S BOA 04-06-1993 129 BOARD OF ADJUSTMENT MEETING APRIL 6, 1993 The Board of Adjustment convened April 6, 1993 at 7:00 in the Council Chambers of the Municipal Complex, Schertz Parkway, Schertz, Texas. The following members present: Earl W. Sawyer, Chairman; Joe Potempa, Baldwin, Barbara Stanhope, Mary Marsh and Ken Greenwald. p.m. 1400 were Hal Chairman Sawyer opened the meeting by asking everyone to stand and join him in the Pledge of Allegiance. Before opening the first public hearing, Mr. Sawyer had the pleasure of presenting Mrs. Vivian Martinez with the "Star of the Month" award for March, 1993. #1 PUBLIC HEARING: The BOA to receive comments from the public on a request by Southwestern Bell Mobile System, Inc. for a Specific Use Permit allowing them to place a cellular telephone tower approximately 250 feet north of the intersection of IH-35 and FM 2252 on the east side of IH-35. Mr. Sweatt commented that notices were mailed to all property owners within three hundred feet of the area and we have not received any objections. The Zoning Ordinance specifies this as a Specific Use item. He then pointed out on the map the location of this property. Mr. Sawyer asked if there were any comments from the public and there were none. He then asked if the Board members had comments. Mrs. Marsh asked if we have been assured that this will not interfere with any of Schertz' communications and Mr. Sweatt said it would not. There being no further comments, Mr. Sawyer declared the public hearing closed at 7:04 p.m. #2' Consider and take action on the request for a Specific Use Permit by Southwestern Bell Mobile System, Inc. Mr. Greenwald moved to approve the request for a Specific Use Permit by Southwestern Bell Mobile System, Inc. Mrs. Stanhope seconded the motion, which carried with the following vote: AYES: Members Potempa, Baldwin, Stanhope, Marsh and Greenwald NAYS: None -, )0 -,-0 #3 request allowing holding prepared PUBLIC HEARING: The BOA to receive comments on a by Arthur Bartlett for a Specific Use Permit him to utilize five acres at 18701 IH-35 as a area for cars purchased and in the process of beinq for sale. Mr. Sweatt first apologized for sending members the wrong map of the location and handed out the correct one, pointing out on the wall map the location of this property. He said it is near the Stone Creek RV Park entrance and Bishop Center and along the roadway to the RV park. Planning & Zoning did review this request and recommends approval subject to certain fencing. Mrs. Marsh questioned the RV park owner's thoughts on this. Mr. Sawyer had talked with the RV park owner, Floyd McKee, who mentioned that he considered this to be an eyesore. He then asked Mr. Bartlett if he planned on keeping it from becoming an eyesore. Mr. Bartlett said no. This will be just a place to store cars until they are sold. Mrs. Marsh asked what kind of cars he was talking about and was told "Classic" cars that were being held and restored to sell. Mr. Bartlett added that the five acres would be fenced. Mr. Baldwin commented that you cannot see this property from IH-35 so of course, you could not see the cars. Mrs. Marsh stated that Mr. McKee is working to make his a 4-Star RV park and hold rallies and this could be seen from his property and could be an eyesore. Mr. Bartlett, on being asked, said the cars would probably be on the property for three or four months. Mr. Potempa said he was concerned that it would not get to look like the one across from Mobile Villa. Mayor Sawyer again said that Mr. McKee was concerned about seeing these junk cars as you drive into his RV park. Mr. Greenwald said that if Mr. Bartlett fences the other side from the park, they could not see anything. Mr. Baldwin asked if this man needed a Specific Use Permit on property that was zoned M-1. Mr. Sweatt said yes, because it relates to storage. Mrs. the only side Marsh ascertained that as you drive down the road entrance you could not see the cars. She said then thing to be concerned about would be on the back and an eight foot fence could be installed there. to the RV Mr. Bartlett said yes he would put in an eight foot fence. Mr. Sweatt advised that Planning & Zoning discussed a six foot fence; but of course it was the prerogative of the Board to stipulate an eight foot fence. There being no further comments from the Board or the public, Chairman Sawyer declared the public hearing closed at 7:12 p.m. #4 consider and take action on the request for a Specific Use Permit by Arthur Bartlett. Mr. Greenwald moved to approve the request for a Use Permit by Mr. Bartlett providing he put up foot fence on the back side of the property.
