present were City Manager Kerry Sweatt and City Secretary Norma Althouse. #1 HEARING OF RESIDENTS: William Neller of 305 Koch St. expressed disappointment about the fact no flags were displayed along Main St. to commemorate the 50th anniversary of the end of World War 2. Mr. Neller mentioned he had heard the VFW is going to display the flags only four times each year and he doesn't know why. Mayor Baldwin pointed out to Mr. Neller it was the VFW who volunteered to take over the job of displaYing the flags when he decided to quit, so maybe he should make his feelings known to them. Mr. Potempa assured Mr. Neller the City always appreciated his work when he was in charge of displaying the flags. #2 CANVASSING OF ELECTION RETURNS A total of 774 votes were cast in the May 6, 1995 City General Election. Mayor Baldwin and the Council canvassed the election returns and declared the following results: (al Dereda Burkett was elected to Place 3 on the Council by defeating James Harris 413 votes to 340 votes: (blTimothy Swinney was elected to Place 4 on the Council by defeating Henry Godbout, Jr. 480 votes to 277 voteSj and, (c) Kenneth Greenwald was elected to Place 5 on the Council by defeating Jerry Graham 458 votes to 289 votes. #3 ORDINANCE: Consider and ordinance canvassing the returns and of the City General Election held May an emergency. take action on an declaring the results 6, 1995 and declaring Mayor Baldwin introduced an ordinance and read the caption as follows: ORDINANCE NO. 95-E-12 BY THE TEXAS, RESULTS CITY ON CITY COUNCIL OF THE CITY OF SCHERTZ, CANVASSING THE RETURNS AND DECLARING THE OF THE CITY GENERAL ELECTION HELD IN SAID MAY 6, 1995 AND DECLARING AN EMERGENCY. .:V ,j- Mr. Potempa moved to approve the ordinance canvassing the returns and declaring the results of the City General Election held May 6, 1995. Mrs. Stanhope seconded the motion, which carried with the following votes: AYES: Councilmembers McDonald, Greenwald. Potempa, Stanhope and NAYS: None. #4 Discuss public hearing for the rezoning of 14.57 acres (Cottage Lifestyles) on East Live Oak Rd. from R-4 (Apartment/Multi-FamilY Dwelling District) to R-2 (Single-Family Dwelling District). Mr. Sweatt advised this request was generated by the Planning and Zoning Commission as a result of Cottage Lifestyles, Inc. not being able to reach a financial agreement and build anything on the property within six months of the approval of the rezoning of the property to R-4. This will revert the property back to its original zoning of R-2. Planning and Zoning held their public hearing on May 9th and the Council's public hearing is scheduled for May 16th. Mr. Greenwald reported that Planning and Zoning had no input at their public hearing and also pointed out that there previously was a portion of the property on the front side of E. Live Oak Road that was NS (Neighborhood Services) before it was rezoned to R-4. Planning and Zoning recommends everything be rezoned as R-2. Mr. Sweatt pointed this area out on the map. After being asked by Mayor Baldwin, City Council concluded they were ready to have this item placed on next Tuesday night's agenda. #5 Discuss consideration of ordinance rezoning approximately (Single-Family Dwelling District) District). the final reading of an 37.886 acres from R-Z to MH (Mobile Home Mr. Sweatt related this 37.886 acres is adjacent to the current Windy Meadow Mobile Home Park and the intention of the developer is to extend the mobile home park. The property owners along Maske Road are asking that a privacy fence be erected along Maske Road between them and the mobile home park and the developer is aware of their request and has agreed to do so. Mr. Sweatt reminded Council they had approved the first reading of this ordinance. Mr. Greenwald added there are drainage details that need to be worked out, but they are part of the platting process. There were several questions about roads and Mr. Greenwald explained, that at the present time, the --- ;213 developer plans to extend Oak St. using the same entrance they have now. Council indicated to Mayor Baldwin they were ready to have this item placed on next Tuesday night's agenda. #6 Discuss Schertz Business Association's request for curfew exception, beverage restrictions and Jubilee aqreement. Anita Clark, Committee Chairman for the Jubilee, showed Council the flyers that will be distributed advertisinq the Jubilee activities. Mrs. Clark commented they are asking for three things. First, that the City Park curfew be extended from 11:00 p.m. until Midnight from June 30th through July 4th. Second, the designated areas for which alcoholic beverages may not be brought into or removed from Pickrell Park need to be approved for the 3rd and 4th of July. (A diagram had been provided and it covers the area basically from the drainage ditch to Oak Street in one direction and from the swimming pool to the road beside the large pavilion in the other direction.) Third, that the contract between the Schertz Business Association and the City be approved with changes to the dates in Sections II and III and changes to the amount the City agrees to pay toward the cost of the fireworks in Section XIII. The dates need to be changed to include the 1995 Jubilee dates versus those in 1994 and the fireworks cost figures need to be changed from $1500 to $1750. Mr. last also year. Schertz, however, is planning a larger fireworks display than it had last year. Council indicated it was ready for these items pertaining to the Jubilee to be placed on next Tuesday night's agenda. #7 CITY MANAGER'S REPORT: Reminded Council of the AACOG annual workshop scheduled for May 31st from 8:00 a.m. to 4:00 p.m. #8 ITEMS BY COUNCIL: Mr. Greenwald reported he and John Bierschwale had attended a meeting of the Canyon Regional Water Authority. Bexar Metro Water is pursuing grant money for a water line to run from Lake Dunlap to San Antonio. Judge Bundy has a meeting on June 19th at which time he could or could not sign an order regarding the Edwards Underground Water District. Mrs. Stanhope: A. Inquired about any progress on the house at 300 Pfeil. Mr. Sweatt advised that the - -, ~ .;,f c::< I ~ Inspection Department had sent a letter to the property owner. B. Thanked everyone and remarked that she had really enjoyed the years she served on City Council. #9 ITEMS BY MAYOR: A. Announced he will be delivering a proclamation to Autumn Winds in recognition of Nursing Home Week which is May 14th throuqh May 20th. B.
