ccswks 02-09-1994 74 SPECIAL MEETING OF THE CITY COUNCIL FEBRUARY 9, 1994 The Schertz City Council convened in Special Workshop Session Wednesday, February 9, 1994 at 7:00 p.m. in the Conference Room of the Municipal Complex, 1400 Schertz Parkway, Schertz, Texas. The following members were present: Mayor Earl W. Sawyer, presiding; Joe Potempa; Hal Baldwin; Barbara Stanhope and Ken Greenwald. Staff present were City Manager Kerry Sweatt and City Secretary June Krause. #1 HEARING OF RESIDENTS: A. Bill Neller mentioned that about four of the bar brackets that are used for Christmas decorations and are too close to the flag holders. He asked if something could be done because about five are in the way of the flags, which we fly on recognized holidays. Mayor Sawyer and Mr. Sweatt both said we would look into this. fl.2 Discuss BVYA request to construct a building on City property. storage Mr. Sweatt showed on a sketch the location of the requested building, saying it would be right in back of the City yard area. He added that we see no problem with this assuming that it is built to meet City specifications and painted to match other city bUildings. Mr. Sweatt said we would work on a lease agreement similar to the Scout Hut arrangements for something like $1 a year. Council had no objections to this arrangement. fl.3 Discuss resolution changing the name of Live Oak Boulevard to Wiederstein Drive. Mayor Sawyer reminded Council they had discussed this before and with no objections he would ask that it be on the next agenda. Mr. Baldwin asked if he understood right, that we do an agreement with Selma and was told yes, but we nothing in writing with Cibolo - just verbal agreement. have have Mr. Greenwald reminded that is the name used in Cibolo already. fl.4 Discuss changes to ordinance amending the Code Chapter 7-1/2 Article II Food Establishments. Mayor Sawyer recalled that the previous week Council and food establishment owners had a good discussion and invited people to come to the meeting and discuss their ideas. _/ 75 Mr. Sweatt mentioned that at the last meeting we discussed the opportunity for the Food Establishment Operator to bring discrepancies into compliance. In this revision of the ordnance, we have suggested wording to allow for that. He then read the exact wording. Mr. David Post, owner of the Sandwich Garden, said his main concern was that this period be allowed before posting the grade. If your accrual points are low, and you would need a lot of stuff wrong to get a low score, you would get a grace period the first time around to get into compliance. The second time for the same thing, there would be no grace period and the grade would be posted. He went on to say that sometime there is something wrong with the building, such as bad tiles in other that the kitchen area this would be minor and not critical to safety but might take longer to correct. Sanitarian Gary Davis said we should be very cautious to not violate the state codes and ordinances. Council then discussed this area at length with the owners and Sanitarian. Mr. Harris and Mr. Mower again brought up that they felt the qualifications to be a health inspector should be in this ordinance, even when Mr. Davis pointed out that the State sets out the duties of a Sanitarian and he felt the qualifications for a health inspector should be in a job description, should the City ever hire a full-time employee, rather than contract for health services. Mr. Sweatt pointed out that it could impact on the budget if Council wished to include in the ordinance that the Inspector should be a Certified Sanitarian and also put in requirements for certain number of inspections. It was Council decision to put the qualifications in the ordinance and require inspections at least one annually, even though that is what is being done at the present time. #5 Discuss final consideration amending the Code Sections 18-32 Stop 18-33 Four-Way Stops. of an ordinance Intersections and Mayor Sawyer last meeting letter from stop signs at advised that this also was discussed at the and since then Council members had received a Mr. Hartzog expressing his opposition to the Broughton and Savannah Drive. Mr. Sweatt agreed that stop signs are not intended to be used primarily for speed but to effect the movement of pedestrian and other traffic. He added that staff believes the interruption of the traffic flow will allow some other traffic to be funnelled toward that intersection. There has been complaints of dangerous conditions such as speeding, 76 bicycle traffic and the such from the home owners in the area who did request chanqes but not necessarily stops signs. If and when Savannah Drive is extended over to Schertz Parkway, it will be a major thoroughfare. Mr. Sweatt said we did have an error in the original proposed ordinance in that we suggested a stop at Habersham with Broughton, a through street. That should have been stop at Habersham with Ogelthorpe the through street. When Mayor Sawyer asked for Council's feelings on this, Mr. Baldwin said his only question was Mr. Hartzog's claim that a lot of people are complaining about this and you would think those people would be at the meeting where it is discussed. Mayor Sawyer acknowledged there was not much discussion to be had on this item and asked that it be on the next agenda. #7 Discuss final consideration of an ordinance calling an election for May 7, 1994 submitting charter amendment questions to voters. As this had also been discussed previously, Mayor Sawyer requested it be on the next agenda. fl.8 Discuss final consideration of an ordinance calling an election for May 7, 1994 for sale of property and a non-binding referendum on recycling collections. Council had no further questions about this ordinance, so it was asked to be placed on the next agenda. #9 CITY MANAGER'S REPORT: A. We have been asked to meet with Congressman Lamar Smith on February 14th from 9:30 to 10:30 a.m. at the Universal City City Hall. He will answer questions and give an update. 7~ B. Would like to place on the next agenda for consideration a minute order for a CDBG Grant Application. Bexar County has accelerated their schedule and the last day is February 23rd. We will be submitting applications for upgrading facilities and sidewalks to meet ADA standards and one for reconstruction of restrooms in our park to comply with ADA. C. It appears we are near or at the low to minimum income requests for Mobile Villa, so it appears we will qualify. #10 ITEMS BY COUNCIL: Mr. PotemDa: A. Had a Tax Incremental Finance meeting and among other items, they have come up with a draft of by-laws. B. He asked if the City was having Schertz Parkway. Mr. Sweatt said problems getting paint to stick to the would ask Public Works to take another paint problems on we are having some pavement. He said he look at it. Mr. Baldwin: A. Ask what the possibility was of the City sponsoring an Easter Egg Hunt in the park. He said he would be glad to work with a committee on this. Mr. Potempa mentioned bringing this up at the Business Club and at Lion's Club. Mr. Greenwald said at Canyon, the VFW does this and in Universal City, the American Legion does it. Mr. Baldwin said he would talk with some people to see if there is some real interest. B. He asked if there was some Parks & Wildlife grant that we could look at doing a walk or jogging path along Schertz Parkway. After further discussion, Mayor Sawyer said he seemed to recall that when talking with developers, they said something about putting in a jogging trail in their buffer zones. He said they had three different seminars and they were all very interesting. He handed out some material on the Texas River Clean-Up Program. Mr. Stuart Henry, attorney for the Sierra Club also was one of the speakers. #11 ITEMS BY MAYOR: Saturday morning at 10:00 a.m. be breaking ground for their Station on Schertz Parkway. Mayor Sawyer announced that the Knights of Columbus will new hall across from the Fire .' 78 #12 ADJOURNMENT: There being no further business to come before Council, the meeting was declared adjourned at 8:34 p.m. by Mayor Sawyer.
