AN ORDINANCE BY THE CITY COUNCIL OF THE CITY
OF SCHERTZ AMENDING THE CODE OF ORDINANCES
OF THE CITY OF SCHERTZ RELATING TO CERTAIN
ANIMAL CONTROL VIOLATIONS; AND ESTABLISHING
AN EFFECTIVE DATE
WHEREAS, the City Council of the City of Schertz believes that required
Penalties imposed for certain .violations of the City's Animal Control Ordinance result
in the loss of a judge's prerogative and latitude;
WHEREAS, the City Council believes that a judge's prerogative and
latitude is important when imposing certain penalties under the Animal Control
Ordinance;
WHEREAS, the City Council has determined that the best method of
giving judges prerogative and latitude when imposing penalties for certain violations
of the Animal Control Ordinance is to permit judges to impose an administrative fee
in lieu of a penalty when a violation has been remedied;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF SCHERTZ, TEXAS:
SECTION 1: Chapter 4, Article XII, Section 4-38, Exhibit 2 of the
Code of Ordinances of the City of Schertz is hereby amended by adding Section 2 which
reads as follows:
"Sec. 2
Discretionary Imposition of Administrative Fee in Lieu of
Penalty
A judge who has jurisdiction of the offense, at his/her
discretion, may dismiss a rabies vaccination violation or a
registration/license violation if the defendant remedies the
charged defect within 10 working days of the date of
citation, upon the assessment by the judge and. payment by
the defendant of .an administrative fee <;>f $20.00 for
dismissal of a rabies vaccination violation, and $10.00 for
dismissal of a'registration/license violation."

SECTION 2: Chapter 1, Section 1-2 of the Code of Ordinances of the City
of Scherb is hereby amended by adding the following definition:
"\Vo.rking Days. The term "working days" shall mean Monday, Tuesday,
Wednesday, Thursday, and Friday."
SECTION 3: This Ordinance shall be in force and effect from and after
