ccreg 06-07-1994 165 REGULAR MEETING OF THE CITY COUNCIL JUNE 7, 1994 The Schertz City Council convened in Regular Session, Tuesday, June 7, 1994 at 7:00 p.m. in the Council Chambers of the Municipal Complex, 1400 Schertz Parkway, Schertz, Texas. The following members were present: Mayor Hal Baldwin, p~esidingi Charles McDonaldi Joe Potempa; Mary Marsh and Ken Greenwald. Absent: Barbara Stanhope. Staff present were City Manager Kerry Sweatt and City Secretary June Krause. Mayor Baldwin welcomed everyone to the meeting and led them in the Pledge of Allegiance. #1 APPROVAL OF MINUTES: Special Meeting of 5-11-94. Mr. Potempa moved to approve the minutes of the Special Meeting of May 11, 1994. Mr. Greenwald seconded the motion, which carried as follows: AYES: Councilmembers McDonald, Potempa, and Greenwald NAYS: None ABSTAINING: Mrs. Marsh #2 HEARING OF RESIDENTS: Mr. Jim Harris related that he had attended most of the Workshops and Council Meetings during the past yeari and at several of the hearings, he was the only participant. He said he was present for a hearing where there was standing room only with about twenty speakers and the Mayor handled it with no rowdinessi therefore, he did not see any reason for the ordinance on the conduct of meetings. He admitted that sometimes there are heated discussions at the workshops; but he felt that was good for the City. There are times when the participants get a little frustrating - he said he probably was one of those and felt sure Mr. Mower was. He just did not see any need for this ordinance at this time. Mr. George Mower said he had been given a copy of this ordinance by Mr. Harris and can not see how this can be proposed when the law of the land is one man, one vote. He mentioned that the way he read this, you would have to violate the charter to get something on the agenda. He said he had never heard of a charter anywhere where one man could not put something on the agenda. Mayor Baldwin thanked these two men for their input. #3 ORDINANCE: Mayor Baldwin introduced an ordinance and read the caption as follows: 166 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES, CITY OF SCHERTZ, TEXAS BE AMENDED BY REVISING SECTION 18-91 PARKING PROHIBITED, OF SAID CODE. Mayor Baldwin summarized by saying this ordinance will prohibit parking on the west side of Mill Street fifty feet back south from FM 78. Mrs. Marsh moved to approve the first reading of an ordinance amending the Code providing for "No Parking" on a portion of Mill Street. Mr. Greenwald seconded the motion, which carried with the following vote: AYES: Councilmembers Greenwald. NAYS: None McDonald, Potempa, Marsh and #4 ORDINANCE: Mayor Baldwin introduced an ordinance and read the caption as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS AMENDING SECTION 2-2 OF THE CODE OF ORDINANCES ESTABLISHING RULES, TIMES AND PROCEDURES FOR CONDUCTING CITY COUNCIL MEETINGS. Mrs. Marsh moved to approve the first reading of an ordinance establishing procedures for the conduct of Council meetings. Mr. Greenwald seconded the motion. Mr. McDonald agreed with Mr. Mower concerning the violation of the Charter when three Councilmembers would have to get together to put something on the agenda. Mrs. Marsh explained the way it is intended works realy well. For instance, if Mr. Potempa wants something on the agenda, he calls the City Manager who checks with the Mayor and then calls other members of the Council to see if anyone had any problem with it. Mayor Baldwin added that is the way it usually is handled and have not had any problems with the City Manager putting items on the agenda. Mr. Sweatt advised that this wording came from ordinances from several different cities in the state. After further discussion, Mayor Baldwin suggested taking out the word "three". Everyone agreed with that. 167 Mrs. Marsh changed her motion to aODrove the first reading of an ordinance as amended that establishes procedures for Council meetings. Mr. Greenwald seconded this amended motion, which carried as follows: AYES: NAYS: Councilmembers McDonald, Potempa, Marsh and Greenwald None #5 BUDGET REVISIONS: Consider and take action on the mid-year budget revisions. Mayor Baldwin referenced the memo from the City Manager, which noted the corrections that were made at the workshop. Mr. Potempa referred to the Fire Department budget, where $1,000 was deleted under clothing line item. He asked if there was any reason this could not be given to the volunteers. Mr. Sweatt said this was primarily moved to pay the costs of maintenance on fire apparatus and it may not even be enough. It is just an internal moving of the money. Mr. Potempa then asked if there was anything wrong with the Council helping the volunteers. Mr. Sweatt said it generally works the other way around. The Volunteers raise money to help the Fire Department. Mr. Potempa moved to approve amendments. Mr. McDonald seconded carried with the following vote: the mid-year the motion, budget which AYES: Councilmembers McDonald, Potempa, Marsh and Greenwald NAYS: None #6 CITY MANAGER'S REPORT: A. Called attention to an item sent to Council as result of the Texas Research League publication. The overall true tax rate for Schertz reflects a tax ranking of 312 among the 405 cities surveyed. That indicates that there are 311 locations with "true" taxes higher than Schertz and 93 with lower tax burdens. B. Reminded given by Earl to 6:00 p.m. them. Council of the Retirement/Anniversary party and Sakae Sawyer on Saturday June 11 from 3:00 They extend an invitation for everyone to join #7 ITEMS BY COUNCIL: Mr. McDonald reminded that he will be leaving for Alaska on Thursday and will not be back until the end of June. Mr. PotemDa asked for an item to be put on workshop to discuss the possible replacement of Parkway Tax Increment Financing Commission members. the next Schertz 168 Mrs. Marsh showed the posters for the Jubilee and read some of the features that will be going on, including the street dance on the 2nd of July, free dance and cloggers on the 3rd and the parade, opening ceremonies, choir, clogoers, dances, arts and crafts and the fireworks, which will take place at 9:15 p.m. on the 4th. She also mentioned that a lot of volunteers are needed to sell tickets and help at various places. Call Gail Douglas at the Library and volunteer. Hr. Sweatt said that, with Council permission, he would like to place on the next agenda the resolution concerning the area around the large pavilion for the street dance. Mr. Greenwald added that there will be a lot of arts and crafts booths and plenty of food. Mr. Greenwald reported on the latest CVADAC meeting, saying they are still active and do have a counselor who will be there Thursdays from 9:00 a.m. until 5:00 p.m. They recently received a check from the Guadalupe County United Way again. They are in business and office hours are from 9 a.m. to 3 p.m. *8 ITEMS BY MAYOR: Mayor Baldwin asked when would we . be ready to appoint Board of Adjustment members. Mr. Sweatt replied that he and the City Attorney are working on a draft ordinance that will address this and hope to have it ready in July.
