REGULAR MEETING OF THE CITY COUNCIL
JANUARY 18, 1994
The Schertz City Council convened in Regular Session,
Tuesday, January 18, 1994, at 7:08 p.m. in the Council
Chambers of the Municipal Complex, 1400 Schertz Parkway,
Schertz, Texas. The following members were present: Mayor
Earl W. Sawyer, presiding; Barbara Stanhope; Mary Marsh
and Ken Greenwald. Absent: Joe Potempa and Hal Baldwin.
Staff present were City Manager Kerry Sweatt and City
Secretary June Krause.

Mrs. Stanhope moved to approve the minutes of the Special
Meeting of December 29, 1993 and Regular Meeting of 1-4-94.
Mr. Greenwald seconded the motion. The Regular Meeting of
January 4, 1994 was approved with the following vote:

#2 HEARING OF RESIDENTS: A. Mrs. Barbara Knight
that she and her neighbors had called many times about
speeding on Mitchell. She said the police will not sit
give tickets on Mitchell except to little old ladies.

Mr. Sweatt advised that we have, at most, three officers on
duty at one time and they may already be on calls. He added
that he would be happy to look into this for her.
Mrs. Knight said they live in the 800 block but the
speeding goes on the entire length of Mitchell Avenue.
B. Mr. George Mower of 501 Brooks Avenue asked if anyone
on the City Council had done anything or intended to do
anything about the law coming up for consideration to put
alpha listings on businesses. He asked if the Council
intended to put any requirements, other than having a
driver's license, on the official doing the inspections. He
felt the qualifications should be put in the ordinance.
Mr. Sweatt advised that in this case, the service is
provided by contract and is not an employee. He does meet
the Texas qualifications for Sanitarian. Where that
information should be would be in a job description, which
we would have if the person was an employee of the City.

Mr. Mower then asked if the City was going to contract this
job out, would the City require the contractor be certified.
Mr. Sweatt said we could contract with anyone to do the
inspection work; but we believe we have the best one for
the job right now.
C. Mr. Adolph Aguilar said that as most of the Council
knows, he has been a member of the Alamo Area Council of
Governments (AACOG) Review Board for some time. He said he
discussed with Mr. Sweatt about a workshop on February 1
and 2 at the University of Texas Health Science Center on an
Economic Prosperity Plan. It will involve all entities in
Texas. He said Mr. Marquez has been designated to attend
this workshop and he invited any of the Council members to
attend who could.
D. Mr. Aguilar also mentioned a questionnaire regarding
recommendations from AACOG concerning the easing of
application requirements for grants. He asked if Council
has any suggestions because they could really use them. He
felt our parks could benefit by some of the grant money. He
said he would discuss the questionnaire with Mr. Sweatt.
E. Linda Little thanked council for approving their request
for the two carports.
#3 ORDINANCE: Mayor Sawyer introduced an ordinance
and read the caption as follows:
ORDINANCE NO. 94-F-2
AN ORDINANCE BY THE CITY COUNCIL OF THE CITY
OF SCHERTZ, TEXAS, PROVIDING THAT THE CODE
OF ORDINANCES CITY OF SCHERTZ, TEXAS, BE
AMENDED BY REVISING SECTION 7-1/2-54,
EXHIBIT 2 GARBAGE RATE SCHEDULE;
PROVIDING AN EFFECTIVE DATE: AND REPEALING
ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT.
Mrs. Marsh moved to approve the final consideration of an
ordinance amending the Code by revising Section 7-1/2-54,
Exhibit 2 - Garbage Rate Schedule. Mrs. Stanhope seconded
the motion, which carried with the following vote:

#4 ORDINANCE: Mayor Sawyer introduced an ordinance
and read the caption as follows:

AN ORDINANCE BY THE CITY COUNCIL OF THE CITY
OF SCHERTZ, TEXAS, AMENDING THE CODE OF
ORDINANCES CHAPTER 7-1/2 BY REPEALING SEC.
7-1/2-16 (b) AND REPLACING IT WITH A NEW
SEC. 7-1/2-16 (b) INSPECTION CERTIFICATE
GRADING AND POSTING; AND PROVIDING A
PENALTY.
Mr. Sweatt recalled that at the last workshop, we discussed
the effective date saying it could be late in February. He
then suggested sending letters to all food establishments
and setting the effective date as March 1, 1994.
Mr. Greenwald moved to approve the first reading of
ordinance amending the Code Chapter 7-1/2, Article II
Establishments. Mrs. Marsh seconded the motion,
carried with the fOllowing vote:

#5 CITY MANAGER'S REPORT: A. The AACOG

residents to turn in surveys and we are a minimum of two
short. We are so close but just don't know what to do now.
Mrs. Marsh suggested talking to Mr. Potempa to see if he
could get two more.
Mrs. Stanhope said the only thing we can do now is
another letter telling them we are within two of
sufficient number.

Mayor Sawyer said we are too close to stop now.
#6 ITEMS BY COUNCIL: Mrs. Stanhooe said she had
received a call about Schertz Parkway so she drove there to
confirm what she was told. When you drive toward Schertz
and get near Maske Road if you are not really noticing what
you are doing, you could lose control because of the curve.
Mr. Aguilar said that several months ago he had discussed
with staff putting reflectors on the posts there.
Mr. Sweatt said he would check into this.
Mrs. Marsh again reminded everyone of the Trail Riders
dinner and dance we have every year. It will be on the
evening of February 4th this year at the VFW. Along with
that the Schertz Business Association has their Silent
Auction to help pay for the Jubilee fireworks display. She
said they could still use more items for the auction.
