AN ORDINANCE
BY THE CITY COUNCIL OF THE CITY OF
SCHERTZ, TEXAS, PROVIDING THAT CHAPTER
12 OF THE CODE OF ORDINANCES, CITY OF
SCHERTZ, TEXAS, BE AMENDED AUTHORIZING
THE MUNICIPAL COURT TO COLLECT CERTAIN
FEES PERTAINING TO CHILD SAFETY BY
ADDING SECTION 12-12, ADDITIONAL FEES
FOR CONVICTION OF CERTAIN OFFENSES
PERTAINING TO CHILD SAFETY; BY ADDING
SECTION 12-13, COLLECTION OF ADDITIONAL
FEES FOR CONVICTION OF CERTAIN OFFENSES
PERTAINING TO CHILD SAFETY; BY ADDING
SECTION 12-14, DEFINITION OF WHEN A
PERSON IS CONSIDERED TO BE CONVICTED;
AND, SECTION 12-15, DISPOSITION OF
ADDITIONAL FEES FOR CONVICTION OF
CERTAIN OFFENSES PERTAINING TO CHILD
SAFETY; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, certain provisions of State law authorize
the City of Schertz (the "City) to collect additional court
costs in certain cases and to utilize such funds for child
safety programs.
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF SCHERTZ, TEXAS;

THAT Section 12 of the Code of Ordinances of the City
of SChertz, Texas be amended by adding Section 12-12 to
read as follows:
"Section 12-12. Additional fees for certain offenses
pertaining to child safety.
THAT the Municipal Court of the City shall assess as
additional fees the following amounts for conviction of the
following offenses:
(1) Parking Violations in School Zone
(2) Speeding in School Zone
(3) Overtaking and Passing a School Bus
(4) Thwarting Compulsory School Attendance (adult)
(5) Thwarting Compulsory School Attendance (minor)

THAT Section 12 of the Code of Ordinances of the City
of Schertz, Texas be amended by adding Section 12-13 to
read as follows:
Section 12-13. Collection of additional fees for certain
offenses pertaining to child safety.
THAT, additional court costs assessed pursuant to
Section 12-12 of this Ordinance shall be collected in the
same manner that other fines in the case are collected.

THAT Section 12 of the Code of Ordinances of the City
of Schertz, Texas be amended by adding Section 12-14 to
read as follows:
Section 12-14. Definition of when a person is considered
to be convicted.
THAT, under this Ordinance, a person is considered to
have been convicted in a case if (1) a sentence is imposed,
(2) a defendant receives probation or deferred
adjudication, or (3) the court defers final disposition of
the case.
IV
THAT Section 12 of the Code of Ordinances of the City
of Schertz, Texas be amended by adding Section 12-15 to
read as follows:
Section 12-15. Disposition of additional fees for certain
offenses pertaining to child safety.
THAT the money collected pursuant to this Ordinance by
the Municipal Court must be used for a school crossing
guard program if the City operates such a program. If the
City does not operate a school crossing guard program, or
to the extent that the funds so collected exceed the amount
necessary to fund the school crossing guard program, the
City Manager may either deposit the additional money in an
interest-bearing account or expend it for programs designed
to enhance child safety.

THAT, should any portion or part of this Ordinance be
held for any reason invalid, unconstitutional, or
unenforceable, the same shall not be construed to affect

any other valid portion hereof, but all valid
hereof shall remain in full force and effect.

THAT this Ordinance shall be effective from and after
its final passage and any publication required by the City
Charter.
