ccreg 04-19-1994 128 REGULAR MEETING OF THE CITY COUNCIL AP R ILl 9, 1 9 94 The Schertz City Council convened in Regular Session Tuesday, April 19, 1994, at 7:00 p.m. in the Council Chambers of the Municipal Complex, 1400 Schertz Parkway, Schertz, Texas. The following members were present: Mayor Earl W. Sawyer, presidingj Joe Potempa, Hal Baldwin, Barbara Stanhope; Mary Marsh and Ken Greenwald. Staff present were City Manager Kerry Sweatt and City Secretary June Krause. Mayor Sawyer opened the meeting by asking everyone to rise and join him in the Pledge of Allegiance. He then had the pleasant duty of presenting two proclamations. The first to the VFW proclaiming "Loyalty Day" on May 1, 1994. Mr. Reece, on behalf of the VFW members, thanked the Mayor for proclaiming May 1st as "Loyalty Day" in Schertz. He asked everyone to show their patriotism on that day by flying their flag. The second proclamation was presented to John Bierschwale, Public Works Directori Eber Bush, Water Superintendent and their department proclaiming May 1st, "National Drinking Water Week" in Schertz. With the help of Lieutenant Starr and Chief Agee, Mayor Sawyer presented Certificates of Completion to the graduates of the most recent Citizen's Police Academy. There were twenty one in the class, with nineteen present to receive their certificates. #1 APPROVAL OF MINUTES: A. B. Special Meeting 3-30-94 Regular Meeting 4-5-94 Mrs. Stanhope moved to approve the minutes of the Special Meeting of March 30, 1994 and the Regular Meeting of April 5, 1994. Mr. Greenwald seconded the motion, which carried with the following vote: AYES: Councilmembers Potempa, Baldwin, Stanhope, Marsh and Greenwald NAYS: None ABSTAINING: Mr. Potempa for the meeting of March 30, 1994. #2 HEARING OF RESIDENTS: Mr. J. L. Stewart of 1308 Circle Oak referred to a lot between his and FM 3009 that is owned by the City. He said every time the weeds get about waist high, he calls the City and they go out and cut about half of it - they do not get down in the drainage ditch. This drainage ditch is full of mud and weeds and every time it rains, he has a lake in his yard. He added that last Monday the Street crews were out doing some work and got out / ./ 129 in the middle of the street and swept everything up to his curb after he had swept it to the drainage ditch. He asked why someone could not go out there and clean the drainage ditch. He reminded that letters are sent to citizens asking them to cut their grass and weeds. About three years ago, he got a letter saying he needed to cut the tree limbs in front of his house because the sweeper could not get under them but he had no trouble parking his 18 wheeler truck under the tree. He asked for some checking to be done on this. Mr. Sweatt said he will check into this and apologized to him if he was sent a letter and should not have gotten one. Mayor Sawyer asked Mr. Stewart to give us a chance to look into his complaints. #3 ORDINANCE: Mayor Sawyer introduced an ordinance and read the caption as follows: AN ORDINANCE PROVIDING THAT THE CODE OF ORDINANCES. CITY OF SCHERTZ, TEXAS BE AMENDED BY REVISING CHAPTER 12 1/2. ATTACHMENT "B", OF SAID CODE, PROVIDING FOR THE USE AND REGULATIONS OF SWIMMING POOL FACILITYi REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT. Mrs. Marsh moy~~ to approve the first ordinance amending the swimming pool regulations. Mr. Greenwald seconded the carried with the following vote: reading of charges motion, an and which AYES: Councilmembers Potempa, Baldwin, Stanhope, Marsh and Greenwald. NAYS: None #4 agreement Base. AGREEMENT: Consider and take action on an for SAFES-EMS services with Randolph Air Force Mayor Sawyer said he believed Council had asked Mr. Sweatt some questions about this agreement and then asked for the answers. Mr. Sweatt answered that Council had discussed this and had touched on most of these items during the negotiations with Randolph Air Force Base. The main questions was has the base prepared civilian and base personnel to expect charges that would be incurred by them. He answered yes, as they currently are accustomed to paying those charges. On-duty military personnel will elect Champus benefits. As for the civilian contractors are required to show proof of insurance and the ability of insurance of at least a portion of the J30 cost of ambulance service. There was a news release to the Wingspread outlining the agreement and indicated the charges would be incurred. The Security Police will be the ones to first respond. Mrs. Malone, Director of SAFES said that as of this date, they have had nine calls and only three were transports. Mayor Sawyer then called for a motion on this agreement. Mr. Potempa moved to approve the agreement between the of Schertz SAFES-EMS and Randolph Air Force Base. Baldwin seconded the motion, which carried with following vote: City Mr. the AYES: Councilmembers Potempa, Baldwin, Stanhope, Marsh Greenwald. NAYS: None and #5 AGREEMENT: Consider and take action on an agreement between the City of Schertz and Buffalo Valley Youth Association for the construction of fencing. Mr. Sweatt recalled that at budget time, we discussed this. BVYA has requested, for several years, 2100 feet of fencing for crowd control, particularly during tournaments. This year we decided to make a loan with repayment by BVYA in the amount of $2,000 a year over a five-year period. We believe it is a good agreement between the two parties and the best way to get the fence. Mayor Sawyer reminded everyone that this will not cost the city anything. Mr. Greenwald moved to approve the agreement with Buffalo Valley Youth Association for the construction of fencing. Mrs. Stanhope seconded the motion, which carried with the following vote: AYES: Councilmembers Potempa, Baldwin, Stanhope, Marsh and Greenwald. NAYS: None Mike Biggs, President of BVYA, presented the City the first installment on this loan and thanked Council for their consideration, adding that BVYA really needs this fencing. Mr. Sweatt added that notices have gone out and soliciting bids for this fencing. The bids to be May 5th. We are trying but are not sure we will completed by the first tournament. we are now opened on have it #6 BY-LAWS: Consider and take action on ratification of Schertz Parkway Tax Increment Financing Zone Board of Directors By-laws. _/ 13] Mr. Sweatt said this board was established as part of the proposed improvements for Schertz Parkway. It consists of seven members - two from each taxing entity, those being the city of Schertz, Schertz-Cibolo-Universal City Independent School District and Guadalupe County. The Chairman is appointed by the Schertz City Council. He mentioned that City Council members had received a copy of the by-laws and minutes of this board and recommended approval. Mrs. Marsh moved to approve the By-Laws of the Tax Increment Financing Zone Board of Directors. Mr. Potempa seconded the motion, which carried with the following vote: AYES: Councilmembers Potempa, Baldwin. Stanhope, Marsh and Greenwald. NAYS: None #7 CITY MANAGER'S REPORT: A. This next Saturday from 9:00 until 11:00 am, the Landscape Committee will be cleaning up and planting trees at the xeriscape educational park on Borgfeld Road. Everyone is invited to join them. B. He reported that our City employees have elected to confine smoking in this building to the conference room and the break roon. They are commended for making this choice. C. As discussed at the last meeting, we have experienced a number of calls for storm damage clean up. Some of the calls were for debris from other sources and was chipped but originally it was just for storm damage. We will be releasing the rented chipper but will continue with our smaller chipper at a charge of $10 per half hour. We had about 300 calls. D. The Flambeau Parade is this Saturday night and our float will be in it. It starts at 7:00 p.m. but we are way in the back. It is three week for thirteen weeks but well worth every minute She said she learned so much and had such a good Mrs. Marsh reminded everyone that the 4th of July is coming up. They had a meeting this date and things are coming along very well. It will be for two days plus a tournament on Saturday. She reminded everyone that when they see those buckets throughout the city to make a donation toward the fire works.
