AN ORDINANCE
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS, PROVIDING THAT CHAPTER 12 OF THE
CODE OF ORDINANCES, CITY OF SCHERTZ, TEXAS,
BE AMENDED BY ADDING SECTION 12-8,
FORMATION OF MUNICIPAL COURT BUILDING
SECURITY FUND AND COLLECTION OF SECURITY
FEE, SECTION 12-9, DISPOSITION OF MUNICIPAL
COURT BUILDING SECURITY FUND, SECTION
12-10, ADMINISTRATION OF MUNICIPAL COURT
BUILDING SECURITY FUND, AND SECTION 12-11,
DEFINITION OF CONVICTED PERSON; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City
determined the need for the creation of a

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF SCHERTZ, TEXAS:
I
THAT Section 12 of the
of Schertz, Texas be amended
as follows:
Code of Ordinances of the City
by adding Section 12-8 to read
"Section 12-8. Formation of Municipal Court Building
Security Fund and Collection of Security Fee.
THAT, in accordance with Article 102.017, Code of Criminal
Procedure, as amended, the governing body of the City of
Schertz, authorizes the formation of a Municipal Court
Building Security Fund and requires a defendant convicted in a
trial for a misdemeanor offense in the Municipal Court to pay
a $3.00 security fee as a cost of the Court. The fee shall be
collected by the Clerk of the Court and remitted to the City
Finance Officer for deposit in the Municipal Court Building
Security Fund."

THAT Section 12 of the

"Section 12-9. Disposition of
Security Fund.
Municipal Court
Building
THAT, the money in the fund may be used as follows for the
purpose of providing security services for the building
housing the Municipal Court: (1) the purchase, lease with
option to purchase, maintenance, and/or repair of (i) x-ray
machines and conveying systems, (ii) hand-held metal
detectors, (iii) walk-through metal detectors, (iv)
identification cards and systems, (v) electronic locking and
surveillance equipment, (vi) confiscated weapon inventory and
tracking systems, and (vii) locks, chains, or other security
hardware; and (2) salaries or other costs relating to
bailiffs, deputy sheriffs, deputy constables, or contract
security personnel during times when they are providing
appropriate security services."

THAT Section 12 of the

THAT, this fund shall be administered by the City
Manager, under the direction of the Schertz City Council."

Section 12-11. Definition of convicted person.
THAT, under this Ordinance, a person is considered
"convicted" if a sentence is imposed on the person; the
person receives community supervision, including deferred
adjudication; or the court defers final disposition of the
person's case."
V
THAT, should any portion or part of this Ordinance be held
for any reason invalid, unconstitutional, or unenforceable,
the same shall not be construed to affect any other valid
portion hereof, but all valid portions hereof shall remain in
full force and effect.
VI
THAT this Ordinance shall be effective from and after its
final passage and any publication required by the City
Charter.
