REGULAR MEETING OF THE CITY COUNCIL
DECEMBER 21, 1993
The Schertz City Council convened in Reqular Session Tuesday
December 21, 1993 at 7:08 p.m. in the Council Chambers of
the Municipal Complex, 1400 Schertz Parkway, Schertz, Texas.
The followlnq members were present: Mayor Earl W. Sawyer,
presidinqj Joe Potempaj Hal Baldwinj Barbara Stanhopej
Mary Marsh and Ken Greenwald. Staff present were City
Manager Kerry Sweatt and City Secretary June Krause.
#1 APPROVAL OF MINUTES: A. Special Meeting 12-1-93
B. Reqular Meetinq 12-7-93
Mrs. Stanhope moved to approve the minutes of the Special
meetinq of December 1, 1993 and the Reqular Meetinq of
December 7, 1993. Mr. Baldwin seconded the motion, which
carried with the followinq vote:
AYES: Councilmembers Potempa, Baldwin, Stanhope, Marsh' and
Greenwald.
NAYS: None
ABSTAINING: Mrs. Marsh for the meeting of December 1, 1993.

#3 ORDINANCE: Mayor Sawyer introduced an ordinance
and read the caption as follows:

BY THE CITY COUNCIL OF THE CITY
TEXAS, AMENDING THE SUBDIVISION
NO. 87-S-11, ARTICLE II,
AND PROVIDING A REPEALING
Mr. Greenwald moved to approve the final consideration of
an ordinance amending the Subdivision Ordinance, Article II
on Procedures. Mr. Baldwin seconded the motion, which
carried as follows:
AYES: Councilmembers Potempa, Baldwin, Stanhope, Marsh and
Greenwald.
NAYS: None
#4 ORDINANCE: Mayor Sawyer introduced an ordinance
and read the caption as follows:
ORDINANCE NO. 93-D-23
AN ORDINANCE PROVIDING THAT THE CODE OF
ORDINANCES, CITY OF SCHERTZ, TEXAS BE
AMENDED BY REVISING CHAPTER 18, ARTICLE II,
SECTION 18-45 OF SAID CODE, PROVIDING FOR
RESTRICTIVE VEHICLE WEIGHT LIMITS OF FIFTEEN

THOUSAND (15,000) POUNDS TO BE PLACED ON
CERTAIN STREETS: AND REPEALING ALL
ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT.
Mr. Potempa moved to approve the final consideration of an
ordinance establishing a load limit of 15,000 pounds on
Ware-Seguin Road. Mrs. Stanhope seconded the motion, which
carried with the following vote:
AYES: Councilmembers Potempa, Baldwin, Stanhope, Marsh and
Greenwald.
NAYS: None
#5 ORDINANCE: Mayor Sawyer introduced an ordinance
and read the caption as follows:
ORDINANCE NO. 93-T-24
AN ORDINANCE BY THE CITY COUNCIL OF THE CITY
OF SCHERTZ, TEXAS, APPROVING A TAX ABATEMENT
AND A TAX ABATEMENT AGREEMENT FOR AND WITH
MR. REX BORNMANN, A PROPERTY OWNER IN THE
CITY OF SCHERTZ.
Mr. Baldwin moved to approve the final consideration of an
ordinance approving a Tax Abatement and Agreement with Rex
Bornmann. Mr. Greenwald seconded the motion, which carried
with the following vote:
AYES: Councilmembers Potempa, Baldwin, Stanhope, Marsh and
Greenwald.
NAYS: None
Mr. Sweatt commented that this is the second expansion of
Cabinet Fronts of Texas. That speaks well for our Economic
Development.
#6 ORDINANCE: Mayor Sawyer introduced an ordinance
and read the caption as follows:
AN ORDINANCE
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS PROVIDING THAT THE CODE OF ORDINANCES,
CITY OF SCHERTZ, TEXAS, BE AMENDED BY
REPEALING CHAPTER 2, ARTICLE IV, ECONOMIC
DEVELOPMENT TASK FORCE AND BY ADDING A NEW
CHAPTER 2, ARTICLE IV, ECONOMIC DEVELOPMENT
COMMISSION.
Mrs. Marsh moved to approve the first reading of an
ordinance amending the Code by replacing Chapter 2, Article
IV with a new one entitled Economic Development Commission.
Mr. Greenwald seconded the motion, which carried as
follows:

NAYS: None
Mr. Sweatt advised that this ordinance was updated since
the workshop when Council agreed to expand the membership of
the commission.
#7 RATE REQUEST: Consider and take action on a
request by Alamo Waste Inc. for an increase in rates.
Mr. Sweatt commented that this has been discussed at length
with Henry Gutierrez of Alamo Waste. The increase request
is the result of an increase in tipping fees from BFI. He
added that staff is recommending Council authorize changes
in the rate from the present $7.25 for residential to $7.85,
which is an increase predicated on the tipping fees and less
than 31.7% as requested. That to be accompanied by a 5%
increase for roll-offs. We recommend this become effective
on January 22, 1994.
Mr. Baldwin moved to authorize the increase in
rates from $7.25 to $7.85 as requested. Mrs.
seconded the motion, which carried as follows:

#8 AGREEMENT: Consider and take action on an
Intergovernmental Agreement with Bexar County regarding
Community Development Block Grant for Economic Development
Plan.
Mr. Sweatt recalled that we submitted an application, along
with Kirby, Selma, Universal City and Converse, for a grant
in the amount of $50,000 from Bexar County for a CDBG
program. Each city to contribute $1,000 for the study. We
recommend authorization for this Intergovernmental
Agreement.
Mrs. Marsh moved to authorize entering into an agreement
with Bexar County for a Community Development Block Grant
for Economic Development. Mr. Potempa seconded the motion,
which carried with the following vote:
AYES: Councilmembers Potempa, Baldwin, Stanhope, Marsh
and Greenwald.
NAYS: None
#9 APPOINTMENTS: Consider and take action on
appointing members to the Schertz Industrial Foundation.

Mr. Sweatt advised that four members had aqreed to renew
their membership to this committee - Charles McDonald, Tom
Weaver, Kerry Sweatt, and Lewis Borqfeld. The Board
recommended addinq Jackie Jones to the membership.
Mrs. Marsh moved to appoint Jackie Jones and reappoint
Thomas Weaver, Lewis Borqfeld, Charles McDonald and Kerry
Sweatt as members of the Schertz Industrial Foundation. Mr.
Potempa seconded the motion, which carried as follows:
AYES: Councilmembers Potempa, Baldwin, Stanhope, Marsh and
Greenwald.
NAYS: None
#10 BID AWARD: Consider and take action on awarding
bid on police vehicles.
Mr. Sweatt advised we had solicited bids for four police
units as funded in this year's budqet. Six bids were
received, ranqinq from $51,460.00 to $59,604.00, with
delivery from 60-90 days to 120 days. Based on the
evaluation of bids received, Southway Ford's bid of $51,460,
which represents a price of $12,865 per unit, is the low
bidder and acceptance is recommended. As you can see by the
Bid Recap, these were very close bids.
Mr. Potempa asked if we had to award the bid to Southway
instead of Jordan Ford, which is much closer and we have had
experience with.
Mr. Sweatt said that as we understand the law, we do unless
there is somethinq decidedly different in the two bids and
there does not appear to be anythinq in this case. However,
we can always take the units to any Ford dealer for
maintenance.
Mr. Potempa moved

#11 CITY MANAGER'S REPORT: A. On behalf of all
employees and staff, he wished Council and their families a
very Merry Christmas, addinq that this has not been one of
our best because of the recent traqic accident to one of our
employees.
B. The Schertz Volunteer Fire Department has extended an
invitation to stop by the Fire Department for their annual
tamales and fun.

#12 ITEMS BY COUNCIL:
Each of the Council Members wished everyone a very Merry
Christmas.
#13 ITEMS BY MAYOR: Today we bid farewell to one of
our outstanding employees, Johnny Peterson.
Mayor Sawyer also extended to each and everyone a Very
Merry Christmas.
#14 ADJOURNMENT: On a motion by Mr. Potempa,
seconded by Mrs. Marsh and unanimously carried, the meeting
was adjourned at 7:21 p.m.
