ORDINANCE NO. 9q-H- 3
AN ORDINANCE
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS, AMENDING THE CODE OF ORDINANCES
CHAPTER 7-1/2 BY REPEALING SEC. 7-1/2-2 (a)
and (b) and SEC. 7-1/2-16 (a) AND (b) AND
REPLACING THEM WITH NEW SEC. 7-1/2-2
(a),(b),(c) AND (D) AND SEC. 7-1/2-16 (a)
AND (b) INSPECTION CERTIFICATE GRADING AND
POSTINGi AND PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS:
SECTION I
THAT, Chapter 7-1/2 of the Code of Ordinances, City of
Schertz, Texas is hereby amended in the following manner:
Sec. 7-1/2 (a) and (b) is hereby repealed and
replaced with the fOllowing paragraphs:
"Sec. 7-1/2-2 APPOINTMENT OF HEALTH REPRESENTATIVE
AND INSPECTOR.
(a) The Health Officer shall be appointed by the
Mayor and confirmed by the City Council.
(b) The Health Inspector shall be appointed by the
City Manager.
(c) The Health Inspector shall have as minimum
qualifications, license as Professional Sanitarian under
Article 4477-3, Vernon's Texas Civil Statutes.
(d) The fees, salary or both for Health Officer or
Inspector shall be set as a part of the annual budget.
SECTION II
Sec. 7-1/2-16 (a) is hereby repealed and replaced
with the following:
"(a) As often as necessary for the proper enforcement
of the provisions of this chapter, but not less than once
per year, the Health Officer or Inspector shall inspect
every food and beverage establishment, and itinerant food
and beverage establishment, as defined by this Chapter, that
is located within the City. In case of violation of any
items of sanitation brought to the attention of the Health
Inspector, the Health Inspector shall so advise the person
in charge of this food and beverage establishment or
itinerant food and beverage establishment. The Health
Officer shall make a second inspection after a lapse of such
time as is deemed sufficient for the violation to be
corrected, and the second inspection shall be

SECTION III
Sec. 7-1/2-16 (b) is hereby repealed and replaced
with the following paragraphs:
"(b) In the interest of public clarification, the
results from compiling the inspection report will
be converted to a letter grade with the letter "A"
being the highest level of food service operation.
The criteria for the various certificates are:
Grade "A" attain a sanitation score of 85 or
above; Grade "B" - attain a sanitation score
between 70 and 84; Grade "C" - below 70 on the
sanitation inspection.
An Inspection Certificate shall be issued and a
copy shall be posted by the Health Officer at some
conspicuous location on the premises where it will
be clearly visible to all patrons. The Certificate
shall not be defaced or removed by any person
except the Health Inspector. Violation of this
ordinance shall be a Class C Misdemeanor punishable
by a fine not to exceed $200.00 per day that the
Certificate is removed, moved or defaced and/or
suspension of the Food Establishment Permit for
thirty (30) days."
The Health Inspector shall permit the owner to
correct any infraction within 24 hours unless the
owner can demonstrate to the Health Inspector's
reasonable satisfaction that such infraction cannot
be corrected within 24 hours and the Health
Inspector shall then permit the owner to correct
such infraction in a reasonable period of time.
Provided however, if the Health Inspector
determines that the infraction is of an immediate
threat to the public health, there shall be no
grace period for correction. Repeat violations may
result in higher point deduction."
SECTION IV
EFFECTIVE DATE: The provisions of this ordinance shall be
in force and effective from and after March 1, 1994.
