SPECIAL MEETING OF THE CITY COUNCIL
DECEMBER 29, 1993
The Schertz City Council convened in Special. Session on
December 29, 1993 at 7:00 p.m. in the Council Chambers of
the Municipal Complex, 1400 Schertz Parkway, Schertz, Texas.
The following members were..present: -Mayor Earl W. Sawyer,
presiding; Joe Potempa; Hal Baldwin, Barbara Stanhope and
Ken Greenwald. Absent: Mary Marsh. Staff present were
City Manager Kerry Sweatt and City Secretary June Krause.
Mayor Sawyer welcomed everyone to the meeting and then asked
them to rise and join him in the Pledge of Allegiance.

#2 Discuss Community Development Block Grant
application for Mobile Villa utility improvements.
There were approximately 27 residents of Mobile Villa
present to ask questions of Council and staff. Mayor Sawyer
thanked everyone for coming and showing an interest.
Mr. Sweatt, for the benefit of Council and the audience,
reviewed the project and discussed what we hope to
accomplish. This project entails street paving and curbing,
replacement of some water lines and fire hydrants to bring
them up to standards. He went on to say that, at this time
it makes sense to also look at the sanitary sewer service.
Today, the lot size will support a septic system; but there
will be a time when the septic system will not work. To do
this, it would necessitate boring under I -35. We applied
for and received approval from Bexar County for a Community
Development Block Grant for $100,000. We would need this
$100,000 to complete the entire water, street and sewer
project. A part of their guidelines is that the project be
made up of low to moderate income families and we are trying
to meet those guidelines. We scheduled a time for the first
survey using forms they instructed us to use. There might
have been some misunderstanding of this project-so we have
asked a representative of Bexar County Resources, our
engineer and Sam Willoughby to answer questions on
construction.
Jesse Flores, from Bexar County Resources, explained that in
order to qualify for this project, we need to ascertain that
the Mobile Villa area does meet the guidelines. The income
limits are based on the number of persons in the household
and 38.73% of the residences must be low to moderate income
families. The way this is done is by surveying the
residents. He said he understood that the City has gone out
on two occasions trying to get documentation of proof of
income. He advised that he was available to help in any way
possible. Mr. Flores then gave the list of income levels
for the number of persons in the household as being: one
4S/3 .
person - $19,300; two persons - $22,100; three persons -
$24,850; four persons - $27,600; five persons - $29,800;
six persons - $32,000, seven persons - $34,200 and eight
persons would be $36,450.
Mr. Sweatt advised that it was never our - .intention to imply
that this was not a federal'.project ''He. said we`do believe

will not be able to do the entire project. We could do the
water lines and streets and curbing and might be able to
bore under I -35.
There were several questions regarding the flow of the
sanitary sewer lines, with engineer Paul Denham explaining
the closest line to Mobile Villa is near the Quality
Closeout business on I =35.
Mayor Sawyer added that if this sewer project is not done
now, chances are it will be a long time before it could ever
be done.

Mr. Denham reminded the people that when you have septic
tanks as they do now, they are not for ever. There will be
a point when the people will have to make a choice.
Answering more questions, Mr. Sweatt advised that the home
owner could do their own plumbing work with a permit. As
for the chances for the CCMA fees being waived, he said it
has been done in the past. Also, he advised that Council
has decided that the residents would not have to hook up to
the sewer lines until their septic tanks need repairs or
replacement.
Mr. Sweatt also advised that about twenty residents had
indicated they would not fill out the survey forms; and,
since we only need seven more to qualify, he felt that
surely of those twenty, seven would qualify.
When asked what options they had if they are not eligible
for the grant, Mr. Sweatt said the City will then proceed
with the water improvements and then the street paving
project. After that, if there is sufficient money left, we
would bore under I -35 and that would deplete the money from
the bond issue.

Mr. Denham projected that if we just do the water lines we
would be talking about 45 to 60 days.:_He. said we would want
to do the utilities first and then come back with the
streets, which- would -take about 75 days He admitted. that
we would be looking at a long time frame but the benefits
would out weigh the inconvenience.
Someone" asked about putting in natural gas lines and Mr.
Marquez said that we only had four that were interested and
Entex said they would have to have at least 34 that wanted
gas.
Mr. Sweatt related that the water line would go to the
meter only and we do anticipate that the pressure would be
improved. Once this is done, the residents should have
constant pressure.
Mayor Sawyer advised that staff would be sending out another
letter and encouraged the people to talk to their neighbors
about this project. He added that Council and staff are
available to help in any way.
Mr. Flores advised that they could wait at least thirty
days to receive the surveys for this project.
Mr. Sweatt thanked everyone for coming and being so
courteous not only tonight but with our survey personnel.
Mayor Sawyer called for a recess at 7:55 p.m.
The Special Session was reconvened at 8:01 p.m. _
#3 Discuss final consideration of an ordinance
amending the Code by replacing Chapter 2, Article IV
Economic Development Task Force with a new Chapter 2,
Article IV Economic Development Commission.
Mr. Sweatt advised this would be the second and final
consideration of this ordinance, which simply proposes to
replace the Task Force with the Economic Development
Commission. The Task Force has accomplished what they had
to do. All the people that were recommended are quite eager
and we recommend this be passed on final consideration.

#5 CITY MANAGER'S REPORT: A.' Reminded that City Hall
will be closed December 31st; however, we will have regular
garbage service and emergency services will continue.
B. We received an invitation from Village Oak Hospital
Emergency Room for their Grand Opening at noon on January
12th, With luncheon following. They need the RSVP by the
10th.
#6 ITEMS BY COUNCIL:
Mr. Potempa asked the City Manager to pass on to Chief Agee
his appreciation to Mike Harris, Beverly Todd and Mark
Schupp. Their response to an incident recently was terrific
and they did one heck of a job. There were some dogs
involved that could involve our animal control.
Mrs. Stanhop_e asked if Cablemax meet our ordinances. Mr.
Sweatt said they have been notified of our 35 foot height
and to our knowledge, they have not installed any at a
greater height.
Mr. Greenwald noted that in the paper today it stated that
Joe Moore was appointed to monitor pumping from the Edwards
aquifer to ensure compliance with the Endangered Species
Act. Be prepared to be charged for pumping.
#7 ITEMS BY MAYOR: Mayor Sawyer said starting next
Tuesday, he would be a full -time mayor because-he will be
retired.
He mentioned the overlay project on Main and Oak Streets are
really looking good.
Mr. Potempa asked if we could send letters to Mayor and
City Council of Converse expressing our appreciation for
them supplying three people as temporary fill -in during Mr.
Peterson's funeral.
Mr. Sweatt added that not only did Converse provide some -
public works personnel during that time; but the City of
Universal City had their Fire Chief and fire personnel
standing by; Bracken Fire Department was on standby; and
we had some additional state and county police backup. It
was asked that letters be sent to all of them.
#8 ADJOURNMENT: There being no further business,
Mayor Sawyer declared the meeting to be adjourned at 8:16
