SPECIAL MEETING OF THE CITY COUNCIL
DECEMBER 1, 1993
The Schertz City Council convened in Special Workshop
Session Wednesday, December 1, 1993 at 7:00 p.m. in the
Conference Room of the Municipal Complex, 1400 Schertz
Parkway, Schertz, Texas. The following members were
present: Mayor Earl W. Sawyer, presiding; Joe Potempa;
Hal Baldwin; Barbara Stanhope and Ken Greenwald. Absent:
Mary Marsh. Staff present were City Manager Kerry Sweatt
and City Secretary June Krause.
Mayor Sawyer welcomed everyone to the meeting and announced
that he would like to have the Executive Session right after
item #2 so that the attorneys could leave early.
#1 HEARING OF RESIDENTS: Mr. C.W. Reese reserved
time for item #3.
Anita Clark reminded everyone of the Annual Tree Lighting
Ceremonies the followinq night, starting at 6:30 p.m. She
also advised they would be having a social at the Kountry
Kitchen immediately following the Tree Lighting and invited
everyone to attend.
#2 Swearing in of the new Mayor Pro Tem.
Mrs. Krause swore Mr. Potempa in as Mayor Pro Tern for the
period through April, 1994.
#10 EXECUTIVE SESSION: Mayor Sawyer called an
executive session at 7:07 p.m. under Section 551.041 of the
Texas Government Code, Section 551.071 on contemplated or
pending litigation and Section 551.074 on Personnel.
The Special Session was reconvened at 8:02 p.m.
#11 Consider and take action, if any, on the above
executive session.
Mayor Sawyer related that the Council had met in executive
session and received advice from the attorneys but no
further action was necessary.
#3 Discuss final consideration of an
regulating alcoholic beverages in city parks or
areas during particular events.

Business Association and the VFW, giving the

police some control over alcoholic beverages at special
events. This way they will have some control by refusinq to
sell to anyone who has had too much to drink. This is a
family celebration and some of the money Qenerated by the
selling of alcoholic beverages goes back into the community.
Mayor Sawyer expressed his appreciation of citizens who are
trying to control alcoholic beverages and over consumption.
He added that the Council felt it right to try to control
what was going on in the parks.
Mr. Sweatt went over some of the details of the proposed
compliance. Since our park is an open area, we propose to
sink a series of sleeves to signs in around the park between
the restroon area, the swimming pool area and back to Oak
Street. We will insert post and a chain during these
special events and have signs advising it is against the
ordinance to bring alcoholic beveraQes in or take them out.
At first the police will not make an arrest but will ask the
people to comply.
Anita Clark reminded to keep in mind where they intend for
the carnival to be this year, which will be from Oak Street
to the back side of the swimming pool to the drainage ditch.
Mr. Sweatt said he did not have any problems with taking in
the carnival area. He said the only reason we added the
part about taking the beverages out is at the suggestion of
the Texas Alcoholic Beverage Commission.
Council then discussed the various places the signs and
chain could be placed.
Mr. Sweatt said this ordinance does not set the time or
date but does state the intent. Sometime before the
Jubilee, we will come back with the resolution setting the
date, event and time. At that time the area can be set
also.
Mr. Potempa referred to the article in the December
Newsletter by Mrs. Marsh, saying it is a clear intent of
what Council is trying to do.
Ascertaining that the Council would be ready to act on this
at the next meeting, Mayor Sawyer asked that it be on the
agenda.
#4 Discuss first reading of an ordinance amending the
Subdivision Ordinance, Article II Procedures.

a load limit of 15,000 pounds for Ware-Sequin Road.
Mr. Sweatt advised that we have not had problems with this
road until recently when construction on Randolph Air Force
Base beqan. He showed pictures of the road and the
destruction the huqe trucks have already caused. He said he
had talked with the company involved and they have agreed to
do some repairs. We believe the company will generally do
what is needed; but to preclude additional problems, we
feel it best to enact this load limit ordinance.
Mrs. Stanhope asked if the same thinq was going to happen
to FM 1103, where they are working on the Loop around Cibolo
and the trucks are using FM 1103 and ruining the road.
Mayor Sawyer said we can look into this but most of that is
in the County and State.
#6 Discuss a resolution requesting projects to be
included in the Metropolitan Planning Organization.
Mr. Sweatt reminded that the MPO is a relatively new
organization and they. have primary control of several
million dollars in State hiqhway projects. We submitted a
number of long and short range projects last year and the
only ones considered are FM 3009, Doerr Lane and FM 78
(which is in the ten year plan). They have issued a call
for 1995-97 projects that have not been included previously
and these are ones that have been submitted but not included
in the past: A. FM 78 - widen and improve; B. Alternate
bridge and low-water crossinq of Cibolo Creek; C. Lower
Seguin Road; D. Woodland Oaks Drive from Cotton King to FM
1518 and E. Doerr Lane from MKT railroad to FM 2252. He
said we believe all of these are very easily accomplishable.
Mayor Sawyer said he felt we have a good chance of getting
FM 78 done this time.
Concerning the FM 78 widening, Mr. Sweatt said we have
spoken to members of the State Hiqhway Commission, the
District Engineer, etc. and they always seem to have a
reason why they don't do this project. He said he
understood from the Resident Engineer that they will try to
get a Corridor meeting early in 1994; and at that time,

they will turn over to us the plans for this. We negotiated
with the Southern Pacific for additional land along the
railroad but we still need to acquire some right of way
along FM 78 that will affect some parking.
Council would be ready to act on this ordinance at the next
meeting.
#7 Discuss revocation of an ordinance establishing
special platting fees for property abutting Schertz Parkway.
Mr. Sweatt related that we currently have an ordinance that
established special platting fees to pay development costs
for Schertz Parkway and the expansion to five lanes. This
was passed in 1987 and the City planned to collect these
fees and rebate them back to the developers. Six years has
passed and nothing has happened and we feel it is because of
this ordinance. It would not take a very large piece of
property that could cost from $15,000 to $20,000 in plat
fees. We can only find three property owners that were in
the original consortium. The problem is that we have some
moral commitment to the three remaining property owners:
but they may never get anything back with this in place.
Mayor Sawyer suggested contacting these three owners with
this proposition and see if we can get them to see that this
needs to be done in order to get development started.

#8 Discuss removal of the old CVADAC building from
park property.

one leased to BVYA and asked if Council was in favor of
this.
Mrs. Stanhope said she thought Council had decided to do
this a long time ago.

#9 Consider recommendations regarding Tax Abatement
Agreement for Cabinet Fronts of Texas.
Mr. Sweatt said this is a truly local success story. This
business is being upgraded for the second time. Mr.
Bornmann has requested the second abatement. The first
request was for $122,000 of increased capital improvements
and he was given 30% tax abatement. He now has come back
for a second abatement and our policy has changed. He has
proposed improvements totaling $316,000 and under the new
policy, his tax abatement would be 26% on the addition.

Mr. Sweatt advised that Mr. Bornmann now employes 24
people and with this addition, he has plans to hire 6
additional employees. Mr. Sweatt made Council aware that
in the past a public hearing was required; but this has
already been done for this property so the only action to be
taken is this ordinance.
#12 CITY MANAGER'S REPORT: A. Reminder of the Annual
Christmas Tree Liqhting Proqram the following night at 6:30
p.m. at the Municipal Complex.
B. There were questions concerning the meetinq dates in
December but they do not conflict with the holidays. The
last Workshop would be on the 29th.
Mayor Sawyer said to follow the previously set procedures -
that beinq if the workshop was needed, call it; otherwise
it could be cancelled.
C. He corrected a date listed wrong in the current
newsletter. Immunization dates are December 14 & 21.
Mr. Potempa pointed out that one of the Council meetings
was also listed wronq. The second one should be the 21st.
D. He had received notice from Guadalupe County Appraisal
District of the followinq elected candidates. Malford Brehm
Jr. received 927 votes; Sylvia Schlather received 1066;
Paul Soto - 854; Hilmer Starke - 1066; and Dick Tatum
854.
#13 ITEMS BY COUNCIL: Mr. PotemDa reminded everyone
of the December 6th Tax Incremental Financinq District
meetinq here in the Conference Room.
Mrs. StanhoDe commented that the Christmas decorations
really look neat.

B. Mr. Baldwin said he would not be able to make the Tree
Lighting because they have a School Board Meetinq.
Mr. Greenwald said he did attend the Canyon Regional Water
Authority special meeting two weeks aqo. They did approve
bids on the water line goinq across the lake and the water
standpipe tower. He showed pictures of the type of pipe
they are using on this project. They are movinq right alonq
and are talkino about probably runninq water about February.
Michael Sullivan and Assoc. Enoineerino firm has agreed to
do the initial reqional water supply survey for the local
cities. We need to qet the rest of our cities to start
looking at this. According to Mr. Tschirhart there are
numerous federal and state dollars available for anythino

that is a regional basis. We still think there will be
pumping limits and costs and we have to pursue an alternate
water supply.
#14 ITEMS BY MAYOR: We now have a full complement on
the Housing Authority Board, as he just swore in the last
member.
#15 ADJOURNMENT: There being no further business, the
meeting was adjourned at 8:45 p.m. by Mayor Sawyer.
