ccreg 05-17-1994 153 REGULAR MEETING OF THE CITY COUNCIL MAY 17, 1994 The Schertz City Council convened in Regular Session Tuesday, May 17, 1994 at 7:05 p.m. in the Council Chambers of the Municipal Complex, 1400 Schertz Parkway, Schertz, Texas. The fOllowinq members were present: Mayor Earl W. Sawyer, presidinq; Joe Potempa; Hal Baldwin; Mary Marsh and Ken Greenwald. Absent: Barbara Stanhope. Staff present were City Manaqer Kerry R. Sweatt and City Secretary June Krause. #1 PUBLIC HEARING: The Council to receive citizen input on the proposed name change for F.M. 78. Mayor Sawyer asked for citizen input. Coralee Fenner, 6430 Pfeil Road, advised that she is an employee of the City of Schertz. She first read a letter that would explain to those that did not want to chanqe their address. The letter is from James Lindsey, Manager Address Manaqement Systems, San Antonio District, United States Postal System. The read stated: "This is to advise you that the renaminq of a portion of FM 78 to "John E. Peterson Parkway" will not affect mail delivery to those persons currently receivinq mail at an FM 78 address. The process of renaming the street involves the input of an "alias" or "alternate" street name into our datafile so that mail addressed with either name will be correctly distributed. This is identical to the process used when the city of San Antonio, for example, renamed Loop 410 Connally Loop or when a portion of IH 10 was renamed Robert F. McDermott Freeway. Mail delivery will not be impacted and mail addressed to either FM 78 or John E. Peterson Parkway will be delivered by the US Postal Service." Mrs. Fenner reminded that on December 17, 1993 John E. Peterson lost his life in the line of duty. Mr. Peterson was a Supervisor of the Water/Wastewater Division of the Schertz Public Works Department. This was a tragic accident. Mr. Peterson was fully dedicated to his job and to the City of Schertz. Upon hearing of his death, his fellow employees felt something should be done to keep his memory alive. Connie Silvers suggested naming the road after him. There were several suggestions but the renaming of FM 78 was the most frequent option. Since Mr. Peterson had so many friends in other cities, they felt it was impossible to limit this to just the City of Schertz. They have talked with all the cities in the FM 78 area. They chose "John E. Peterson Parkway" because FM 78 runs by a park in Cibolo and in Converse it goes by a city park. They felt it sounds better also. She then thanked Council for the opportunity to make their feelings known. There being no further comments from the citizens or Council, Mayor Sawyer declared the public hearing closed at 7:09 p.m. J54 #2 Consider and take action, if any, on the above public hearing. Mr. Greenwald moved to approve the renaming of FM 78 to John E. Peterson Boulevard. Mr. Potempa seconded the motion. Mr. Greenwald pointed out that Planning & Zoning Commission members had recommended changing the name from "Parkway" to "John E. Peterson Boulevard". When the vote was called by Mayor Sawyer, the motion passed as follows: AYES: Councilmembers Potempa, Baldwin, Marsh and Greenwald NAYS: None #3 APPROVAL OF MINUTES: SpeCial Meeting 4-27-94 and Regular Meeting 5-3-94. Mrs. Marsh moved to approve the minutes of Meeting of April 27 and the Regular Meeting of Mr. Greenwald seconded the motion, which follows: the Special May 3, 1994. carried as AYES: Councilmembers Potempa, Baldwin, Marsh and Greenwald NAYS: None #4 HEARING OF RESIDENTS: None #5 ORDINANCE: Mayor Sawyer introduced an ordinance and read the caption as follows: ORDINANCE NO. 94-S-10 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, REPEALING ORDINANCE NO. 87-S-22 PROVIDING FOR SPECIAL PLATTING FEES CONTIGUOUS WITH AND PARALLEL TO SCHERTZ PARKWAY. Mrs. Marsh moved to approve, on final reading, the ordinance repealing Schertz Parkway Platting Fees. Mr. Greenwald seconded the motion, which carried as follows: AYES: Councilmembers Potempa, Baldwin, Marsh and Greenwald NAYS: None #6 SWEARING-IN CEREMONIES: Mayor Sawyer said that as he stepped down, he wanted everyone to know that it has been a pleasure to be the Mayor of this city for the past several years. He added that he has enjoyed his association with the people that work for the city and the people who live in this city. He said he did appreciate the naming of FM 78 to John Peterson Blvd, it is good that we recognize employees who have given of their lives in service to the community. ~ 155 At this point, Mrs. Krause swore in to office Hal Baldwin as Mayor, Charles L. McDonald - Councilmember, Place 1 and Joe Potempa - Councilmember, Place 2. Each new member of the Council were then given their new name plates and badges. Mr. Baldwin then thanked everyone present, especially his family, his extended family - next door neighbors, friends and relatives for the help during his campaign. He then thanked his wife, Barbara for her support. Mayor Baldwin then called Mayor Sawyer forward and called on Guadalupe Council Judge Jim Sagebiel, who wished to make a presentation to Mr. Sawyer. Judge Sagebiel first congratulated everyone on their new Council seats. He added that it sounds real good to hear "Mayor Baldwin". Judge Sagebiel advised that anytime the County could assist or work with the City to just let them know. He then presented a Proclamation of Retirement to Mayor Earl W. Sawyer, commending him for his many contributions to the progress of this county, and extending his personal best wishes and those of the Guadalupe County Commissioner's Court and all our citizens for many more years of health and happiness. Mayor Baldwin said he knew he would be following in some pretty big footsteps, adding that he and Earl Sawyer had been friends and political allies for some 25 years in this city. He added that they first met in the days of BVYA baseball, Earl's days on the Planning and Zoning Commission, his days on the Council and his days as Mayor. Mayor Baldwin then presented a clock plaque to Mr. listing his years of service to the City. Sawyer #7 CDBG PROGRAM: Consider and take action re-qualification for Urban County CDBG Program County. regarding of Bexar Mr. Sweatt reminded Council this is an issue for which they have spent considerable time going over the pros and cons. An issue of great importance to our city for the next three years. He said we have in the past six years affiliated ourselves with Bexar County through what is known as Urban County designation and have been eligible for certain CDBG funds as a result. We have received funding for two projects - the most recent being the utility improvements in the Mobile Villa Subdivision. Previously there was a CDBG grant for water line improvements in the Schermirville area and also benefited from an economic development block grant with other cities for a study. There has been CDBG funds used for water line extension and soon to be sewer line in the Rittimann Addition. Those are the positive sides of participation in the Urban Program. j56 On the negative side, we have lost our eligibility to participate with the State of Texas in the small cities Community Development Block Grant program, which among other things, allows cities to make application and receive funds for a capital program, which is used in economic development incentive packages. We understand that Bexar County has approved an application for certain ADA projects that we submitted this year. This action should not affect those. Based on our being eligible for certain State CDBG programs and Capital funds, we recommend that we notified Bexar County that we will not renew our affiliation for the next three years and instead pursue an application to the State of Texas for Capital funds. Mayor Baldwin asked if Council had any concerns about burning our bridges with Bexar County. Mrs. Marsh reminded that Council has discussed this at length. Mayor Baldwin said he felt the bottom line is the pool is tremendously larger at the State level but we would be competing with a large number of cities. He added that what concerns him more than anything is the qualification for the Community Development Block Grant program under the Urban County designation - that being, the low to moderate income areas. Mr. Greenwald feared that once we inform Bexar County we will not renew, they will cancel the ADA project they have approved. Mr. Sweatt advised that this has been preliminarily approved but we do not have any guarantee. The final action will not be taken until about the tenth of June. He added, that in meeting with other City Managers, Live Oak took action to not be affiliated with Bexar County for the next three years. He was fairly positive that Converse, Kirby and Universal City would be renewing their affiliation. Mr. McDonald asked that if we lose the ADA funding, how would we comply with the law. Mr. Sweatt said it would be his suggestion that we would begin funding as many of those projects as possible as funds become available through the general operating budget. Mr. Potempa asked if all could be done this way by 1995. Mr. Sweatt advised that he did not feel that many cities could comply with that date. We have 320 intersections that need to be ramped. Most of our new subdivisions are cum~lying with this now. We have a deadline of May 27th. Mayor Baldwin was concerned about the effect of our severing contract with Bexar County on things other than the ADA projects. 157 Mr. Greenwald said that if we do go with them to insure the grant, we would be stuck with them for three years and we virtually have no more areas that would qualify. Mr. McDonald moved to withdraw from the Bexar County Urban County CDBG Program. Mr. Greenwald seconded the motion, which carried with the following vote: AYES: Councilmembers McDonald, Marsh and Greenwald NAYS: Councilmember Potempa #8 APPOINTMENT: appointment of three Authority Board. Consider members and take action to the Schertz on the Housing Mrs. Jones, Housing motion, Marsh moved to approve the appointment of Jackie Warren Klebig and Sharon Fruge as members to the Authority Board. Mr. McDonald thanked the people who helped him get elected with their moral and telephone support. Mr. McDonald then asked Council indulgence. He has two grandchildren getting married in Alaska and he planned to go the weddings and would be gone June 9-27. 158 #11 ITEMS BY MAYOR: A. This will mean Mr. Potempa will be Pro Tern for another six months. C. He has asked the City Manaqer and City Attorney to draft an ordinance on the proper procedures for conductinq meetinqs. This will be on the next workshop. D.
