REGULAR MEETING OF THE CITY COUNCIL
NOVEMBER 16, 1993
The Schertz City Council convened in Reqular Session
Tuesday, November 16, 1993 at 7:00 p.m. in the Council
Chambers of the Municipal Complex, 1400 Schertz Parkway,
Schertz, Texas. The followinq members were present: Mayor
Earl W. Sawyer, presidinq; Hal Baldwin; Barbara Stanhope;
Mary Marsh and Ken Greenwald. Absent: Joe Potempa. Staff
present were City Manaqer Kerry Sweatt and City Secretary
June Krause.
Mayor Sawyer welcomed everyone to the meetinq and asked them
to rise and join him in the Pledqe of Alleqiance.
The Mayor then read and presented a proclamation to
Commander Dave Mazoch, VFW members and VFW Auxiliary members
from Post 8315, proclaiminq the week of November 7-13 as
"Voice of Democracy Week".

Mrs. Stanhope moved to approve the minutes of the Reqular
Meetinqs of October 5th and 19th and the Special Meetinqs of
october 13th and 27th. Mr. Greenwald seconded the motion,
which carried with the followinq vote:

#2 HEARING OF RESIDENTS: None
#3 ORDINANCE: Mayor Sawyer introduced an ordinance
and read the caption as follows:
ORDINANCE NO. 93-F-20
AN ORDINANCE BY THE CITY COUNCIL OF THE
CITY OF SCHERTZ, TEXAS, PROVIDING THAT
THE CODE OF ORDINANCES CITY OF SCHERTZ,
TEXAS, BE AMENDED BY REVISING CHAPTER 19
WATER, SEWERS AND SEWAGE DISPOSAL;
PROVIDING AN EFFECTIVE DATE; AND
REPEALING ALL ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT.
Mr. Sweatt referred to questions asked at the last meetinq
concerninq the justification of the minimum qallonaqe. He
said the rationale on the estimated rate cateqories, the
3,000 qallon blocks and the primary 3,000 minimum was to
reduce the impact on the minimum users, which is 56% of our
residential customers. Throuqhout the State of Texas 100
qallons per capita usaqe is the desiqn criteria for water
systems and we have used this fiqure since 1973. We have

used this 3,000 gallon m~n~mum in all of our bond issues.
We surveyed ten other purveyors of water in the immediate
area five of those used the 3,000 gallons as the base
criteria. Another is on a cubic foot arranqement and their
breakdown is based on about 3,740 gallons. When visitinq
with one of highest used rate analysts in the State of Texas
for rate studies, he said probably the averaqe of the base
rate is 2,000 range. He pointed out that there are a
significant number of systems that have no minimum gallons
included in the base rate. We think it very important to
serve that minimum user that uses between the 1,000 and
3,000 gallon. Generally the readiness to serve charoe - the
base charge - is desiqned to meet the debt service. The
most recent addition of the 1992 Certificates of Obliqation
necessitated the fifty cent increase in the base rate.
Mrs. Marsh moved to approve the final consideration of an
ordinance amendinq the Code by revising Chapter 19 - Water,
Sewers and Sewage Disposal. Mrs. Stanhope seconded the
motion, which carried with the followinq vote:

Mr. Jerry Graham said he would like to commend city staff
on the analysis. They did an excellent job.
#4 AGREEMENT: Consider and take action on an
agreement between the City of Schertz and the Schertz Humane
Society.
Mr. Sweatt commented that we have reduced previous
misunderstandinqs and verbal aqreements and introduced some
new areas in this aqreement between the City of Schertz and
the Schertz Humane Society. We have outlined each of our
responsibilities and authority. There is a document that
consists of nineteen points. Three of them are primary
points. One is that the Society is to work with the City to
develop a spay and neuter program - this is the sinqle
highest point of this agreement. The Society has revised
its attitude in the manner in which animals are adopted.
All fees paid for adoption and cost necessary to recover
those fees will inure to the City of Schertz. The Society
plans to be in the fund raising program and new programs and
new support activities. The Society will remove animals
from the complex under certain conditions for placement in
foster homes and all adoption fees will be paid to the city
at that point. As Mrs. Keller pointed out at the last
meeting, this has been submitted to their board and we
understand it has full board support.

#5 ORDINANCE: Mayor Sawyer introduced an ordinance
and read the caption as follows:
AN ORDINANCE
BY THE CITY COUNCIL OF THE CITY OF
SCHERTZ, TEXAS AMENDING SECTION 12 1/2-3
OF THE CODE OF ORDINANCES OF THE CITY OF
SCHERTZ TO PROHIBIT THE BRINGING OF
ALCOHOLIC BEVERAGES INTO OR REMOVAL
THEREOF FROM DESIGNATED PARKS AND
RECREATION AREAS DURING PARTICULAR
EVENTS; TO ESTABLISH THAT, ON SUCH
OCCASIONS, ALCOHOLIC BEVERAGES CAN BE
PURCHASED ONLY FROM THOSE VENDORS GRANTED
PERMISSION BY THE CITY COUNCIL TO MAKE
SUCH SALES; AND TO SET AN EFFECTIVE
DATE.
Mrs. Marsh moved to approve the first reading of an
ordinance regulating alcohol beverage sales in the city park
or recreational area during particular events. Mr.
Greenwald seconded the motion, which carried as follows:

#6 CITY MANAGER'S REPORT: A. We are experiencing
some load and traffic problems on Ware-SegUin Road, the same
as we have had with Lower Seguin Road. We are attempting to
deal with that issue.
B. Called attention this is the last meeting in November.
Our next meetinq will be December 1st for a workshop.
#7 ITEMS BY COUNCIL: Mrs. Stanhone reminded everyone
of the Senior Citizen Craft Show on November 20th, with the
Judginq to be at 9:00 a.m. and requested the judoes be
there by 8:30 that morninq.
Mrs. Marsh: A. Reminded everyone of the Christmas Tree
Liqhtinq on December 2 at 6:30 p.m. It will be the same as
last year with the activities outside, weather permitting.
B. The Business Association is still looking for items for
their silent auction, which will take place at the Trail
Riders dinner/dance at the Randolph Country Roundup.

C. Also reminder of the VFW breakfast on Saturday at the
VFW.
#8 ITEMS BY MAYOR: A. Council was suppose to discuss
the Mayor Pro Tem at this meeting but Mr. Potempa could not
be present so he will be sworn in at the next meeting.
B. BVYA has opening ceremonies on the 20th of November at
9:00 a.m. everyone on the Council is invited.
#9 ADJOURNMENT: Mrs. Marsh moved the meeting be
adjourned at 7:19 p.m. Mr. Baldwin seconded the motion,
which carried with a unanimous vote.
