SPECIAL MEETING OF THE CITY COUNCIL
FEBRUARY 24, 1993
The Schertz City Council convened in Special Workshop
Session Wednesday, February 24, 1993 at 7:00 p.m. in the
Conference Room of the Municipal Complex, 1400 Schertz
Parkway, Schertz, Texas. The following members were
present: Mayor Earl W. Sawyer, presiding; Joe Potempa;
Hal Baldwin; Barbara Stanhope; and Ken Greenwald. Staff
present were city Manager Kerry Sweatt and City Secretary
June Krause.
#1 HEARING OF RESIDENTS: None
#2 Discussion of awarding bid on the City's uniform
contract.
Mr. Sweatt advised that proposals were mailed to ten
suppliers; however, only four bid proposals were received.
He said staff would like to do a little more analyzing of
the proposals and asked if this was accomplished and a
recommendation made would Council be willing to act at the
next regular meeting. Council agreed they would.
#3 Discussion of recommendation from Planning & Zoning
Commission regarding Live Oak Blvd. name change.
Mr. Sweatt commented that P&Z sees a need to extend Live
Oak Blvd.through Live Oak Hills eastward crossing F.M. 3009
and extending to Wiederstein Road on over to FM 1103. This
would give an East/West cross town thoroughfare. At this
stage, P&Z are still just discussing this but would like
Council's reaction to a name change, making the entire
length "Wiederstein Road". If Council has no objection, the
next steps would be to discuss this with both Selma and
Cibolo. With no objection from Council, P&Z would continue
with the plan and set up some hearings.
Mr. Greenwald said that we do not want a major road
three different names and we already have a Live Oak
which is a duplicate. Mr. Greenwald said this was
up at P&Z meeting because of some recent platting
area. This would give the City another major access
1518 and 1-35.

Mayor Sawyer asked if any member of Council objected and
received negative replies.
#4 Discussion regarding bidding and Public Works
contracts.

Mr. Sweatt reminded that for some time Council has
questioned why we receive a small number of bids on
different projects. The last one on the animal shelter,
where only one was received, really brought this to our
attention. Mr. Sweatt referred to his 2-1/2 page memo on
this, stating that bidding procedures are regulated by state
law, city charter and ordinances. The Local Government Code
provides that if the contract is for construction of public
works and is required to be submitted for competitive
bidding, the successful bidder must execute a good and
sufficient payment bond and performance bond. These bond
requirements often pose an obstacle to very small
contractors. We have also been told that often small volume
contractors are reluctant to bid public jobs because they
feel the time lag for payments will be too long or are not
justified.
Additionally, public works contracts require record keeping
for equal employment opportunity standards, Davis Bacon Act
wage determinations, various safety standards, including
OSHA and state trench safety standards. There is also a
recent state law relating to tax exemptions which has
precipitated a "separate contract" concept. All of these
tend to make qualified bidders reluctant to submit bids on
city work. He ended by saying we will continue to encourage
competitive bidding on all city work.
#5 EXECUTIVE SESSION: Mayor Sawyer called an
executive session at 7:10 p.m. under Article 6252-17
Vernon's Texas Civil Statutes, Section 2 (e) to discuss
pending or contemplated litigation with the city attorney.
The Special Meeting was reconvened at 7:46 p.m.
#6 Consider and take action, if any, on the above
executive session.
Mr. Greenwald moved to allow the lawyers to continue with
the litigation as discussed in the Executive Session. Mr.
Baldwin seconded the motion, which carried as follows:
AYES: Council members Potempa, Baldwin, Stanhope and
Greenwald.
NAYS: None
#7 CITY MANAGER'S REPORT: A. Announced that he and
Mark Marquez would be making a presentation Monday morning
to the Guadalupe County Commissioner's Court on tax
increment financing for Schertz Parkway. He invited all to
attend with them.

B. Spring Clean Up will be from March 27th through April
11th, with the dumpsters being located at the Alamo Waste
site on FM 3009. Also Alamo Waste will be picking up the
white goods this year, with the City only doing the chipping
upon prior request.
C. He asked Council for permission to remove the Escrow
Agreement with the Texas Department of Transportation. The
original request was for bus loading arrangements be made
along FM 3009 at the Cyrus McCormick and Eli Whitney
Cul-de-sacs. The School District had asked if the TDoT
would consider building a bus loading area and construction
of sidewalks in the area. However, because of the
configuration, they found that to be almost impossible. We,
and the School District concurs, the sidewalks will not be
necessary. The turn-off lane will stay but no sidewalks.
Council had no objections.
#8 ITEMS BY COUNCIL - Mr. Potempa: A. Asked if March 3rd
was still on for the FM 3009 bid letting. Mr. Sweatt
advised it is and said if anyone wanted to go for that to
let him know.
B. Advised that dumping is being done again on 13th row.
He saw a brown pickup there.
Mrs. Stanhope - Said the letter from the Texas Department
of Transportation angered her.
Mr. Greenwald - A. Asked if we had received official word
from the School Board as the current paper said they had
adopted the tax abatement policy. Mr. Sweatt said no.
B. On March 25th, the Main Street Gallery will be having an
Art Show co-sponsored by CVADAC. They will have local
artists, poetry readings, cheese and snacks, etc.
c. P&Z received a very preliminary plat for a Corridor 35
project. It looks like HEB and several other stores.
#9 ITEMS BY MAYOR: A. Had received a letter from the
Arlington City Council asking Schertz to pass a resolution
urging that legislation be passed for capital punishment for
anyone who takes the life of a child through abuse.
B. Referred to the letter from Mr. Brown that was in the
newspaper, saying that once again Mr. Brown does not come
to meetings and did not get his facts straight.
C. He mentioned that Mr. Jones of the Herald wishes us to
again open the bidding for official paper. Mayor Sawyer
said he should first get his permit to make his paper legal.

Mr. Sweatt advised that staff would be meeting with the
Gazette-Enterprise on Monday.
D. Had a proclamation from the Key Club on child abuse and
Mayor Sawyer asked that it be delayed until the next meeting
so it could be presented in conjunction with the like
resolution.
